Succession of Fourteenth Judicial District No. 708 Court of Louisiana Sitting Mrs. Emily Perkins, Deceased and for Allen Parish Petition To The Honorable Judges Of Said Court: The petition of Odis P. Perkins, Administrator of the above numbered and entitled Succession, with respect represents: ( I ) That he has filed his Final Account herein and that the same has been finally approved and homologated by judgment of this Court on the 8th day of April, 1935. ( II ) Your petitioner further represents that since the judgment was rendered in this Court on April 8, 1935, approving and homologating the Final Account of the Administrator herein and ordering a distribution of the funds in accordance with the Final Account as amended, one of the heirs of the said decedent has departed this life, viz: Ira Perkins, who departed this life in Allen Parish on the 29th day of April, 1935; that the said Ira Perkins was married but there was no issue of this marriage and the said Ira Perkins left no forced heirs and that therefore, his undivided interest in the real estate herein after described as belonging to the said estate is inherited by the other heirs as hereinafter set out. ( III ) That your petitioner has paid all the creditors of this estate the various amounts due them, as fixed and determined by the said account and judgment as aforesaid, and as will more fully appear from vouchers annexed hereto and made a part hereof; that the following described real estate is owned by the said succession as shown in the said final account,to-wit; The Northwest quarter of the Southwest quarter (NW=BC of SW=BC) of Section Seven (7), Township Three (3) South, Range Six (6) West of the Louisiana Meridian, Beauregard Parish, Louisiana; that he now desires that the heirs be placed in possession of the said real estate in undivided proportions as follows, and as shown in Exhibit =93E=94 of the said Final Account, to-wit: Will Perkins . . . . . . . . . . an undivided 1/12 George A. ( IV ) That the said property is not subject to the payment of any inheritance tax of this State as shown by the Inventory filed herein, but that a Rule is necessary on the Sheriff and ex-officio Tax Collector of this Parish to show cause, if any he may have, why the said property should not be decreed to be free from the payment of any inheritance tax. Wherefore, premises considered, your petitioner prays that a rule be issued herein directed against the Sheriff and ex-officio tax collector of this Parish to show cause if any he may have why the property belonging to this Succession should not be decreed to be free from the payment of any inheritance tax of this State; That after due hearing the said Rule be made absolute and that the property be decreed to be free from the payment of the inheritance tax of this State; That the said heirs named herein be recognized as the sole surviving forced heirs of the said decedent, and such entitled to the ownership of the said property in the proportions hereinabove set out. That your petitioner as Administrator be now relieved and discharged from all further trust and responsibility as Administrator of this Estate, and that his Bond as such be ordered cancelled and the Surety thereon released.
