McRae The petition of Robert Dyer of said Parish and State respectfully represents, that Colon C. McRae late of the Republic of Texas, has died leaving his principal property situated in the said Parish of East Feliciana where his sucession of right ought to be opened and administered. Your petitioner further represents that said sucession is a vacant sucession and without any persons to administer upon the same. Your petitioner further represents that he is a creditor of said sucession and entitled to the administration of the same. Wherefore your petitioner prays that due notice of his application may be granted, and that your petitioner may be duly appointed curator of said vacant sucession, that an attorney for absent heirs may be appointed an inventory made and all other necessary proceedings may be had and for general relief [ for other purposes ? ] (Signed) Muse & Marick, Atty for pet. Probate Book " B ", pg. 331 State of Louisiana, Parish of East Feliciana, Probate Court No. 1648 Robert Dyer in the matter of the sucession of Colon McRae deceased. the application of petitioner having been published ten days according to law and no opposition being made and he having given Bond and taken the oath required by law: It is ordered that he be appointed Administrator of the Estate of Colon McRae deceased. Ordered that Isaac Kemp and Elijah Stafford be appointed Experts to examine and report to this Court whether the tract of land herein referred to can be divided in kind without dimenation (?) or loss (?) to the parties or either of them. Dec. 29th 1840 (Signed) L. Saunders, Parish Judge In this case Alexander H. McRae the defendant having accepted service of this petition and waived process of citation and ten days entice (?) and concerned with petitions and Isaac Kemp and Elijah Stafford the Experts appointed to examine and report whether the land referred to in this petition could be divided in Kind having reports that the same cannot be done without loss to one or both of the parties: It is therefore ordered, adjudged and decreed that the tract of land be sold on the following terms towit One hundred dollars cash and the balance in three equal annual installments from the day of sale and at a partition take place as heir prayed for. McRae, of the Republic of Texas owned tract of land situated on the waters of Thompson Creek, containing in the whole about four hundred and fifty acres, purchased by Colin C. McRae at the probate sale of David and John Campbell. One half of which since sold to A.H. McRae and is now a community.
