That it is now necessary that some one should be appointed administrator of his estate as said estate is owing debts which will require a part at least of the above property to be sold and an estimative inventory should likewise be ordered as provided by law. Wherefore petitioner prays that her applications to be appointed administratix of the estate of her said husband be duly published; that an estimative inventory be ordered to be taken as provided by law, and that in due course petitioner be appointed and qualified as administratrix of his estate on complying with the requirements of law, then she prays for all further necessary orders and decrees, for cost and for general relief. The petition of Mrs. Ada Welch Taylor, surviving spouse of Uriah Taylor-- RESPECTFULLY REPRESENTS:-- That her said husband died in the Parish of Acadia, Louisiana, several years ago, and that she has qualified as natural tutrix to her said minor children, Frances Lillian, Florence Vivian, Etta Ona, Beatrice Bela and Asa Leon Taylor, issue of her marriage with her deceased husband, and that the only other issue of her marriage is a son, a major, Louis Clinton Taylor, who has been duly appointed and qualified as under tutor to her afore-named minor children. Your petitioner further represents that the estate of her said husband has been duly opened in the Parish of Acadia. That an inventory of all his property, real and personal, has been taken and that all of the said property so inventoried belongs to the community of acquets and gains formerly existing between herself and her said deceased husband, and that the property is now owned in common between herself and her said children in indivision she being the owner of and undivided one half thereof, and her said children including the major, being the owner of the other undivided one half or of Six Twelfths (6/12), and that her minor children, hereinabove named, are the owners of an undivided Five Twelfths (5/12) of all of the said property owned in common between them, as aforesaid. That the real estate consists of the following described property, situated in the Parish of Acadia, to-wit:- That certain tract or parcel of land, situated in this Parish and State, lying and being in that portion of the country known as Long Point Woods, and in Section No. Four (4) Township Nine (9), South of Range One (1) East, and known and described as beginning at a point Twelve Chains and Thirty-One (12.31) Links South of the centre of said Section Four (4); thence S. Eighty nine degrees 47' W., a distance of Twenty (20) Chains and Thirty (30) Links to a point; thence S. 0. degrees 31' E., a distance of Nineteen Chains (19) and Seventy-One (71) Links to a point; there N. Eighty-nine (89) degrees and 47' E. a distance of Twenty (20) Chains and Thirty (30) Links to a point on the dividing line of the East One Half (1/2) & the West One Half (1/2) of said Section Four (4); thence N. 0. Another tract of land, also situated in Acadia Parish, Louisiana, and acquired by Uriah Taylor, deceased, from the United States Government under the Timber Culture Act, and described as the North-west (1/4) of Section No. Twenty-eight (28) on Township No. Eight (8), South of Range No. One (1), East, Louisiana Meridian, and containing One Hundred and sixty-one and 25/100 (161.25) Acres, with all the buildings and improvements situated thereon. Your petitioner further represents that in the inventory said tract first above described was appraised at the sum of Sixty ($60.00) Dollars; the tract secondly above described at the sum of Five Hundred and seventy-five ($575.00) Dollars, and the tract thirdly described at the sum of Eight hundred and ten ($810.00) Dollars, and that the movable property, accounts, etc., described in the inventory amounts to the sum of Nine Hundred and twenty-eight - 16/100 ($928.16) Dollars, all of which will more fully appear by reference to the said inventory on file in suit No. 273, on the Probate Docket of this Honorable Court, entitled "Estate of Uriah Taylor, deceased." Your petitioner further represents that the experts appointed by this Honorable Court, and duly qualified, have appraised the said property at the above figures. Your petitioner further represents that she no longer desires to hold any of the said property in common with her said minor children, but that she desires to have all of the property, real and personal, rights and credits, as hereinabove described, and mentioned in the inventory, adjudicated to her at the price of the estimation thereof fixed by