Be it remembered that on this the twenty first day of September, In the Year of Our Lord One Thousand Eight Hundred and Seventy two, Before me, Charles A. Younger, Recorder of the Parish of Ascension, duly commissioned and qualified, herein residing and acting Ex officio as a Notary Public and in the presence of the Witnesses hereinafter named and undersigned. Personally came and appeared “First” Mr. Joseph Pertuis, of lawful age, residing in the Parish of Ascension aforesaid who declared that he has and doth by these presents Grant, bargain, cede, sell, convey, transfer, set over and deliver with free and legal guarantee and with special subrogation to all of his rights and actions of warranty against any and all previous owners and possessors thereof. Unto Messrs. Alfred Plaisance and Prosper Plaisance, both residing in said Parish of Ascension, here present and accepting, purchasing for themselves, their heirs and assigns in the proportion of one undivided half each, hereby acknowledging due delivery and possession thereof all and singular, the following described property, to wit: A certain lot or tract of land, being and situated in this Parish on the left Bank of the Mississippi River, about three miles below the town of Donaldsonville, measuring one half arpent front, on said river, with a depth of one arpent, bounded above by lands formerly belonging to Mrs. John Marchand, below by lands belonging to John Burnside and in the rear by lands of Mrs. John Marchand, being the property of the present Vendor for having purchased the same of Mrs. Andrew Marchand by authentic act passed before the undersigned Recorder on the 14th day of February, Eighteen Hundred and Seventy, and is of record in this Office. This sale is made and accepted for and in consideration of the full sum, and price, of One Hundred and fifty Dollars “Cash”, the receipt whereof is hereby acknowledged by the present Vendor, who grants a full and valid acquittance, discharge and release therefor. The undersigned Recorder certifies that there are no mortgages recorded in this Office against Mr. Jos. H. Pertuis, his wife, or anyone else bearing upon said property now personally conveyed. And also personally came and appeared Adam M. Guidry, also a resident of this Parish, who declared that he has and does, by these presents, grant, bargain, cede, sell, convey, transfer, set over and deliver with full and legal guarantee unto the said Messrs. Alfred Plaisance and Prosper Plaisance and accepting purchasing for themselves, their heirs and assigns likewise in the properties of one undivided half each, hereby acknowledging due delivery and possession thereof, all and singular, without reserve, the following described moveable property, to wit: All of the improvements now situated and being upon the tract of land sold this day by Mr. Joseph H. Petruis to the said Alfred and Prosper Plaisance and fully described above, to which due reference is hereby made, together with the entire contents of said improvements occupied as a store by the said AM Guidry goods and merchandize of various description. This sale is made and accepted for and in consideration of the full sum of Two thousand, three hundred and thirty eight Dollars and forty cents, payable in the following manner, to wit: The sum of Three hundred fifty dollars “Cash” the receipt of which is hereby acknowledged by AM Guidry Vendor who grants a full and valid acquittance, discharge and release therefor, and the balance of said purchase price payable at two, four, six and eight months from the date hereof. In representation of which said credit sum, the said purchasers have made under date and subscribed their four several joint promissory notes cash down to the order of said AM Guidry and endorsed by Prosper Plaisance Sr. And made payable on the 21st day of November 1872 and one on the 21st day of January 1873 and one of the 21st day of March 1873, each for the sum of five hundred Dollars and another for the sum of four hundred and eighty-eight dollars and forty cents, payable on the 21st day of May, 1873.. Each of said notes, numbered from Nos. one to four inclusive, which said notes, after having been paraphed and signed by me Recorder “Ne Veritur” in order to identify them with the present act were handed to the said Adam Guidry who acknowledges the receipt thereof. And in order to secure the full and final payment of said above described notes, at their respective maturity, capitol and eventual interest the said Alfred Plaisance and Prosper Plaisance do by these presents specially mortgage and hypothecate in favor of the said Adam M. Guidry, his heirs