Dunke clk Recorded Feb 26th 1852 on pages 517, 518, 519, 520, 521, 522 in Book of Successions No. 2 Healliday ---------------------------------To the Honorable Edward Barry judge of the Eleventh Judicial District of the State of Louisiana holding session in and for the Parish of Catahoula in said District. The petition of Jane Heard, widow of Thomas Heard deceased and resident of the parish of Catahoula, State aforesaid with due respect represents that by the late decease of her said husband, there is a vacancy in the tutorship of Delitha Stampley a minor child of David Stampley deceased and your petitioners daughter Harriet, present wife of James H. Spann. The said Thomas Heard, having acted under legal appointment as tutor to the said minor. Your petitioner further represents that Angeline Wilson and Jane Wilson minor children of your petitioners daughter Louisa Heard and her late husband Leuis Wilson, deceased, are also without any tutor, the father and mother of said minors being both deceased. Your petitioner further represents that Laura Jane Hawthorn minor child of your petitioners daughter Susannah Heard and her husband Robert Hawthorn is also without any tutor, both parents in this case being also deceased. Your petitioner further represents that as the grandmother of said minor children she is entitled to the tutorship of said several minors, there being no other ascendant of the same degree of relationship that can come in competition with your petitioner for the tutorship. Your petitioner further represents that beyond the respective shares or portions to which said minors will be entitled in the estate of their grandfather, the said Thomas Heard, decd, and of which your petitioner has the us_snct and therefore is not bound to give security for the administration of it, said minors have no property except the minor Delitha Stampley who demised a small amount of property from her fathers estate consisting of an undetermined interest in a quarter section of land and some three or four hundred dollars in money owing by her former tutor the said Thomas Heard, decd. That except in the case of said minor Delitha Stampley, it will be unnecessary to make an inventory, at least there is no property belonging to the Wilson and Hawthorn minors which your petitioner would be required to give security for Wherefore your petitioner prays to be confirmed as the tutorix to all said minors; that an under Tutor be appointed to each set of said minors. That and inventory and appraisment be made of the property of the minor Delitha Stampley which she demised from her Fathers succession; and you petitioner prays such other and further order in the premises as the law and ______ of the case may require and for general relief James H. Taliaferro Atty of Petitioner Eleventh District Court Parish of Catahoula Clerks Office----- It is ordered that Jane Heard be appointed and confirmed as Tutorix to her several minor grandchildren named in the foregoing petition ng; To Angeline Wilson and Jane Wilson, minor children of Louisa Heard and Lewis Wison decd To Laura Jane Hawthorn minor child of Susannah Heard and Robert Hawthorn deceased & to Delitha Stampley minor child of David Stampley deceased; That petitioner be required to take the oath required by law, in each case and that an undertutor be appointed to each set of minors as prayed for. It is further ordered that an inventory in each case of the property of said minors be made; and that the petitioner be required to enter into bond and security for the amount of Delitha Stampleys property demised to her from the estate of her father David Stampley deceased.
