Judge of the Parish Court in and for the Parish of Claiborne, State of Louisiana. Your Petitioner, Decatur J. Buford resident of the Parish of Claiborne and testamentary executor of the estate of his father, Miles Buford with respect represents to your Hon. Court that Miles Buford, late of your said Parish, deceased, left at his death a nuncupative will by public act by which he disposed of his property to his children by his second marriage, to wit, your petitioner, D. J, Buford, Thomas Jefferson Buford, F. E. Holiday, H. W. Buford, residents of the Parish of Claiborne, State of Louisiana and R. M. Buford, resident of Columbia County, Arkansas, all of whom join with the maker of this petition. That by the provisions of the said will James H. Smith was appointed testamentary executor but failed to qualify according to law. That afterwards your petitioner, D. J. Buford was appointed by your Hon. Court Testamentary Executor and qualified according to law. Petitioners all agree that for the purposes of carrying into effect the provisions of this will it is necessary that it be by your Hon. Court admitted to probate and ordered executed. Petitioners respectfully show that the children by decedents first and second wife are a portion of them living in the Parish and a portion in Texas. To Wit Moses Patton, husband of Susan Buford, deceased, William R. Buford, A. Armstrong, husband of Emily Buford, deceased, Isaac Frank, husband of Kitty Buford and J. P. Buford, residents of Texas. William Buford son of Christopher Buford and brothers and sisters of said William Buford to your petitioner unknown, residents of Madison County Missouri. Nacy Meeks, husband of Eliza Buford, deceased, Almanda Buford, wife of John F. Dunn, and Susannah T. Buford, wife of J. J. Patrick, residents of the Parish of Claiborne. Petitioners represent that it is necessary that a curator at law be appointed to represent the absent children of Miles Buford, deceased. Wherefore petitioners pray that a service here of be made upon Nacy Meeks, husband of Eliza Buford, deceased, John F. Dunn, husband of A. Buford, deceased and Susannah T. Buford, wife of J. J. Patrick and that a curator at law be appointed to represent the absent heirs upon whom service can be made and that they be duly notified to appear at the court house in the town of Homer, Parish of Claiborne on Friday the 17th day of May 1878 and there the last will and testament of Miles Buford be admitted to probate, that it be ordered executed according to law, for allocation orders in the forms necessary and for general relief. Hayes be appointed curator at law to represent the absent heirs children and descendants of Miles Buford, deceased and that service hereof be made upon him.