or assigns or any future “bona fide” holder or holders of said notes all and singular the following described property, to wit: A certain tract of land, lying, being and situated in this Parish upon the Left Bank of the Mississippi River, at about three miles below the town of Donaldsonville, measuring one half arpent front on said River with the depth of one arpent bounded above by lands formerly belonging to Mrs. John Marchand, below by John Burnside and in the rear by lands of Mrs. Marchand, together with all the buildings and improvements thereon and thereunto belonging, Entire contents of Store and all appurtenances thereof, the said above described property to remain thus mortgaged in favor of the said AM Guidry until the full and final payment of said above described notes, the said Mortgagers themselves not to sell, alienate or in any manner encumber the said above described mortgaged premises to the prejudice of this act. To have and to hold the said above described property unto the said purchasers, their heirs and assigns in their proper use and behalf forever. The said Vendors binding themselves by these presents to forever warrant and defend said property against the lawful claims of all persons whomsoever. Revenue stamps to the value of Three dollars are hereunto affixed and cancelled as duty in the present act. Thus done, passed and signed at the Parish of Ascension aforesaid, on the day, month and year first herein before written in the presence of Messrs. James H. Proffitt and Antoine P. This sale is made and accepted for and in consideration of the sum and price of one hundred and fifty dollars cash the receipt whereof is hereby acknowledged by the present Vendor, who grants a full and valid acquittance, discharge and release therefor (sic): The Undersigned Recorder certifies that there are no mortgages recorded in this office against the said Jos. H. Pertuis in favor of his wife, or any one else bearing upon said property now presently conveyed. And also personally came, and appeared 2dly Mr. Adam M. Guidry also a resident of this Parish, Who declared that he has and does by these presents, grant, bargain, cede, sell, convey, assign, transfer, set-over and deliver with full and legal guarantees Unto the said Mssrs. Alfred and Prosper Plaisance here present and accepting purchasing for themselves, their heirs, and assigns, likewise in the proportion of one undivided half cash hereby acknowledging the following described movable property, to wit: All of the improvements now situated and being upon this tract of land Sold this day by Mr. Joseph H. Pertuis to the said Alfred and Prosper Plaisance and fully described above, to which due reference is hereby made, together with the entire contents of said improvements now occupied as a store by the said A. M. Guidry. Consisting of Groceries and merchandize of various description. This sale is made and accepted for and in consideration of the full sum and price of two thousand three hundred and thirty eight dollars and forty cents payable in the following manner to wit: The sum of three hundred and fifty dollars “Cash” the receipt whereof is hereby acknowledged by the said A.M. Guidry (Vendor) Who grants a full and valid acquittance discharge and release therefor (sic) and the balance of said purchase price payable in two, four, six and eighth (sic) months from the date hereof. In representation of which Credit sums the said purchasers have under date hereof made and subscribed their four several joint promissory notes each drawn to the order of Adam Guidry and endorsed by Prosper Plaisance Sr. And made payable one on the 21st day of November 1872 and one on the 21st day of January 1873 and one on the 21st day of March 1873, each for the sum of five hundred dollars. And another for the sum of Four hundred and eighty-eight dollars and forty cents payable on the 21st day of May 1873. Each of said notes being numbered from one to four inclusive which said notes, after having been paraphed, and signed by me Recorder “ne Varitur” in order to identify them with the present act were handed over to the said Adam Guidry who acknowledges the receipt thereof. And in order to secure the full, and punctual, payment of said above described notes at their effective maturities in Capital and eventual interest the said Alfred Plaisance and Prosper Plaisance do by these presents specially mortgage and hypothecate in favor of the said Adam M. Guidry his heirs or assigns or any other future “bona fide” holder, or holders, of said notes all and singular the following described property to wit: A certain tract of land, lying being