All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** Be it remembered that in pursuant of the authority of a commission from the District Court of Carroll, Louisiana to me directed requiring the convocation of a family meeting of the relatives and friends of the minor Augustus Job son of Abram Bass, Sr and of his late wife Sarah E Bass, deceased, to deliberate and advise on matters and things touching the interest of said minor in regard to the property which fell to him by the death of said mother---I Eli Harris, Notary Public duly commissioned and sworn residing at Providence in the Parish of Carroll and State of Louisiana did on the 27th day of September 1856 issue written summons to Col Warren M Benton, grandfather of said minor, to James A Bass and Erasmus Benton, uncles of said minor, they being the only male relatives of said minor in this parish who can sit in said family meeting and caused the said summons to be duly served by constable Green to be and appear at my office in Providence La on Tuesday the second day of October (inst) 1856 and I also delivered a written summons to Alfred F Green the under tutor of said minor to be present and attend the deliberations of said family meeting on said day--- and I also summoned Anderson Bagley and Richard S Key friends of said minor to be also members of said family meeting -- whereupon on the second day of October Eighteen Hundred and fifty-six came and assembled before me, Notary, the said Erasmus Benton, James A Bass, Anderson Bagley, Richard S Key, the said Warren M Benton being absent from the state, Henry B Blackburn friend of said minor was summoned in the place of Warren M Benton and I said Notary administered the following oath to said members of said family meeting and which they here subscribe in my presence to wit; We do solemnly swear that we will well and faithfully give and advise this day in family meeting on matters, things touching the interest of said minor Augustus Job Bass as certified in the petition here presented by his father, the said Abram Bass, to the best of our knowledge, so help us God. Sworn to and subscribed before me 2nd October 1856, Eli Harris, Notary Public R S Key James A Bass Nathan Trotter E Benton H B Blackburn Whereupon the said members of the said family meeting took into consideration the subject matter of said Abram Bass Natural Tutor duly qualified of the minor Job Augustus Bass - - the substance of which petition is as follows -- Your petitioner prays that a family meeting be convoked according to law to deliberate touching the interest of said minor and whether or not it would to his interest to have the property of the succession of the said Sarah E Bass which was held in community with your petitioner, adjudicated to him upon the appraisement and inventory thereof....and that after applying so much of the estimated value of said community property as will extinguish the balance in favor of your petitioner and then the balance of said succession arising from the community property should be served by a mortgage in favor of said minor in and by your petitioner upon unencumbered real estate of the kind required by law == and here reference is had to the account rendered by the said natural tutor in the succession of said Sarah E Bass which shows a balance due the natural tutor of fourteen thousand six hundred and forty- four & 26 cents -- $14644 26\100 homologated on the 4th Aug 1855 and said account is made a part of this process stated. It appears that Lot 7 & 8 Township 20 Range 13 East is community property appraised @ $25.00 per acre the undivided half of which is $4000.00 -- Nine mules community property is appraised $850 the undivided half being $425. Appraised @ $11650 One half of which is $5825. Alexander Scott age 30 years, Tina 25, Bethna 4 years and Randall 35 years, ages according to inventory of October 11, 1851. appraised at $2150 The one-half of which is 1075 $15857.00 Amt of Acct of Sarah E Bass --?-- to Abram Bass $14644.26 Due to the minor 1212.74 The act of the Legislature of the State of Louisiana entitled --?-- acts in addition to the laws now in force relative to tutors and curators of minors approved March the 11th 1831 (?) having been read to said family meeting as required by law and the condition and amount of the property belonging to said minor having been shown to said family meeting by exhibiting to them the --?-- of the property of said minor and the account rendered by the said natural tutor which has been homologated according to law, they the said members of the said family meeting took into consideration the petition of the said Abram Bass, natural Tutor as aforesaid and it appearing to the satisfaction of said family meeting that six of the negroes mentioned in the inventory have died yet they do not deem in adjucation of the property taking the land and negroes together that there should be any deduction for the reason that the land has somewhat increased in value since making the said inventory and upon mature deliberation they deem it greatly to the advantage of said minor that the debt against the succession of his mother should be at once should be at once extinguished by adjucation of the property which was held in community which will leave the entire succession free from debt and the balance in favor of the minor in the hands of the Tutor of one Thousand two hundred and six 24/100 dollars. The said family further advises that the said tutor shall be permitted to execute a mortgage on unencumbered real estate land to secure to said minor the payment of said sum of money at the time of his arriving at the age of majority and also to secure the said minor in the faithful administration and delivery to the said minor of the other property which he inherited from his mother -- and when this done all the other property of said tutor not specified in said mortgage shall be released from the tacit mortgage now existing in favor of minors against their tutors -- said mortgage to be made to the satisfaction of the under tutor and a family meeting convoked to decide on the sufficiency of the mortgage. This done and advised before me said Notary on the second day of October (inst) 1856 in the presence of Hugh Short and Anderson Bagley -- witnesses residing in the Parish of Carroll who have signed hereto with the members of said family meeting and the under tutor who approves the above advice -- In full credence whereof I have hereunto signed my name and affixed the impress of my seal of office. The petition of Abram Bass Natural Tutor of the minor Augustus Job Bass with respect shows that the family meeting convoked to deliberate touching the interest of the said minor heir as will appear by the annexed --?-- verbal adjucation the property of the succession of the said Sarah E Bass which was held in community to the said Abram Bass at the appraised value thereof and now the said Abram Bass prays that the deliberations of the said family meeting may be confirmed by judgement of homologation and for relief. --?-- Perkins --?-- Having heard and considered the foregoing petitions and deliberations of the family meeting & by reason of the law & evidence & by further reason of the approval of under Tutor it is hereby ordered adjudged and decreed that the deliberations of said family meeting be homologated as prayed for.
