Firmain Landry. At the request of Mrs. Marie Eleine Amelton, widow of the decd. Firmain Landry; in her name as well as in her capacity of mother and tutrix of Dava Landry, her minor son, child of the second marriage; of Anselme Landry, in his capacity of paternal uncle and principal tutor to as well as Hipolite and Pierre Ferdinant Landry, the two latter minors emancipated by Judgment of the children of the second marriage. And Mr. Simon Pierre Babin inhabitant of this said place, maternal uncle and under tutor of the six minors of the first marriage; all in their capacity of heirs of the said deceased Firmain Landry. Observing the following: 1st. Marriage contract passed between him and Ludivine Babin before Mr. Dustisne on Feb. 5, 1774. 2nd. The inventory made after the decease of the latter, on January 7, 1792. 3rd. The act of acceptance of the amount of the inventory bearing the obligation of the above said Firmain Landry to come in the future, to his minor children on the part of their deceased mother, on the date of Jan. 10, 1792. 4th. Marriage contract passed between him and Marie Eleine Amelton, his widow, on Feb. 4, following. 5th. The inventory made on Sept. 28, 1792 and after the decease of Firmain Landry. 6th. Public sale which followed, Oct. 9, of same year. 7th. Finally, the decision of the Governor General dated Jan. 29, passed (1795) Added to amount coming from sale of the property of the decd. Firmain Landry are credits mentioned in act of Sept. 29, 1792. By act of acceptation and obligation of the last Firmain Landry, dated Jan. 10, 1792, the privileged sum coming to his eight minor children in the succession left by the late Ludivine Babin, their deceased mother; after paying various sums to various persons, money is to be divided among children: Hipolite, Pierre Ferdinant, Marine, Auguste, Landry, Henriette, Carmelite and Divine Landry, children of the first marriage also Firmain Deva Landry, child of the second; Mrs. Marie Eleine Amelton, widow, has also right to claim therefrom to this sum for a child's share according to the decision of the Governor General of this Province on date Jan. 29, passed, * * that her husband had given her by article five of their marriage contract, dated Feb. 4, 1792, according to the intent of the laws Causa Mortis; therefor sum divided into ten equal portions; 8 children by 1st marriage 1 by second marriage and widow. Date: March 28, 1795 Mrs. Marie Eleine Amelton widow of Firmain Landry to minors, Firmain Deva Landry. Having received sum for minor from Anselme Landry, she mortgages all her property until payment of same at age of majority or marriage; sum coming from Sucn of Firmain Landry. Date: March 28, 1795 Receipt - Hipolite Landry to Anselme Landry his uncle and tutor. For receipt of sum due him from the sucn. of his father, Firmain Landry. Date: March 28, 1795 Receipt - Pierre Ferdinand Landry to Anselem Landry, his uncle and tutor. Receipt for sum received from Sucn. of Firmain Landry. Date: March 28, 1795 Receipt - Anselme Landry to the Comdt. (DeVerois) for sum from auction of property of decd. Firmain Landry. Date: March 28, 1795 Minor's mortgage - Anselme Landry to minor's - Marine, Auguste, Landry, Henriette, Carmelitte, and Divine Landry, Mtgs. all property because he holds money from decd. and Divine Babin, their father & mother. Date: March 28, 1795 Minor's mtg. - Theodor Duga to Minors, Mtgs. following plantation because he holds money from succession. His plantation situated in this Post on the left bank of the Mississippi river adjacent above to the lands of Mr. Rivas and below to those of Simon Pierre Babin, containing six arpents of front on the ordinary depth. Surety - Simon Pierre Babin. Date: March 28, 1795 Minor's mortgage - Hipolite Landry and Pierre Ferdinant Landry to minors: Marine, Auguste, Landry, Henriette, Carmelitte and Divine Landry, their brothers and sisters. They have received of Anselme Landry, tutor, a certain sum, and mortgage the following: Their plantation situated in this Post on the left bank of the Mississippi river adjacent above to the lands of Victor Blanchard and below to that of Paul Babin, containing eight arpents five toises of front on the ordinary depth of forty arpents.