and situated in this Parish upon the left bank of the Mississippi River, at about three miles below the town of Donaldsonville measuring one half arpent front on said river with the depth of one arpent bounded above by lands formerly belonging to Mrs. Amedoine Marchand, below by John Burnside and in the rear by lands of Said Mr. Marchand, together with all the buildings and improvements thereon and thereunto belonging. Entire contents of store and all appurtenances thereof. The said above described property to remain thus mortgaged in favor of the said A. M. Guidry until the full and final payment of said above described notes, the said mortgagors binding themselves not to sell, alienate, or in any manner encumber the said above described mortgaged premises to the prejudice of this act. To have and to hold the said above described property. Unto the said purchasers their heirs and assigns to their proper use and behalf, forever. The said vendors binding themselves by these presents to forever warrant and defend said property against the lawful claims of all persons whomsoever. Younger Recorder Ascension Parish Courthouse Conveyance Records Book 30, p. 320 United States of America. The State of Louisiana. Parish of Ascension. Before me Robert N. Sims, Notary Public in and for the Parish of Ascension, duly commissioned and qualified and in the presence of the subscribing witnesses. Personally came and appeared Alfred Plaisance and Prosper Plaisance of the Parish of Ascension, who declared that in consideration of the price herein mentioned and Stipulated, they do by these presents transfer, convey, sell and deliver unto John Burnside of the city of New Orleans, here present and accepting this sale for himself, his heirs and assigns the following described property. Situated in the Parish of Ascension. Viz - A certain piece or tract of land, situated about three miles below the town of Donaldsonville on the left bank of the Mississippi River, measuring one half arpent front on Said River by one arpent in depth, bounded above by land belonging to the Hopeful Baptist Church, below by lands of the present vendor and in the rear by lands of Mrs. John Marchand together with all of the buildings and improvements thereon and thereto attached without exception or reservation. The said parcel of land being formerly a part of Lot No. 2 of the Marchand Plantation as designated on a plan thereof made by Valenin Sulakorski, Surveyor and now deposited and on file in Office of the Recorder of the Parish of Ascension, and was acquired by the present vendors from Joseph H. Eutnis, by Notarial Act passed before Chas. A Younger, Recorder of the Parish of Ascension on the 21st of September 1872. To have and to hold the above described property to the said vendee, his heirs and assigns irrevocably and for Ever by virtue of these presents. The said vendors hereby subrogating the said vendee to all of their rights and actions of warranty against all previous vendors and owners and warranting the said vendee specially against all claims, debts, mortgages or other encumbrances against said property herein sold. This sale is made for and in consideration of the price and sum of Seven hundred Dollars cash in United States Treasury Notes. The receipt whereof is hereby acknowledged and full acquittance Given therefor (sic). The parties to this act hereby dispence (sic) with the producting (sic) of the certificate of Mortgages from the Recorders Office of this Parish required by article 3364, of the Revised Civil Code and exonerate the undersigned Notary from all responsibility in the premises. Gecks, Recorder Ascension Parish Courthouse Mortgage Records Book 14, P. 379 Lapene and Ferre vs No. 371 A & P Plaisance Parish Court Parish of Ascension State of Louisiana This case came up regularly for trial and the Court being satisfied that the Plaintiffs have fully made out their case - it is ordered, adjudged and decreed that Plaintiffs Jules Lapene and August Ferre do have and recover judgement against Alfred Plaisance and Prosper Plaisance in solido in the full sum of Two hundred and Eighty nine Dollars and six cents, with five per cent per annum interest from the 14th day of July 1873 until paid with costs of suit. Recorder of Ascension Parish Ascension Parish Courthouse Mortgage Records Book 14, p. 313 In the Parish Court of Ascension Lucien Gex vs. No. 357 A & P Plaisance A judgement by default was regularly taken against Alfred Plaisance, one of the defendants in the above Suit, and the judicial days having elapsed without any answers being filed or any appearance whatsoever made by said Defendant. By