J. Robertson herein authorized by her said husband; Farzano Broussard, nee Robertson, wife of D. H. Broussard, J. M. Bilbo, Natural Tutor of the minors Renie and Lawrence Bilbo; Nora Royer, nee, Bilbo, wife of Gus Royer, herein authorized by her said husband; Murl Royer, nee Bilbo, wife of Raymond Royer, herein authorized by her said husband; Miss Zorida Robertson; Seth Robertson; Marion Robertson; and Jasper N. Robertson; all residents of Calcasieu Parish, Louisiana, respectfully represents: 1. That Gabriel Robertson, departed this life, intestate, in the Parish of Calcasieu, State of Louisiana, on or about the 5th day of December A. D. 1918, leaving property, both personal and real, belonging to the Community of acquets and gains, between himself and his wife, Ellen Robertson, nee Prater, located in the Parish of Calcasieu, State of Louisiana, as hereinafter set forth. 2. That the said deceased Gabriel Robertson, left his wife, Ellen Robertson, nee, Prater who owns one-half of the property left by her said husband, and who is entitled to the usufruct of the other half thereof. 3. That the said Gabriel left the following children and forced heirs, they being the issue of his marriage with the said Ellen Robertson, viz; 1. Virginia Robertson, nee Robertson, wife of T. J. Robertson; 2. Fairsano Broussard, nee Robertson, wife of D. H. Broussard; 3. Rosano Bilbo nee Robertson, deceased wife of J. M. Bilbo, who died on the 1st, day of December 1914, leaving the following four children named herein after; 4. Zordia Robertson, who is over the age of twenty-one years, and never married; 5. Seth Robertson who is of legal age; 6. Marion Robertson, who is of age; 7. Jasper N. Robertson, who is of age; 8. Early Robertson, deceased who died leaving two sons, who are over the age of twenty-one years, as herein after set forth. 4. That each of the following named heirs inherit one-sixteenth (1/16) of said property, viz., 1. Virginia Robertson, 2. Fairsano Broussard, 3. Zordia Robertson; (4), Seth Robertson; (5) Marion Robertson; (6) Jasper Robertson, 5. That said Rosano Bilbo, deceased wife of J. A. Bilbo, who was a daughter of said Gabriel Robertson, died intestate in the Parish of Calcasieu, on December 1 1914 leaving, the following children, who are forced heirs, and each inherits one-sixty fourth (1/64) of the property left by said Gabriel Robertson, by representation of their deceased mother, viz; (1) Nora Royer, nee, Bilbo, wife of Gus Royer, (2) Mrs.Murl Royer nee Bilbo, wife of Raymond Royer, (3) Renie Bilbo, a minor, and (4) Lawrence Bilbo, a minor, both of said minors being represented herein by their father, who has been appointed and qualified as their Natural Tutor. 6. That the said Early Robertson, who was a son of Gabriel Roberrtson, died intestate, before the death of his said father, the said Gabriel Robertson, leaving two children, Howard and Everitt Robertson, both of whom are of age, and inherit one thirty second (1/32) each of the property left by their Grandfather Gabriel Robertson. 7. That the said Howard and Everitt Robertson are both of legal age and are now in the United States Army, and at present are, somewhere in France, and that it will be necessary that an attorney be appointed to represent them herein. 8. That the personal property belonging to the community at the time of the death of the said Gabriel Robertson, consists of the following, to- wit: Cash in the Calcasieu National Bank, at Lake Charles, La., $4,066.06 Cash in the Lake Charles, Trust and Sav. Bank, at L. C. La. 24,766.72 Cash in the Calcasieu National Bank, at Vinton, La. 88.95 Registered U. S Government Bond, No. 9929 1,000.00 __________ $29,921.73 9. That the real estate belonging to the community of acquets and gains at the time of the death of Gabriel Robertson, is located in the Parish of Calcasieu, Louisiana, and described as follows, to-wit: Southeast quarter, (SE1/4) South-half of Northeast quarter (S1/2 of NE1/4)of Section twelve (12), Township nine (9) South, Range twelve West, La. Mer.; Southwest quarter of Northwest quarter (SW 1/4 of NW 1/4)of Section eighteen, (18) , Township nine (9), South Range, eleven (11) West, La. Mer, . valued at Seventeen Hundred and seventy and no/100 Dollars. 10. That the said Gabriel Robertson did not owe any debts at the time of his death, and there are not now any debts due by the succession except One Hundred twenty nine Dollars ($129.00), due for the expense of his funeral, which is due J. M. Bilbo, as he has paid Robert Trousdale the Undertaker, and therefore there is not necessity of having an administrator appointed or an administration of the Estate. 11. That the real estate has borne its just proportion of taxes, and there is no inheritance tax due the Stat of Louisiana, because the amount of property inherited by each of said heirs is less than Ten Thousand Dollars, ($10,000.00) 12. That petitioners accept the succession of Gabriel Robertson, unconditionally and without the benefit of an inventory. 