J. Lea clerk and exofficio notary public, personally appeared B. S. Landis whose wife is Mrs. Elise Landis, who in presence of the undersigned competent witnesses, declared and acknowledged that for and in consideration of the price and sum and on the terms and condition hereinafter expressed and set forth, he does by these presents, grant bargain sell and deliver with full warranty of title unto W. F. Choat whose wife is Mrs. S. A. Choat, present and accepting this sale for himself his heirs and assigns, free from all mortgages or other incumbrances whatsoever, the following described land situated lying and being in the Parish of Franklin and more fully described as the East Half of the South West Quarter of Section 19 Township Fourteen, North Range Seven East containing 80 acres more or less. This sale is made and accepted for the price and sum of one thousand two hundred dollars of which sum the vendee herein has paid cas at and before the signing hereof, the sum of one hundred dollars, the receipt of same is hereby acknowledged, and for the remaining portion of said sum to wit the sum of Eleven hundred dollars is to be paid in two annual installments of Five hundred and fifty dollars each, for which the vendee herein has made executed and signed two certain promissory notes for Five hundred and fifty dollars each payable to his own order and by him endorsed in blank the first note bearing 8% interest from date and the 2nd note bears 8% interest from Feb 2nd, 1913, said notes are due and payable on the 2nd day of Feb 1913 and 1914 respectively, stipulating to pay 10% as atty fees in case of suit to collect same, and in order to secure payment of said notes the said vendor herein retains a special mortgage and vendors privilege on the property herein sold and conveyed as above described, which the vendee herein said W. F. Choat agrees shall stand so specially mortgaged hypothecated and affected to an in favor of said vendor or any holder or owner of said note until the full and final payment thereof. The vendee herein further agree that he will not sell mortgage or incumber the said property to the prejudice of this mortgage. The parties to this act herein agree to dispense with the production of the mortgage certificate and tax receipts required by law and exonerate me said notary from all liabilities therefor.