reason of said Default and by further reason of the law and evidence being in favor of Lucien Gex, Plaintiff and against Alfred Plaisance Deft. It is ordered adjudged and decreed that judgement be and the same is hereby rendered in favor of Lucien Gex and against Alfred Plaisance individually and as a member of the commercial firm of A & P Plaisance for the full and entire sum of One Hundred Eighty nine 33/100 Dollars with legal interest thereon from Judicial demand on the 25th day of April 1873 and all costs of suit. Who declared that in consideration of the price hereinafter stipulated and mentioned he does by these presents, sell, transfer and convey unto A. Victor Farride, of said Parish, here present and accepting this sale for himself, his heirs and assigns, all and singular the property hereinafter described, viz: The entire contents of a certain store belonging to the vendors, A&P. Plaisance which said store is situated in the Parish of Ascension, on the Left Bank of the Mississippi River, about three and one half miles below the Town of Donaldsonville, on a certain tract of land which the said vendors lately acquired from Adam Guidry of the said Parish of Ascension. The contents of said store consist of a stock of goods and merchandize, dry goods and groceries, notions, hardware, Tinware, hats, caps, Boots, shoes, crockery ware, Trunks and valises, etc., etc., Together with the good will of said firm in said Parish of Ascension. To have and to hold the above described property to the said Vendor, his heirs and assigns, irrevocably and forever, by virtue of these presents, the said vendors hereby subrogating the said vendee to all of their rights and actions against all previous vendors and guaranteeing specially the said vendee against all claims and privileges whatsoever against said property. This sale is made for and in consideration of the price and sum of Four Thousand Two Hundred Dollars, payable as follows, viz: In equal installments of Three Hundred Dollars every Three months commencing from this date with interest thereon from and after maturity at eight per cent per annum until final payment. In representation of the said purchase price, the said A. Victor Farride has executed and subscribed his fourteen certain promissory notes, of this date each for the sum of Three Hundred Dollars, to his own order and by him endorsed in Blank, and payable at the Office of the Recorder of Ascension, respectively in three, six, Nine, Twelve, Fifteen, Eighteen, Twenty-one, Twenty Seven, Thirty, Thirty Three, Thirty Six, Thirty Nine and Forty Two months from this date, with interest from and after their respective maturity at eight per cent per annum which said notes were by me delivered into the possession of the said Alfred Plaisance, who hereby acknowledges the delivery of the same. Thus done and passed at my office in Donaldsonville this Twenty seventh 27th day of March 1873 in the presence of Mssrs. Sims, a Notary Public, in and for the Parish of Ascension, duly commissioned and qualified, and in the presence of the subscribing witnesses, Personally came and appeared Alfred Plaisance of the Parish of Ascension, and representing herein the commercial partnership of A & P Plaisance, the said partnership being composed of appearer and Prosper Plaisance Jr., who declared that said A & P Plaisance are jointly indebted unto Adam Guidry of this Parish in the following Sums, viz: In the sum of Five Hundred Dollars due 21st of March 1873 and in the further sum of Four Hundred and Eighty Eight Dollars and Forty cents represented by two promissory notes, one for Five Hundred Dollars and the other for Four Hundred and Eighty Eight Dollars and Forty cents, subscribed by said A & P Plaisance payable respectively 21st of March and 21st May 1873, to the order of Adam Guidry and secured by special mortgage on a certain Lot of ground and the improvements Thereon, situated in this Parish as per act passed before Chas. A. Younger, Recorder of the Parish of Ascension, under date of 21st of September 1872. Now in order to more fully secure the payment of said two notes at the respective dates hereinafter mentioned, the said A & P Plaisance in consideration of the indulgence and further time, granted to them by the said Adam Guidry, for the payment of said Two notes, have given to him the said Guidry, as a pledge, the following described promissory notes viz: Two certain promissory notes subscribed by A. V. Panide of Donaldsonville, La. March 27th 1873, each for the sum of Three Hundred Dollars to his own order and by him endorsed in blank, payable respectively in three and six months