J. Morris killed John Markham, both of Claiborne Parish, by stabbing him in the breast and side. It occurred at the house of Morris. The case was investigated before Judge H. A. Drew and Morris was discharged. In the Succession of John B. Markham dec'd Petition for Administration Filed August the 15th A.D. 1856 J. F. Stephens Clerk Recorded on page 258 Conn James Upshaw applies to administer estate of J.B. Markham for Sarah & children To the Honorable Judge of the 17th Judicial district of Louisiana in & for the Parish of Bienville, or to the Clerk thereof The petition of James Upshaw, a resident of the parish and State aforesaid respectfully represents, that John B. Markham, late of the same residence with petitioner, recently departed this life without having made any last will and testament, and leaving a small estate of real and personal property in your said parish, which has not been administered on. The deceased left no forcd? heirs of age and competent to administer on his estate, and it the desire of his surviving widow, a sister of petitioner that your petitioner should take upon himself the duties of administrator of said estate -- believing that it would be to her interest as well as that of the minor heirs- The jrennises? considered petitioner prays that he be appointed administrator of the Estate & Succession of John B. Markham, decd, and that after leagal notice by advertisement, letters of administration issue and be delivered to petitioner, upon giving bond and security, as the law directs. Petitioner further prays that some Notary Public be authorized to make & take an Inventory & appraisement of all the prooperty of said sucesson and prays for all orders necessary in the premises. G. Markham (Decd) Notwithstanding his application has been advertised according to law it is ordered that James Upshaw be appointed Administrator of the succession of John B. Markham Decd where his executing his Administration Bond with good & solvent security in the sum of twenty eight hundred dollars and taking the oath prescribed by law. Stephens, Clerk To the Honorable of the 17th Judicial District Court of the state of Louisiana holding sessions in and for the Parish of Bienville. The petition of Sarah Upshaw, a resident of said state and Parish with respect - shows that she is natural tutor of the minor children of John Markham Decd duly confirmed & sworn she futher shows that said minors are owners by inheritance from their Decd father of one undivided half of the following lands. T5 with the w 1/2 of N.E. 1/4 & the N.WE. 1/4 of NW 1/4 & S.E. 1/4 of NW 1/4 Sec. 34 & SE 1/4 of SAW 1/4 of Sec 27, T.15 R7 west 200 acres more or less and that the other half of said land is owned by your petitioner, it being community-property between petitioner and said Decd, she further shows that she is desirous of selling her interest in said land and that it is to the interest of said minors that said lands be sold especially their interest theirin in order to effect the final payment of all the debts of their decd father and in order that the ballance of the proceeds may be invested in a smaller tract and for many other beneficial purposes to said minors. Petitioner further shows that the interest of said minors requires the said land be sold and that a family meeting be convoked to give this advice as to wheather said land especially the interest of said minors therein shall be sold and appon what terms and to deliberate looking the interest of said minors ie the friends. Wherefore petitioner prays that a family meeting be convoked composed of John Upshaw & T. Allen Upshaw the only male relatives of said minors in law. Davis h [?] & E. N. Warren L. Young friends of said minors to deliberate to them the interest of said minors and to advise wheather it will be to their interest or not to sell their interest in said land and to fix the terms of said sale according to law & that a commission issue to J. Allen Upshaw, E. N. Warren, L. Eldridge, & John C. Young, relatives and friends of the minors of John B. Markum decd be convoked to deliberate upon the interest of said minors - It is further ordered that a commission issue to John G. Noles, Recorder, or any other lawful officer of the Parish of Bienville authorizing him to hold said family meeting. Done and signed by me officially on the day and date above. John F. Young - having been appointed by the District court in and for the Parish of Bienville members of a family meeting convoked for the petition of Sarah Upshaw, widow and marriage partner in community of John B. Markum decd to deliberate and advise what would be to the best interest of Permilia Ann, Tabitha, James M. John B., Emily Jane Markum, minors of Sarah Upshaw & issue of her marriage with John B. Markum deceased Do solemnly swear that we will faithfully and impartally discharge and perform all and singular members of family, to the best of our knowledge & abilities, so help me God. Eldridge The State of Louisiana Parish of Bienville Be it known, thereof, that on this the eighteenth day of November in the year of our Lord One Thousand Eight Hundred and fifty seven "AD.1857" By order and in obedience to authority and commission issue out of the District court held m-- arif for said Parish & state and to me the undersigned Recorder directs authorizing and requiring me said Recorder to convoke and hold a family meeting composed of John Upshaw and T.A. Upshaw, male relatives, and E. N. Warren, John C. Young and Lewis Eldridge, friends of Permilia Ann, Tabitha, James M, John B. and Emily Jane Markum, minor children of John B. Markum decd and issue of his marriage with Sarah Upshaw widow and surviving partner in community of said John B. Markum and convoked for the purpose of deliberating, advising and recommending what would be the interest of said minors in regard to the sale of their interest in a certain tract of land owned by them in common with their mother Sarah Upshaw and if advised to sell said land upon what terms, and after having sworn, said members, according to law, and after due and mature deliberation had upon the subject matter submitted to them were of opinion and advice that it would be to the interest of said minors to sell their interest in said land upon a credit of one and two years from date of sale, purchasers to give their notes with approved personal security - and a mortgage returned on the land to secure the jray? account of said notes given for the purchase price said notes bearing interest at 8 per cent per annum from date ---- James Upshaw, administrator of the aforesaid minors, being present concurs in the deliberations of said family meeting any cause such that the same be approved. Noles James Upshaw Recorders office Notary Public State of Louisiana Parish of Bienville Clerk's office, Sparta November the 23rd, 1857 On reading this written and foregoing petition it is ordered that the prayer of petitioner be granted that the lands refered to in the within and foregoing be sold at public auction to the highest bidder on a credit of one and two years purchases, to give their notes with approved personal security and a special mortgage on the lands sold to secure the payment of the purchase price and that said notes bear 8 percent from date until paid. And it is futher order that the proceedings of the family meeting be homologater [?] and approved, according to law. Thus done and signed by me officially on the day and date above. Written John F. Court The foregoing license was recorded this the 14th day of July A.D. 1843 The State of Mississippi, Noxubee County To any regular, ordained Minister of the Gospel, Judge, Justice of the Police Court, or acting Justice of the Pease, in and for said county, Greetings: You or either of you are hereby authorised to solemnize the rights of Matrimony, between John Markum and Miss Sarah Upshaw and join them together as man and wife in holy estate of wedlock; Your official Certificate whereof you are to return, together with the license, into the office of the clerk of the Probates Court of said county, within the time proscribed by law.
