CHAMBLISS The State of Louisiana, Parish of Carroll= Be it known and remembered that on this sixth day of March eighteen hundred thirtyfive, Before me, FELIX BOSWORTH, Parish Judge and Ex officio Notary Public, in and for the said Parish of Carroll in the State of Louisiana, personaly appeared LUCINDA S. HOOD, formerly the widow of ABNER EVERETT, deceased, and now the wife of ROBERT JAMES CHAMBLISS, who now publishes and declares that she doth now in this Instrument of writing and by these presents, make her last Will and Testament in the manner , form, and words, as herein follows: In the name of God-Amen.-I, the said LUCINDA S. HOOD, former widow EVERETT and now wife of ROBERT JAMES CHAMBLISS being at times in delicate health and being now of sound and disposing mind, considering the certainty of death and the uncertainty of this life and wishing to arrange my temporal concerns as for as may be to my satifaction-Do hereby will,devise and bequeath as follows-Article 1st.In consideration of the love and affection which I bear to my said husband, ROBERT JAMES CHAMBLISS I do hereby will, devise and bequeth unto him the one third of my Estate both real and personal of which I shall die, seized, and possessed, whether situated in the State of Louisiana or elsewhere, after deducting the reservation made in favor of my children in the Article 2 and 6 to be held in full property by him, the said ROBERT JAMES CHAMBLISS, his heirs and assigns forever. Article 2. The remaining two thirds of my whole estate of which I shall die seized, I do hereby will, devise and bequeath unto my two children, namely WILLIAM HARBIRD EVERETT and JOHN ABNER EVERETT, in full property unto them the said WILLIAM HARBIRD EVERETT and JOHN ABNER EVERETT, and their heirs and assigns, forever, and provided that the negro boy BEN, shall be known to belong to WILLIAM HARBIRD EVERETT ,and the negro boy PETER shall be know to belong to JOHN ABNER EVERETT without being collated withE the property of the Estate, but shall be over and above their legetime- the negro boy BEN being about twelve years of age and the negro boy PETER about seven years of age- Article 3. It is my wish and desire, that in case of the death of my husband, the said ROBERT JAMES CHAMBLISS at any short period , say twelve months after my decease, and I should not leave a child, or issue, by him that the brquest maned in the first Article unto my said husband, ROBERT JAMES CHAMBLISS, shall be divided between my said two children,WILLIAM HARBIRD EVERETT and JOHN ABNER EVERETT and the child of my said husband named ELIJAH CLARK CHAMBLISS and so that the one half of the said one third of my estate so bequeathed to the father of the said ELIJAH shall belong in full property unto him the said ELIJAH CLARK CHAMBLISS his heirs and assigns forever - Article 4th I hereby name, constitute and appoint the said ROBERT JAMES CHAMBLISS, my said husband, to be gaurdian and Tutor of my two minor children, the said WILLIAM HARBIRD EVERETT and JOHN ABNER EVERETT and that he shall manage and conduct their affairs until they shall arrive at the age of majority; and that he shall raise and educate them in a manner consistent with their fortune - hereby invest- ing him with all the power and authority of tutor of my two children.- Article 5th I hereby constitute name, and appoint the said ROBERT JAMES CHAMBLISS, my said husband the sole Executor of this my last Will and testiment and to be detainer of my estate both real and personal; that I shall in anywise die siezes or prosssessed of whether the same be situated in the state of Louisiana or elsewhere and granting unto him full and entire possession of the same, allowing him for his trouble as Executor the legal commissions; and I desire that the Court may not require any security from my said Executor for the exercise of his function as such. - Article 6th In addition to the provisions made in the 2nd Article of the foregoing bequests it is my will and desire that the Lake Place on Lake Providence, situated in Township N 21 Range N12E being Lot No.__ and No. __ and No. Forty Three back lot __being the two front lots and the back lot entered in the name of ABNER EVERETT containing together Five Hundred and Seventy Two acres and a fraction of an acre, be the same more or less __ said land being in the Parish of Carroll and State of Louisiana__ shall belong in full property to JOHN ABNER EVERETT and to his heirs and assigns forever and that the same shall not be collated with the mass of the Estate, but shall be over and above the Legetime or porttion of my estate mentioned in the 2nd Article - and that four lots of land situated on the Mississippi River, in the Parish of Carroll and State of Louisiana, below the town of Providence, adjoining below the land of DAVID O. BARTON, and above land of DOCTOR ELLIOTT, with the right of the back concession belonging to the said four lots of land - the said four lots containing Fourteen Hundred acres, or more, be the same more or less shall belong in full property to WILLIAM HARBIRD EVERETT his heirs and assigns forever, and that the same shall not be collated with the mass of the estate, but shall be over and above the Legetive or portion mentioned in the second Article. - In testimony of which the said LUCINDA S. HOOD, formerly widow EVERETT and now wife of ROBERT JAMES CHAMBLISS, doth herewith sign her name, acknowledging this Instrument and all therein written to be her Last Will and Testement revoking and annulling all others, if any heretofore made by her and ratifying and confirming the present as her last and only Will, on present of me the said Judge and Notery, who have hereto signed my name, as also in presence of ZACHARIAH H. DARSEY, ALIXIS SAPPINGTON, and NATHANIEL CHAMBLISS, witness hereto residing in said Parish and vicinty who have also signed their names hereto as such, with the said Testatria on the day and year first above written - the same bing first dictated by the said Testatria and by me the said Notery written and read to her in presence of the aforesaid witnessess = LUCINDA S.