the said experts duly appointed and qualified as aforesaid. That the following named parties are the nearest relatives to her said minor children, to wit;- John Welch and Gabriel Harmon, great Uncles of the said minors; Aristide Rue and Dallas Green First Cousins on the Paternal side, and Ivy Welch, Second Cousin on the Maternal side, and that they are the proper parties to compose the said family meeting to decide whether the adjudication to her of all of the above described property is to the interest of the said minors. Therefore your petitioner prays that a family meeting in behalf of her foresaid five minor children be held before Gus E. Fontenot, Notary Public, in and for the Parish of Acadia, State of Louisiana, to declare whether or not the said adjudications is for the interest of the said minors; that the under-tutor said minors, Louis Clinton Taylor, be duly notified to attend said family meeting, and that all such other orders and decrees may be granted that might be necessary or proper in the premises. Fontenot, Notary Public, in and for the Parish of Acadia, Louisiana, on a day and date to be fixed by him, to deliberate and give their opinion and advice on the subject matter of the above petition; said family meeting to be composed of the following persons, to-wit:- John Welch, and Gabriel Harmon, great Uncles of the said minors; Aristide Rue and Dallas Green, First Cousins of the said minors, and Ivy Welch, Second Cousin of the said minors, they being the nearest relatives of the said minors living within the distance prescribed by law of the Court House of the Parish of Acadia, and let Louis Clinton Taylor, the under-tutor of the said minors, be notified to attend the said family meeting. Considering the foregoing petition and the documents attached, and the law, it is therefore Ordered, Adjudged and Decreed that the deliberation of the family meeting held in behalf of the minors, Frances Lillian, Florence Vivian, Etta Ona, Beatrice Bela, and Asa Leon Taylor, before Gus E. Fontenot, Notary Public, on the 17th day of February 1903, be approved, homologated and made the judgment of this court. It is further Ordered, Adjudged and Decreed that the interest of the above named minors in and to the following described real estate and the movables, etc. described more particularly in the inventory herein, the interest of the said minors amounting to Five Twelfths (5/12) of the whole; all of said property being held in common between the said minors, their major brother and their mother, Mrs. Ada Welch Taylor, surviving spouse, to-wit;- 1st. That certain tract of parcel of land situated in this Parish and State, lying and being in that portion of the country know as the Long Point Woods and in Section Four (4), Township Nine (9), South of Range One (1), East, and know ad described as beginning at a point twelve chains and thirtyone links South of the centre of said Section Four (4); thence South 89 degrees 47' West, a distance of Twenty chains and thirty links to a point; thence South 0 degrees 31' East, a distance of Nineteen chains and seventyone links to a point; thence North 89 degreed 47' East, a distance of twenty chains and thirty links to a point on the dividing line of the East One Half (1/2) and the West One Half (1/2) of the said Section Four (4); thence North 0 degrees 31' North, a distance of Nineteen chains and seventy-one links to the place of beginning; containing Forty (40) acres. 2nd. Another tract of land in Acadia Parish, Louisiana, described as the West One Half (1/2) of the South-west Quarter (1/4) of Section Twenty-one (21), and the East One Half (1/2) of the South-east Quarter (1/4) of Section Twenty (20), in Township Eight (8), South of Range One (1), East, Louisiana Meridian, containing One Hundred and sixty - 88/100 (160.88) acres. 3rd. Another tract of land also situated in Acadia Parish, Louisiana, and described as the North-west Quarter (1/4) of Section Twenty-eight (28), Township Eight (8), South of Range One (1), East, Louisiana Meridian, containing One Hundred and sixty one - 25/100 (161.25) Acres, with all the buildings and improvements thereon be adjudicated to their mother, Mrs. Ada Welch Taylor, for the price and sum of Nine Hundred and eighty-eight -.81.2/3 ($988.81 2/3) Dollars; this being the amount of the appraised value of the interest of the said minors in the said property, real and personal, rights and credits; the said real estate to remain specially mortgaged and hypothecated in order to secure the rights of said minors in capital and interest.