after date at the Recorders Office of the Parish of Ascension, with interest thereon, from and after maturity, at the rate of eight per cent per annum until final payment. In consideration, of said pledge to him herein made and acknowledging due delivery to him of said two notes above described, the said Adam Guidry here present and accepting the said pledge binds himself to extend the payment of said Mortgage note of Five Hundred Dollars to the first day of May 1873, and to extend the payment of said Mortgage note of Four Hundred and Eighty Eight Dollars and Forty cents to the first day of December 1873, the said Adam Guidry binding himself further to make no disposition of said Two mortgage notes to the ____ of this agreement. Thus done and passed in my Office, in Donaldsonville Parish of Ascension, this 29th day of March 1873 in the presence of Mssrs. Gecks Ascension Parish Courthouse Mortgage Records Book 17, p. 679 Leon Dupart et al to Prosper Plaisance State of Louisiana Parish of Ascension This indenture made and entered into this day between Prosper Plaisance and Leon Dupart witnesseth, That Leon Dupart in consideration of the Sum of One hundred dollars payable as needed and from March 10th 1884 to 1st October 1884 Pledges his crop of Cotton on his small Plantation in the rear of Linwood Plantation in the Parish of Ascension State of Louisiana for the year 1884 and binds himself to ship the same to Prosper Plaisance for sale giving the said Prosper Plaisance the first lien and privilege on said Cotton crop and making payments out of the first Cotton sold to the extent of his Prosper Plaisance advances and interest at eight per cent per annum two and a half per cent commission on all advances from dates of payment made to said Leon Dupart until paid. Cantey Deputy Clerk and Recorder Ascension Parish Courthouse Conveyance Records Book 34, p. 209 State of Louisiana Parish of Ascension, Be it known on the day of the date hereof, and in the presence of the witnesses hereinafter named and undersigned before me Frederick Duffel a Notary Public in and for the Parish of Ascension, State of Louisiana aforesaid, duly commissioned and qualified, personally came and appeared Edmund Maurin Esq., acting by virtue of the power of attorney hereunto annexed, who declared that for the consideration, and upon the terms and considerations hereinafter expressed, he has bargained and sold and does by these presents, grant, bargain, sell, convey assign and set over with all legal warranties, unto and in favor of Prosper Plaisance a resident of said Parish of Ascension, State of Louisiana here present, purchasing and accepting and acknowledging due possession thereof, the following described - A certain tract of land in the Parish of Ascension on the left bank of the Mississippi River at about five miles above the town of Donaldsonville measuring half an acre front in said river by about thirty acres in depth (more or less) bounded above by lands of Mrs. Isidore Landry and below by lands of Daniel G. Neams together with all the buildings thereon and thereunto belonging - being the same property acquired by the present vendor from John Warner by act passed before Charles Gecks Recorder on the 26th of March 1878 and recorded in the Book of Conveyance No. 30 page 317. This sale is made for and in consideration of the sum and price of Five Hundred Dollars cash in hand paid by the said purchaser to the said vendor through his attorney in fact the said Edmund Maurin, who hereby acknowledges the receipt thereof. By the certificate of the State, Parish tax Collectors exhibited to me Notary it appears that all the taxes due to date on said property have been paid. The Certificate of Mortgages required by Article 8304 of the Revised Civil Code is waived by consent of parties who exempt me Notary from all responsibility in the premises. The foregoing Act was then read to the said parties and by them approved. Thus done and passed at my office in the Town of Donaldsonville in the presence of Christian Kline and Edward N. Keller the sum of twenty-five Dollars on account of the purchase price of a tract of land adjoining the Gem Plantation containing about seventeen and a half arpents and bounded above by lands of the Valey’s which property I have agreed to and do agree to sell to said C. A. Keller for the price and sum of Six Hundred and fifty Dollars ($650.00) payable One hundred and fifty Dollars cash on day of sale and balance four months from date of sale, interest at eight per cent after maturity. Sims, Jr., a Notary Public duly commissioned and qualified, in and for the Parish of Ascension, State