Being humble of my mortality and desirous of disposing of my earthly estate, I make the following my last will and testament. I will that my land in Woodford County which amounts to about six hundred acres be divided and disposed of in the following manner: First, that two hundred and forty acres be surveyed off the tract on which I now live, the southern boundary to being the north line of Randolph Adams’ land which is the dividing line between him and myself - the two hundred and forty acres to be made by running from R. Adams line above named along my eastern and western lines northward to the public road which crofses the bridge and runs by Mt. Vernon Meeting House, and a line to crofs the road by Mt. Meeting House to Alexr Loufs line and down it until a line running back to the road will make the 240 acres. These two hundred and forty acres I asfifsn to include the house in which I now live, and the improvements together with the farm which I now occupy. I give and bequeath the free of land 240 acres to my son David Harris forever, to be ocupied however by my wife, Ellinor Harris and David my son until he becomes of age, unlefs she should marry, and in that case should she choose to occupy it she is to pay one half of the annual value of the rents of the 240 acres to my executors for my son David to his estate until he comes of age - If she chooses to have it in case of her marriage she is to derive no advantage from it. Second, the ballance of my land, which I suppore will amount to 300 acres I give and bequeath to my son, Randolph Dieuguied Harris with all the improvements thereon, with the exception of half an acre which lies near to which part of the Mt. Vernon Meeting house now stands, which I give to the Church of Christ that now meets there to be used for the convenience of public worship. I will that all my livestock and my crops on hand be sold on a credit of one year and that the amount of the sales be equally divided between my son R. Dieuguied and my son David and his mother. I will and devifs that Randolph D. have one half and the other half to be equally divided between my wife Ellinor and my son David, to be theirs forever. I do moreover will that the hire of negroe slaves hereafter mentioned be equally divided between my son R. D. Harris and David and his mother, that is, that R. D. Harris have one half of the hire and David and his mother Ellinor Harris have the other half the latter half to be divided between David and his mother Ellinor to be theirs forever. I will moreover that all my house hold furnature and farming utensils be sold, except what I got off my wife Ellinor, at a years credit and that the money arising therefore be divided or before directed viz. one half to be given to R. D. Harris, and the other to David Harris and his mother the latter half to be equally divided between them - and that all the property and claims my wife Ellinor got from her former husband as duelr (dower) or other words she retain to have and dispose of as she may think for her - I bequeath to her Ascy to do with as she may please. The foregoing bequests and allowances I have made to my wife Ellinor in place of her dower. It is my will that my old man Bob be free and that he have paid to him fifteen dollars yearly as long as he may live and that he be permitted to occupy the cabin in which now lives. I moreover will that Duke, Jeny, Rose and Judy be free - I will moreover that Jerry & Ben be hired out for thee years and then be free and that Peter be hired out six years and then be free and that Parker and Sam be hired out for ten years and then be free. And that Woodson be hired out eleven years and then be free and that Jefferson, Madison, Jack and Spencer be hired out twelve years and then be free and that Henrietta be hired out eleven years and then be free and that Sally be hired out fifteen years and then be free and that Rebecca be hired sixteen years and then be free - and that Matilda be hired out for seventeen years and then be free - and that all that are young and who have not been named are to be raised and hired out until they are twenty five years old and then to be free, and all the children that may be born of the females or of their children before that they become free by the __ of this will be raised and hired out until the arrive at the age of twenty five years and then be feee - the money for which the negroes may be hired or which may be obtained for their hire is to be divided as before directed. Should my sons Randolph Dieuguied Harris and David Harris die before they become of age or have heirs of their own body, two hundred acres of the land aforesaid lying on the south side of my tract of land, I will and bequeath to my nephew David Harris son of my brother Randolph Harris. It is my will that the blacksmith shop now occupied by Mr. Swofger be the property of my son R. D. Harris with the ground on which it stands and that my blind boy John be put into some factory where he will be supported. I moreover will that Robert McCrary have a home and be supported in my house as long as he lives. I do hereby appoint Turner Branham my Executor and guardian to my son Randolph Dieuguied Harris, and my son David Harris Witnefs (signatures) James Fishback David Harris David Harris (two signatures) Robt Moffett Commonwealth of Kentucky Woodford County June County Court 1835 The foregoing Testament of writing purporting to be the last will and Testament of David Harris dec’d was produced in court and proven in part by the oaths of James Fishback one of the witnefses thereto and confirmed for further proof and after__ . At the subj county court 1835 was again produced in court and fully proven by the oath of Robert Moffett a witnefs thereto and ordered to record. Whereupon Turner Branham the executor therein named came into court and took the oath required by law of executor and acknowledged bond with Daniel I. Williams and Isaac Williams as his securities in the sum of twenty five thousand dollars conditioned according to law.
