Davey, a Notary Public, duly commissioned and quali- fied,in and for this City and the Parish of therein residing, and in the presence of the witnesses hereinafter named and undersigned: PERSONALLY CAME AND APPEARED, JAMES RICKER, of full age and majority and a resident of this City and State, who declared that he does by these presents, grant, bargin, sell, convey, transfer, assign and set over, abandon and deliver, with all legal warranties and with full substitution and subro- gation in and to all the rights and actions of warranty which he has or may have against all preceding owners and vendors, unto HARAHAN REALTY COMPANY, INC. a corporation of this City and State, herein represented by Andrew S. Chenet it's Vice President herein appearing in his said capacity under and by virtue of a resolution of the Board of Directors of said Company adopted on the 14th day of February, 1922, have present accepting, and purchasing for itself and assigns, and acknowledging due delivery and possession, thereof, all and singular the following described property to wit: A CERTAIN PORTION OF GROUND, situated in the Parish of Jefferson, on the left decending bank of the Mississippi River, at a distance of about five miles from the upper limits of the City of New Orleans, being part of the lot of ground designated by the No. 3 on a plan of survey of S.F. Lewis, Surveyor, dated December 25th, 1910, annexed to act of partition passed before E. Grima, Notary Public, New Orleans, March 19th, 1910, which portion of ground constitutes the rear portion of said lot No. 3 and measures as follows: Four hundred feet, five inches front on the right of way of Orleans Kenner Electric Railroad; Sixteen Hundred and Eighty feet, eight inches along the said line towards the City of New Orleans to point near letter V. on said plan; Five Hundred and twenty-seven feet, eight inches on line running towards the public road between points P and O on said plan; thence fronting on said public road one hundred thirty feet to point T on said plan; thence on line running towards the Mississippi River Twenty One Hundred and Thirty-three feet to point on right of way of Orleans Kenner Electric Railway, which is the point of beginning, the whole as more fully shown by sketch of S.F. Lewis, Surveyor, dated January 24th, 1916. Which portion of ground contains in area 17 and 68/100 acres, more or less. Together with all the buildings and improvements thereon rights, ways, privileges, servitudes and appurtenances thereunto attached and belonging; and also the servitudes of drain from points T ro U on said plan, in a canal or ditch ten feet wide extending from points P to O, held in common for use and benefit of lots Nos. 1, 2, and 3; and also the servitude of drain in a canal or ditch ten feet wide extending from points O to D, held in common for the use and benefit of lots 1, 2, 3, 4, 5, and 6; and also the servitude of passage and way over a road from from points P to O held in common for the use and benefit of lots 1, 2, 3 and 6; and also over another road from points O to M, held in common for use and benefit of Lots 1, 2, 3, 4, 5 and 6, as per said plan. The drainage canal from points P to O, shall be hereafter kept and maintained at the expense of the owners of lots 1, 2 and 3 in the proportion of the frontage of each lot bordering on said Canal or ditch. The drainage canal from point O to D shall hereafter be kept and maintained at the expense of the owners of lots Nos. 1, 2, 3, 4, 5 and 6 in the proportion of 1/6 each. There shall be constructed, kept and maintained, by and at the expense of the owners of lots 1, 2, 3 and 6, in the proportion of the frontage of each lot, a good substantial dirt road from points P to O, connecting with the contemplated road from the point O to M leading into the public road, said road to have a ditch on the north side of said strip of land and adjoining lot 6. so as to facilitate proper drainage of said road. There shall be constructed, kept and maintained, by and at the expense of the owners of lots 1, 2, 3, 4, 5 and 6 in the proportion of 1/6 each a good and substantial dirt road from the point O to M leading into the public road, and connecting with the contemplated road from points P to O, said road to have a ditch on the west side to facilitate the proper drainage of said road from points O to M. Being the same property which the said Ricker acquired from Patrick J. Morris on July 20th, 1921, by act passed before the undersigned Notary Public, registered in the office of the Clerk of Court of the Parish of Jefferson, In Conveyance Book No. 52, folio 11, and recorded in Mortgage Book No. 57, folio 613. To have and to hold the said above described property unto the said purchaser and it's assigns forever. This sale is made and accepted for and in consideration of the price and sum of Nine Thousand Four Hundred and Fifty Dollars ($9,450.00), in part payment and deduction whereof, the said Harahan Realty Company, Inc., has well and truly paid, in ready currency money, the sum of Twenty Seven Hundred Dollars ($2700.00), to the said Ricker, who hereby acknowledges receipt thereof and grants full acquittance and discharge therefor. And for the balance of the purchase price, the sum of Six Thousand Seven Hundred and Fifty Dollars ($6,750.00), the said Harahan Realty Company, Inc., vendee herein, assumes the payment of Five Certain promisory notes, dated at New Orleans, May 15th, 1921, each for the sum of One Thousand Three Hundred and Fifty Dollars ($1,350.00), drawn to the order of and endorsed by James Ricker, vendor herein, and payable one, two, three, four and five years from date respectively, which said notes stipulate to bear interest at the rate of eight per cent per annum from the date until paid, and are paraphed "Ne Varietur" to identify them with and act of mortage of the herein described property, passed before John C. Davey, Jr., Notary Public, on the 20th day of July, 1921, which said act of mortgage is recorded in the office of the Recorder of Mortgages for the Parish of Jefferson, State of Louisiana, in book 57, folio 613. James Ricker being duly sworn says; that he is married to Amelie Floree Lyons, who is living and residing this city with him. The parties hereto waive the production of the mortgage, conveyance and tax certificates and exonerate me, Notary, from all responsibility in the premises. THIS DONE AND PASSED in duplicate, at my office at the City of New Orleans, on the day, month and year first above written, in the presence of: Thomas Sachill and R. C.
