This transcription is pages 1-5 State of Louisiana Parish of East Baton Rouge Before me Charles Tessier Parish Judge and Ex Officio notary public in and for said Parish on this twenty eighth of April AD eighteen hundred and thirty seven, by virtue of an order of the Honorable Court of Probates be and for said parish were regularly assembled agreeably to just ??, Messrs. Philbin Thomas, Benjamin Bryan, Thomas Cooper, Manuel Moreno and William Thomas to compose a family meeting of the nearest friends (in default of relatives residing within thirty miles) of the minors Reuben, Isham and Nancy Fox, children of Isham P. Fox of said parish by his first marriage an with Mary O’Conner deceased and also of Richard Colombus minor son of the said Isham P. Fox and Elizabeth Miller deceased, his second wife. The said meeting being assembled at the instance and request of Isham P. Fox their natural tutor for the purpose of deliberating and deciding on the propriety of making a reappraisement of the landed estate, slaves and personal property constituting the community heretofore existing between the said Fox and his said wife Mary O’Conner and Elizabeth Miller deceased and also of attaining the terms of sale so as to effect a legal sale of the said property which was advised by a family meeting heretofore held. Whereupon I administered unto the members assembled the oath prescribed by law and submitted to their consideration the objects for which they were called. When after discussing the same and deliberating thereon the said members were unanimously of the opinion that it would be for the best interest of the said minors that there should be a sale of the said property in order to meet the debts which encumber the same, that a new inventory and appraisement should be made of said property and finally that the said sale should be made in the __ terms and conditions __ the land and negroes, five thousand dollars in cash and the balance in a credit of one two and three years and the personal property for cash. And Jesse Fallon the under tutor of the said minors being present at the deliberations aforesaid concurred in the __ of the same and __ this process verbal with the members composing the said meeting and the tutor and notary at Baton Rouge in my office after which the said meeting was adjourned . Tessier ********************* Parish of Rapides Be it remembered that on this 7th day of November 1831 pursuant to a ?? from the Humble Probate court of the Parish of East Baton Rough, I Thomas C. Scott Parish Judge in and for the Parish of Rapides proceeded to make the following inventory of the goods and effects rights and credits of Isham P. Fox and his late wife situated in this Parish and having appointed Richard F. Gibson & Thomas Patterson appraisers and they having been first sworn according to law they proceeded to appraise the said goods, and effects as follows in presence of the undersigned assisting witnesses,- Inventory- appraisement, A Tract of Land situated in the Parish of Rapides on the right bank of the Bayou Robert in descending adjoining lands of Havard above and lands of Mulholland below & containing three hundred and sixty arpens appraised at twelve hundred dollars, - $1200. In testimony whereof we the said Parish Judge and estimaters and witnesses, hereto subscribe our names, at Alexandria this day and year first aforesaid. Witnesses Th C Scott Par Judge Jas M Gordon Thos Patterson ******************* To the Honorable Charles Tessier Parish Judge and Ex Officio Judge of the Court of Probates In and for the Parish of East Baton Rouge, State of Louisiana The petition of Isham P Fox, a minor above the age of nineteen residing in said parish respectfully represents that he is devious of having the time dispensed with prescribed by law for attaining the age of majority in as much as your petitioner wishes to embark in business on his own account , to collect debts, give receipts and acquisitions, appear in courts of justice to promote his rights and generally to manage his estate so as to render them available ? believing himself capable of administering and conducting the same. Petitioner further represents that his father Isham P. Fox who was confirmed as the natural tutor to your petitioner lately and within a few days past died and that our orders that the requisites of the law may be complied with it will be necessary that a tutor ad hoc be appointed to your petitioner upon whom service of this petition may be made to the end that course may be shown if any exists why the prayer of petitioner may not be granted. Wherefore in consideration of the premises, petitioner prays that a tutor ac hoc may be appointed to him that a family meeting may be ordered to be assembled before your Honor as Parish Judge at such time and place as may be deemed fit composed of the nearest relations of your petitioner. And that a copy of this petition be served awarding by law one such person as may be appointed by your honor, citing him to appear on the day fixed for said family meeting to show cause why the prayer of your petitioner should not be granted and for general relief in the premises By his atty Danl D Avery Probate court Parish of East Baton Rouge State of Louisiana Isham P Fox a minor for emancipation. On reading and filing the foregoing petition, It is ordered that Andrew Klimpeter Esq be appointed tutor ad hoc to the minor Isham P Fox and it is further ordered that a family meeting composed of (left blank) Be assembled before me as Parish Judge at my office in the town of Baton Rouge on Tuesday the 5th instant at 12 o’clock m. to take into consideration and deliberate on the prayer of said minor. And it is further ordered that a copy of said petition be served on Andrew Klimpeter tutor ad hoc, citing him to show cause why the prayer of said petitioner should not be granted. A true copy M Moreno, Dep ******************* EMANCIPATION State of Louisiana Parish of East Baton Rouge On this 5th day of December in the year of our Lord eighteen hundred & thirty seven were regularly convened before me Charles Tessier Judge in and for the Parish aforesaid in the town of Baton Rouge Mess. Jas. C. Dawson, William Thomas, Robert Penny, Manl Moreno & Philip Garig the nearest relations & friends of Isham P Fox, minor, son of the late Isham P. Fox of this parish deceased composing a family meeting to deliberate on the propriety of emancipating said minor who has attained & is over 19 years of age according to the provisions of div act approved the 23rd of January 1829. The members of said meeting thus assembled took before me the oath provided for by said act when they proceeded to the consideration of the subject submitted to their deliberations and after reading the petition presented by said minor and weighing the reasons alleged in support of the same, they were unanimously of opinion that his prayer ought to be granted & that he be dismissed from this time prescribed by law for attaining the age of majority that he be authorized accordingly to manage his estate and affairs with the privileges resulting from his emancipation in conformity to the meaning of the above recited act. And Andrew Klimpeter the tutor ad hoc of said Isham P Fox having been duly cited and present at the family meeting offered no objections to his emancipation. And nothing else being before the board I have dissolved the same subscribing thereto my name with the members thereof of the said tutor ad hoc the day & year first above written. James C. Dawson of this Parish praying that he might be appointed tutor to Richard Colombus Fox, minor son of Isham P. Fox late of this Parish dec’d. Now know ye, that James C. Dawson has been and is hereby appointed tutor to the said Richard C. Fox and that he has fulfilled all the requisites of the Law.
