Warren was born in 1813 in Mississippi. She the wife of Samuel McRee (b. 1803 in North Carolina). Mary A. Warren McRee died in January of 1866 at the age of 53 in Claiborne Parish Louisiana. Her father-in-law was William McRee who died in Claiborne Parish just six years earlier, in 1860. When Mary A. Warren McRee died, she left five single or minor children, all daughters. Their names were Oney Elizabeth, Margaret, Corine, Victoria and Ella McRee. There were older McRee children also, but at the time of their mother's death they were all grown: James J. McRee b. 1831, Rebecca J. McRee b. 1833, Martha A. McRee b. 1835, William H. McRee b. 1837, Samuel W. McRee b. 1838, all born in Mississippi. One form of Guardianship under Louisiana law is referred to as a Tutorship for a minor child. A Tutorship allowed an individual to be appointed to manage the affairs of another. Tutorships were necessary when a minor child's parent or parents had died while the child was still a minor, and the Tutor, someone above the age of majority, would be responsible for financial and legal matters for the minor child. In Tutorships, not only was a Tutor appointed, but an Under Tutor also had to be appointed. For the protection of the minor child, the Tutor was obligated to file an account every year with both the Under Tutor and the Court where the Tutorship was opened proving he or she was continuing to act in the best interest of the child. The Tutorship below appoints Samuel McRee, widower of Mary Ann and father of the five single or minor children, as their Natural Tutor. D. W. Gladden is appointed as the Under Tutor for the children. This is transcribed from copies of the original documents written in old fashioned longhand. Occasional question marks throughout indicate text which could not be read from the very old writing. Warren that all the property in which said minors are interested as heirs of their mother in community ownership of lands, stock and etc. be sold and he therefore prays that a family meeting in and of the following named friends of said minors in default of relations to wit, W. Family Meeting Held - Decision Made to Sell the Property Jointly Owned by the Minor Children and their Father, Samuel McRee August 28, 1866 State of Louisiana Parish of Claiborne Be it known that I J. R. Ramsey a Notary Public in and for the Parish and State aforesaid, duly commissioned and sworn by virtue of the authority commissioned to me directed by Hyden A. Kennedy Clerk of the District Court for said parish proceeded on this day to convoke and hold a family meeting composed of W. A. O'Brien, W. S. Kinnebrew, J. T. Davidson, J. H. Jordan and W. Callahan as friends of the minor children of Mary A. Warren deceased and issue of her marriage with Samuel McRee to wit, Onie E., Margaret, Corrine, Victoria and Ella McRee to deliberate and advise whether it would be of interest to said minors for the community property held by them with Samuel McRee their Father or Natural Tutor be sold upon which terms, by causing them to appear before me at my office in the Town of Homer in said Parish, and after having qualified said persons according to law, they advise and recommend that all the community property in which said minors have any interest be sold, the land upon the following terms to wit at the sum price of three dollars per acre paid cash, and the balance in one and two years credit with 8 per cent interest from with Special Mortgage on the land to secure the payment of the purchase price and the house and lot in Homer at $500.00, authorizing Samuel McRee cash partners in community to sell the same at private sale, other personal property upon such terms as said McRee in his judgment may deem most conducive to the interest of said minors in proof of which I have caused said persons to sign these presents with the said Notary in presence of the attesting witnesses on this 28th August 1866. Gladden, Under Tutor Court Orders that Samuel McRee, the Natural Tutor, May Proceed with the Sale of Property August 29, 1866 State of Louisiana Parish of Claiborne By reason of the law and the evidence it is now decreed that the proceedings of the foregoing family meeting be allowed, confirmed, and homologated and made the judgment of the Court and that Samuel McRee Natural Tutor be authorized to make sale of the property belonging to said succession on the terms stated by the family meeting.