of Louisiana, and in presence of the witnesses hereinafter named and undersigned, Personally came and appeared Mr. Prosper Plaisance, a resident of the Parish of Ascension, who declared that he did and does by these presents, grant, bargain, sell, convey, assign, set over and deliver unto Mr. Charles A. Keller a resident of the Parish of Ascension here present, accepting and purchasing for himself his heirs and assigns, all and singular, the following described, to wit: “A certain tract of land, situated in the Parish of Ascension, on the left bank of the Mississippi River at about five miles above the Town of Donaldsonville, measuring eighty feet more or less front on said river, with the depth thereto belonging bounded on the upper side by lands of Valery Jones and below by the Gem Plantation together with all buildings and improvements thereon and thereto belonging, being the same property which was acquired by the present vendor at a public sale made by the Sheriff of the Parish of Ascension on the 29th day of January 1885, under an order and decree of sale rendered by the District Court of said Parish, in the matter of the Succession of Benajah Gibson.” And now personally came and appeared, Robert N. Sims, a resident of the Parish of Ascension, who declared that the property above described was duly adjudicated to the vendor herein, Prosper Plaisance, as herein before set forth by him, that he immediately went into possession thereof as owner and has been ever since said adjudication, in the peceable (sic), undisturbed and continuous possession of the same as owner, that although there does not appear of record any proces verbal of said adjudication, said Plaisance title is good and valid; said adjudicatee settled the price of adjudication of said property and was at the time of the sale duly credited with the amount by the Executor of the deceased who was the latter’s universal legatee and successor and sole testamentary heir. The present purchaser declares himself to be satisfied with the foregoing declaration. To have and to hold the said above described property unto the said purchaser his heirs and assigns in full property forever, free from any lien, mortgage or encumbrance whatever, with full and general warranty of title, and with full subrogation to all the rights of warranty and all other rights as held by said vendor. This sale is made and accepted for and in consideration of the price and sum of Six Hundred and Fifty Dollars payable as follows, to wit: One hundred and fifty dollars in cash, which amount has been paid as the vendor acknowledges and for which he grants full acquittance to the purchaser and the balance of the price amounting to five hundred dollars payable in equal amounts in three and four months from the date with interest after maturity at eight per cent per annum until paid, in representation of which the purchaser has made and subscribed three promissory notes to this own order and by him endorsed in blank, one for the sum of one hundred dollars and one for the sum of One hundred and fifty dollars payable three months after date and one for the sum of two hundred and fifty Dollars payable four months after date which promissory notes, after being paraphed “ne varistur” by me, said Notary in order to identify the same with these presents, have been delivered to said vendor who acknowledges due possession and delivery thereof. And in order to secure more effectually the full and punctual payment of the aforesaid notes, together with all interest and costs that may accrue on the same, according to the tenor (sic) of said notes and the stipulations herein written, the said purchaser, in addition to the vendor’s lien and privilege, which is hereby expressly retained by said vendor, declared that he does by these presents especially mortgage and hypothecate the property herein conveyed, to the said vendor, binding himself, heirs and assigns, not to alienate, deteriorate, nor encumber the same to the prejudice of the mortgage. The said appearers agree to dispense with the certificate, required by Article 3364 of the Revised Civil Code of the State, and exonerate me, said Notary, from all responsibility on account of the non-production of the same. All of the State taxes upon said property have been paid, except tax of 1897, as evidenced by Tax Collector’s receipt in the possession of said vendor, which tax of 1897 purchaser will pay. Thus done and passed, at the residence of R.N. Sims in the Parish of Ascension on this 18th day of December Eighteen hundred and Ninety Seven in presence of Frank K. Sims and John S. Goudrau State of Louisiana