Columbia, La. October 10, 1913 Page 9, Column 2 Pool Held Without Bond. The preliminary trial of Dittimus Pool, charged with killing Monroe Warner of the Second Ward of this parish, was heard Saturday by Judge George Wear of the Thirtieth Judicial Court. The courtroom was crowded and special deputies were sworn in to preserve order. District Attorney Richey placed B. F. Howe and E. W. Radford on the stand. Both swore to having heard Pool say the Monday before the killing took place that he knew that Warner had been told several things that he had said about him, but that Warner had never tackled him about any of them. Witness Radford went so far as to say that Pool had said in substance that he would "get" Warner if he ever got the law on his side. Both of these witnesses were within 150 years of the scene when the shooting took place, both heard Pool and Warner talking and the shot fired, and were among the first to reach Warner's body after he was shot. They testified to the fact that they found Warner in a dying condition, and that he was lying upon his back with a hunting horn clasped in his right hand, and that his left hand was shot through the fingers, showing that he could not have been in the act of drawing a weapon when shot. The bridle which was worn by Warner's horse on the morning of the killing was produced in court, identified and offered in evidence. Its reins were puntured by bullet holes. The only eyewitness to the deed was a little negro girl about six or seven years old. She said that she heard Warner curse Pool, and that she saw Pool shoot Warner. Other witnesses testified that Warner was unarmed when he was shot. The case was submitted without argument on either side, and the court immediately gave a decision refusing bail to the prisoner, remanding him to jail, and referring the case to the grand jury for action atits next sitting here in December.
