In pursuance of an order of the Honorable the Third Judicial District Court of the State of Louisiana bearing date the eighth day of August 1851 rendered on the petition of John Antheil of the Parish of Jefferson state aforesaid. Said petition representing that petitioner is one of the forced heirs of his deceased mother Saloma Antheil who departed this life on the third day of August 1851 in the Parish; that on the 30th day of July of the same year his same mother made her Last Will and Testament being a nuncupative will by public act passed before the undersigned notary. He further shows that no executor was named in said will and that it is necessary that one should be appointed to carry into effect the provisions of said will. Petitioner further prays that said will be filed, approved and homologated, that petitioner be appointed Dative Testamentary Executor and be permitted to take the necessary oath and that an inventory be taken by some competent officer. Said order of Court directing that the nuncupative will aforesaid be filed and homologated, that petitioner John Antheil forced heir of the deceased be appointed and sworn Native Testamentary Executor of said will and testament and sworn as such, that an inventory of the succession of the deceased be taken by the undersigned Notary, and that J M Beelman and John Helmer be sworn to appraise said property. I there found the said Saloma Armending in bed sick, but in full possession of her mental faculties as she appeared to me Notary and the witnesses herein are named and undersigned. And the said Saloma Armending required of me Notary to receive her last will and testament which she dictated to me in the presence of the following named persons expressly called upon by me Notary to act as witnesses to wit: William Duffy, John Helmer, and George Aichinger, all whom are citizens of the United States of America and of the state of Louisiana, and are of lawful age and reside in the Parish of Jefferson. And I have written the said will as the said testatrix dictated the same to me in the presence of said witnesses as follows: “My name is Saloma Armending. I am a native of Bermisen in the Kingdom of Bavaria. I am now aged fifty-two years. I have been in the United States of America about twenty years – have resided in McDonoughville in the Parish of Jefferson, state of Louisiana, about fourteen years. My father and mother are both dead. I have been married twice. My first husband’s name was George Antheil now deceased. My second husband’s name is Peter Rüth. I have five children now living to wit. John Antheil aged twenty four years, George Antheil aged twenty two years, Catherine Antheil aged twenty years, and Caroline Donalfelser aged fifteen years and Sally Donalfelser aged fourteen years. The first named children to wit – John, George and Catherine Antheil being lawful issues of my first marriage with George Antheil. I give, devise, and bequeath unto my two daughters Caroline Donalfelser and Sally Donalfelser my two lots of ground situate in the Town of McDonogh in the Parish of Jefferson in this state, designated by the numbers four and five of square number fifteen, measuring each in french measure sixty feet front on Washington Street by one hundred and twenty feet in depth between parallel lines, together with the improvements thereon. I give, devise, and bequeath unto my eldest daughter Catherine Antheil, wife of Julius Auguste Peterson of the Parish of Orleans, the negress named Hannah now aged about forty-five years. I give, devise and bequeath unto my two sons John Antheil and George Antheil the following described property: First – The undivided half or moiety of the two lots of ground situated in the Town of McDonogh in this Parish, designated by the numbers one and two, in square number fifteen said lots measuring each french measure sixty feet front on Washington Street by a depth of one hundred and twenty feet – lot number one fronting also on Copernicus Street with which it forms a corner together with the buildings and improvements thereon. Second – The undivided half of a piece or portion of ground situated in the Town of McDonogh in this Parish making part of the lot designated by the number three of square number fifteen. Said portion of ground measures in American measures sixty feet front on Washington Street by a depth of one hundred and twenty feet, bounded on one side by lot No. four and in the rear by the remaining portion of lot number three together with the buildings thereon. I give, devise, and bequeath unto my son John Antheil one of my cows being a muley cow or without horns. I give to my eldest daughter Catherine Peterson wife of Julius Auguste Peterson my other cow.” Thus the said testatrix dictated her said will to me, Notary, in the presence of said witnesses, and I have written the said will as the said testatrix dictated the same, in the presence of the said witnesses and having read the said will to the said testatrix in the presence of the said witnesses in a loud and intelligible voice, she declared that she understood the same perfectly well and that the same was her Last Will and Testament. Done without interruption or turning aside to other acts. Now your petitioner shows that it is necessary that the said estate should be settled as there are, as he is informed [ ] the same.