13. That petitioners are entitled to have a rule issued and served upon the Sheriff and Ex-officio tax collector of Calcasieu Parish, Louisiana, commanding him to show cause, if any he has, why petitioners should not be placed in possession of said property, in the proportions above setforth, free of an inheritance tax. Wherefore premises considered, petitioners pray, that a rule issue commanding H. A. Reid, Sheriff and ex-officio tax collector of Calcasieu Parish, Louisiana to show cause, if any he has, on a day to be fixed by your Honorable Court, why petitioners should not be recognized as the heirs of Gabriel Robertson, and as such placed in possession of the above described property in the proportions above setforth, free and clear of an inheritance tax; That an attorney be appointed to represent Howard Robertson and Everitt Robertson, absentees, upon whom service of process herein should be made and contradictorily with whom these proceedings should be conducted; That after legal delays have elapsed and due proceedings had, there be judgment herein, in favor of petitioners, recognising them as the heirs of said Gabriel Robertson, and as such placed in possession of the within described real and personal property, in the proportion of one- half to the surviving spouse, Ellen Robertson, with the usufruct of the remaining one-half, and placing the following heirs in possession of an undivided one-sixteenth, (1/16) each of said property, viz; 1. Virginia Robertson, 2. Fairsano Broussard, 3. Miss Zordia Robertson, 4. Seth Robertson, 5. Marion Robertson, 6. Jasper Robertson, and recognizing the following heirs and placing them in possession of an undivided one-sixty-fourth, (1/64) each, of said property, viz;, 1. Nora Royer, 2. Mrs. Murl Royer, 3. Renie Bilbo, 4. Lawrence Bilbo, the last two being minors and placed in possession through their Natural Tutor, J. M. Bilbo; and recognising the following and placing them in possession of one-thirtysecond (1/32) each, of said property, viz., 1. Howard Robertson 2. Everitt Robertson, Petitioners further pray for all orders and decrees necessary in the premises, full general and equitable relief. By their attorney, (signed) A. O. J. Robertson, Farzano Broussard, J. M. Bilbo, Natural Tutor; Zodie Robertson; Seth Robertson; Marrian Robertson; and Jasper Robertson; who after being duly sworn, say: That they are petitioners in the Succession of Gabriel Robertson, and that they have read the allegation of said petition, and that the facts therein set forth, are true and correct. That Gabriel Robertson died, intestate in the Parish of Calcasieu, State of Louisiana, on or about the 5th., day of December A. D. 1918. Lock, who after being duly sworn, said: That they knew Gabriel Robertson, during his life time, and that he died in the Parish of Calcasieu, State of Louisiana, intestate, on or about the 5th., day of January, A.D. 1918. That they have read the foregoing petition of the heirs of Gabriel Robertson, and that the facts therein set forth are true and correct to the best of their knowledge and belief. It is hereby ordered that Ellen Robertson, the surviving spouse be and she is hereby placed in possession of one-half of the following described property as owner and as usufructuary of the remaining one- half, said property being described as follows; to-wit: Cash in the Calcasieu National Bank, at Lake Charles, La., $4,066.06 Cash in the Lake Charles, Trust & Savings Bank, at L.C. La. 24,766.72 Cash in the Calcasieu National Bank, at Vinton, La., 88.95 Registered U.S. Government Bond, No. 9929 1,000.00 __________ $29,921.73 and the following described real property, to wit: Southeast quarter, (SE1/4);, South-half of Northeast quarter (S 1/2 of NE 1/4), of Section twelve (12), Township nine (9), South, Range twelve (12), West La. It is further ordered that the following named heirs, be placed in possession of an undivided one-sixteenth (1/16) each, in the above described real and personal property, said heirs being as follows, to- wit: 1. Virginia Robertson, wife of T. J. Robertson, 2. Fairsano Broussard, wife of D. H. Brousard,[sic] 3. Zordia Robertson, 4. Seth Robertson; 5. Marion Robertson; 6. Jasper Robertson; It is further ordered that Nora Royer, wife of Gus Royer; Mrs. Murl Royer wife of Raymond Royer; Renie Bilbo, and Lawrence Bilbo, be and they are hereby placed in possession of an undivided one- sixtyfourth (1/64), each, of the above described real and personal property, subject to the usufruct held by Ellen Robertson. It is further ordered that Howard Robertson and Everitt Robertson, be and they are hereby placed in possession of one-thirty second (1/32) each of the above described real and personal property, without the payment of an inheritance tax, and subject to the usufruct granted to the surviving spouse, Ellen Robertson. It is further ordered that the fee of J. A. Wisong, Esq., as attorney for the absent heirs be fixed at Twenty Dollars, to be paid out of the share of said property inherited by said absentees, Howard Robertson and Everitt Robertson. Thus done read aloud and signed in open court at Lake Charles, Louisiana, on the 31 day of January, A. D. 1919.
