All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** Oct. 30, 1860....Petition of Amy Anderson for Court Ordered Family Meeting .... contained in Succession of Adeliza Quays; Drawer 52, Succ F-160 To the Honorable the Judge of the Tenth Judicial District Court of the State of Louisiana in and for the Parish of Carroll: The petitioner Amy Anderson, who resides in the said Parish, tutrix of the minor heirs of the late Adeliza Quays, children of the said Adeliza and Phil D. Quays deceased, with respect shows that many years since, the individual property of the said Adeliza Quays, which she held separate from her husband, became much involved and was under a mortgage for a large amount to Martin, Owen and Cobb, and at the same time under a mortgage to the late Robert Anderson; that for the purpose of assisting the said Adeliza, the said Robert Anderson agreed to pay three thousand dollars per year on the mortgage due Martin, Owen and Cobb, which he continued to do during his life, and since his death, his succession and your petitioner, as survivors in community, have continued to advance money to relieve the property of the said Adeliza from its embarrassment by which the property of the estate of the said Adeliza became indebted to the succession of the said Robert Anderson, as will appear from the account filed by your petitioner as Administrator in the succession of the said Mrs. Quays, who was the daughter of your petitioner. By the will of the said Mrs. Quays, which has been probated and ordered to be entered, she left her husband, Phil D. Quays, who survived her, one fourth of her property after the payment of the debts; that for the purpose of paying the debts of said succession and that the administration on the succession of Philip D. Quays might have the control of the interest left to the said Quays under the will to settle the debts due by the succession, an order was made to sell the property of the succession of the said Mrs. Quays by the Tenth Judicial District Court in and for the Parish of Carroll, and the said property is now advertised for sale; it is the wish of your petitioner, as the tutrix of her grandchildren, to buy the said property by and with the consent of a family meeting, to buy and save it for them, and to be enabled to do so that she be authorized to execute any mortgage that may be necessary to secure the debt due the succession of the late Robert Anderson, now represented by Robert Anderson his son, who is now of age, and at the same time to execute any mortgage that may be necessary to procure advances to pay over to the administrator of the succession of P.D. Quays, the amount which the said succession may be entitled under the will of the said Adeliza. Wherefore, your petitioner prays that your Honor will order a family meeting to be convoked before James A. Branghon, to deliberate touching the interests of the said minors and that she be authorized to make the said purchase and to execute any mortgages that may be necessary as aforesaid and for general relief.