Parish of Ascension Be it known, That on this Seventh day of February in the year One thousand Nine Hundred and Two, before me G. Adolphe Goudrau, a Notary Public, duly commissioned and qualified in and for the Parish of Ascension, State of Louisiana, personally came and appeared Prosper Plaisance, a resident of the Parish of St. James, State of Louisiana, who declared that for and in consideration of the price and sum of One Thousand 00/100 Dollars to be paid in the manner hereinafter mentioned and stipulated, he does by these presents grant, bargain, bargain (sic), sell, convey, assign and transfer with all the legal warranties and with substitution and subrogation to all of his rights against preceding vendors or owners unto C. Desire Goudrau a resident of the Parish of Ascension State of Louisiana here present and accepting and purchasing for himself his heirs and assigns, and acknowledging due delivery and possession thereof the following described property, to wit: A certain tract of land situated in the Parish of Ascension at about five miles above the Town of Donaldsonville, on the left bank of the Mississippi River, measuring one half of an acre front on said river by a depth of thirty acres (more or less) bounded above by the lands formerly belonging to Mrs. Isadore Landry now to the present purchaser, and below by the lands formerly belonging to Daniel G. Neams, now to the present purchaser, together with all of the buildings and improvements thereunto belonging, being the same property acquired by the present Vendor from Henry Warner by Act passed before Fred Duffel Notary Public of Ascension Parish on the 22nd of May 1888, and recorded in Book of Conveyances No. 34 Folio 208 et sig. Said purchaser to have and to hold the above described property for himself his heirs and assigns now and forever. This sale is made for and in consideration of the price and sum of One Thousand One Hundred 00/100 Dollars paid and to be paid as follows, to wit: Five hundred cash which the said vendor acknowledges to have received from the purchaser and for which he grants to the said purchaser full acquittance and discharge, and for the Balance of the purchase price say: Six Hundred Dollars the said purchaser has this day made and subscribed his certain promissory note to the order of himself and by himself endorsed in blank for the Sum of Six Hundred 00/100 Dollars payable on the 15th of January 1903 at the Bank of Ascension Donaldsonville La. And bearing interest at the rate of eight per cent per annum from date until paid, which note after being paraphed “Ne Varitur” by me, Notary, for identification herewith was delivered to the said Prosper Plaisance who acknowledges due delivery and receipt of the same. In case it becomes necessary to institute legal proceedings for the recovery of the amount of said note, or any portion thereof, the said Purchaser hereby binds and obligates himself to pay the fees of the attorney who may be employed for that purpose, which fees are fixed at the rate of ten percent on the amount sued for. Now in order to secure the full and punctual payment of said note in principal, interest, attorney’s fees and costs in case of suit the said Purchaser hereby recognizing the Vendor’s lien and privilege according to law in favor of said Prosper Plaisance, His heirs and assigns does further specially mortgage and hypothecate in favor of said Prosper Plaisance or any future holder or holders of said note with the pact de non alienendo, binding and obligating himself not to sell, encumber or alienate the same to the prejudice of this act, all and singular, the foregoing described and presently sold property, so to remain mortgaged and hypothecated until the full and final payment of said note as aforesaid. The said Purchaser further confers judgement in favor of said Prosper Plaisance or any future holder or holders or holders (sic) of said note, who, in the case the same is not paid at maturity, shall have the right to proceed for the collection whereof via excuitiva and said property shall be sold for cash without benefit of appraisement. The parties to this act hereby dispense with the production of the mortgage certificate as required by Article 3364 of the Revised Civil Code of this state and exonerate me, Notary, from all liability in the premises. All taxes on said property now due have been paid as evidenced by the Tax Collector’s receipts exhibited to me by the said Vendor. Thus done and passed at my office in the Town of Donaldsonville Parish of Ascension State of Louisiana on the day, month and year first above written and in the presence of Mssrs.
