Date: December 30, 1794 At request of Etienne Ebert; Abner Gale, husband of Adelaide Ebert; Francois Ebert, paternal uncle and Maturin Landry, maternal uncle. A plantation situated in this District on the left bank of the Mississippi river, adjacent above to the lands of Joseph Michel LeBlanc and below to those of Abner Gale, containing six arpents one toise and five feet of front on the ordinary depth of forty; the buildings, enclosures which are on, in a word, such as it comprises and contains, at present, which belongs to the succession for having been acquired of Alexandre Ebert by act passed before Mr. Dutisne, my predecessor, on the date of the tenth of November 1776. Which are all the movables, effects, immovables, slaves, animals, implements and untensils dependent on the succession left by Anne Magdelaine Landry as it thus has been declared to me by Mr. Etienne Ebert with the exception of a tract of seven arpents or thereabout situated in the District of Baton Rouge; of another tract situated in the Post of Galveztown and at the Prairie, of seven arpents and a half or thereabout on which there are five horned cattle and ten hogs. The relatives have appointed as tutor of the minors, Etienne Ebert, their father and as under-tutor, Maturin Landry, their paternal uncle. Date: January 2, 1795 Declaration of Etienne Ebert, as father and natural tutor of minor children issue of his marriage with the late Magdelaine Landry, who renounces by the present act to the benefits of the clause of their marriage contract dated June 25, 1771 by which it is said that the last living would enjoy all which belonged to the community during life-time; he rejects estimation price and demands a family meeting in order to deliberate on the most advantageous manner to proceed in the interest of the minors. January 2, 1795 DeVerbois declares that this day is decided to have relatives meet in family meeting. Date: January 2, 1795 Family meeting - Appeared: Etienne Ebert, father and natural tutor of 7 minors; Maturin Landry, maternal uncle and under-tutor to minors; Francois Ebert, paternal uncle. Decided that is was advantageous to minors to have property sold at public auction. Date: January 4, 1795 Notice of public sale. Adjudicated to Etienne Ebert. Date: November 3, 1796 Etienne Ebert to Commandant, De Verbois, for receipt of money coming from the sale of the property of his community with Magdelaine Landry, his wife. In recapitulation various sums mentioned distributed among heirs; half to Etienne Ebert, and other half to nine heirs, children. Date: November 3, 1796 Donate Ebert to Etienne Ebert, receipt for sum due him from Succession of Magdelaine Landry, his mother. Date: November 3, 1796 Declaration of obligation - Etienne Ebert, declares that, as father and natural tutor of his minor children, with approval of Maturin Landry, under- tutor, he has sums belonging to Abner Gaile as father and natural tutor of Marie Louise Gaile, minor issue of his marriage with Adelaide Ebert; has sums belonging to Narcis Ebert; Etienne Ebert. Jr.; Magdelaine; Constance; Abraham; Jeanvier and Marie Louise Ebert. The whole being left them by their decd. mother and grandmother Magdelaine Landry, said sums to be paid to them at their age of majority. (Attached to the inventory is the following:) Date: April 8, 1799 Agreement - Etienne Ebert and Abner Gaile; they have named Mr. Jn Bte Babin, Sindic, to pass in arbitration with Joseph Michel LeBlanc who the said Etienne Ebert has named, and with Joseph Dupuy who the said Abner Gaile has named, to settle their differences in regard to the succession which is due to the child of Gaile. That Etienne Ebert owes the child. They have decided that Etienne Ebert should render account to the children, of: some animals in woods. Also a tract situated in the District of Baton Rouge which he sold to Mathurin Landry and which was not sold at auction. Also a tract situated in the District of Galveston, which has not been estimated; they agree that is should be sold and the heirs draw their parts due them. Deducted certain expenses. In a manner so that the half belonging to the minors according to an account, approved by the interested parties herein named, as well as of Joseph Babin, his son-in-law, be distributed. Abner Gaile will pay certain sum to his father-in-law, Etienne Ebert for upkeep of child for 3 years and give due acquittance to Etienne Ebert, for all mentioned hereinabove. Agreed that Etienne Ebert will pay 5% int. for which he passed his obligation, which int. is for upkeep of child.
