All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** File contributed for use in USGenWeb Archives by: Crystal Devillier oneonone@cox.net February 28, 2007, 2:09 pm Source: Transcribed Court Document Written: September 7, 1805 Date: September 7, 1805 Agreement - Public Sale Appeared: Mrs. Anne Clouatre, widow of Bernard Capdevielle; Edmon, Ferdinand, Joseph, Marie, and Angelique Capdevielle, major children of the same Bernard Capdevielle; and Pierre Joseph Landry, husband of Margueritte Capdevielle; all 7 of this County; who declared that according to the archives of Sept. 20, 1800 there was proceeded an inventory and estimation of the property left by the decd. husband, father and father-in-law; that about the month of August of 1804, being all in accord, that there be a sale proceeded with, of the said property, conjointly with the Comdt Francois Connell, they had all unanimously consented to this, that Mrs. Anne Capdevielle, their mother and mother-in-law, take of this succession, the half of all the property thereto dependent, that which was made in the partition, to the satisfaction to all, and we consented that she use and enjoy in all possession, of the half of the plantation which consist of a tract situated at the above said place, on the right bank of the Mississippi river, bounded above by the lands of Mr. Alexandre Ebert and below by those of the Succession, or the other half; this said half composed of two arpents and a half of front on forty of depth with the buildings, enclosures which might be found thereon, in a word, such as it comprises and contains; so that Mrs. Anne Clouatre widow of Bernard Capdevielle might use the same at her will. And Edmon Capdevielle declared that by means of that which he received of his decd. father, in a tract as well as other things, he renounces to all benefits and claims on the surplus of his sucn. And in consequence of this which is above, the other half thereof belongs jointly to Ferdinand, Joseph, Margueritte, Marie and Angelique Capdevielle, they agree that it be publicly sold by the same Comdt. At Public Sale adjudicated to Ferdinand Capdevielle: Being: The other half of the plantation, consisting of two arpents and a half of front on the river, situated in this County, on the right bank adjacent above to the other half accorded herein above by the present act to the Widow Anne Clouatre and below to the land of Francis Gallaghan, composed of two arpents and a half of front as it is said hereinabove on forty of depth, the buildings, enclosures, etc. which might be found thereon. A liquidation follows, distribution among the heirs of sums of money, from auction sale. The above transaction, liquidation and distribution all in one act. Date: Sept. 7, 1805 Appeared: Ferdinand Capdevielle who declared that he owes to Joseph, Marie and Angelique Capdevielle, his brother and sisters, certain sum for the half of the plantation of his decd. father, Bernard Capdevielle according to the liquidation dated this day; obligating himself to pay to them, said sums, and for security, mortgages: The plantation where he resides situated in this District on the right bank of the Mississippi river. I say, on the right bank of the Mississippi river bounded on the upper part by lands of Anne Clouatre widow Bernard Capdevielle, his mother, and below by those of Francis Gallaugham, composed of two arpents and a half of front on the said river on the ordinary depth of forty, the buildings, enclosures and other things which might depend thereon actually as also those which might be made and built in the future; which plantation belonging to him for having been purchased at the auction sale of the property of the succession left by his decd. father, Bernard Capdevielle.
