Brashear Judge of the Parish of Lafayette and the Ex Officio Judge of the Court of Probates within and for the Parish aforesaid. The Petition of Ursin Hebert of the aforesaid Parish, with respect represents that he is the surviving Partner of the Acquists and Gains of the Property left in the community between your Petitioner and Dame Marie Margret Richard his deceased wife. Your Petitioner represents that there is six children of marriage between your Petitioner and his deceased wife aforesaid to wit - Ursin Hebert fils, Joseph Hebert, Lidi Hebert, Caroline Hebert, Uranie Hebert and Jacques Fastin Hebert all under the age of Puberty - and to whom your Petitioner is the Natural Tutor. Your Petitioner represents that he is desirous of ascertaining his rights in the said community as well the rights of his minor children aforesaid. Wherefore your Petitioner prays you to order that an Inventory of all the property in the aforesaid community together with an appraisement of the same be made, and that you also appoint an Under Tutor to the aforesaid minors in conformity with the Law. And after the Inventory and appraisement terminated that you order a meeting of family to convene before a competent officer to deliberate and advise to the most equitable and advantageous manner of disposing of the property in the community aforesaid to the best advantage of said minors and that you will make such other and further order as in Law and equity your Petitioner may be entitled to and as in duty bound. Brashear, Judge State of Louisiana Parish of Lafayette Be it remembered that on this Thirteenth day of July Anno Domini One Thousand Eight Hundred and Twenty Six at the request of Ursin Hebert of said Parish and in virtue of an order of the Court of Probates within and for the aforesaid Parish dated this day. Brashear Judge of the Parish of Lafayette and Ex Officio Notary Public within and for said Parish repaired to the domicile of the said Ursin Hebert of the Parish aforesaid for the purpose of causing an Inventory and appraisement to be made of all the property in the community between the said Ursin Hebert and the legal heirs and descendants of Dame Marie Margret Richard his deceased wife and to the effect of taking said Inventory and appraisement I the said Judge and Notary have administered the oath prescribed by Law to Charles Mouton and Athanas Meaux (resident inhabitants of said Parish) appraisers named and appointed by the Court of Probates aforesaid and approbation of all the Interested Parties and have proceeded to the said Inventory and appraisement in presence of all the Interested Parties and also in presence of (Blank Space) and (Blank Space) witnessed residing in said Parish as follows to wit: Lee Crockett’s Notes: "There were over thirty-six items inventoried and appraised. I have included only the most expensive items in my notes. The value of the Community Property of Ursin Hebert and Marie Marguerite Richard inventoried and appraised was $5584.27." 4. "One Negro woman named Marie aged Thirty five years and her child named Louise aged Eight years slaves for life. Estimated together at the sum of Eight Hundred dollars." 5. "One dwelling house in which the said Ursin Hebert now resides. Estimated at the sum of One Hundred and Thirty dollars." 6. "One certain portion of land situated in said Parish of Lafayette containing One Hundred and Six acres it being a part of the tract obtained from the United States in conformity to the Cerfiticate of the Register of the Land Office. Dated Oppelousas 4 May 1826. Estimated at the sum of Three dollars per acre." 7. "One certain portion of wood land situated in the said Parish of Lafayette containing one and one third arpents front lying on the west bank of the river Vermillion with the depth of the wood. The said portion comprised in a certain tract of wood land of four arpents front with the depth of the wood. Bounded above by the lands of Charles Braux and below by the lands of Moise Hebert. Estimated at the sum of Ninety Two dollars." 8. "One certain portion of land situated on the Conli de Mein containing fifty arpents superficial measure. Bounded on one side by the lands of Moise Hebert and on the other by the lands of Leufroy Boudreaux. Estimated at the sum of One Hundred and Fifty dollars." 11. "Seventeen gentle horses creole. Estimated at the sum of Twenty five dollars per head." 12. "Three hundred fifty one head of wild horned cattle estimated at the sum of Six dollars and fifty cents per head. One year old and upwards." 13. "Fifty four head of horses mares, etc. one year old and upwards. Estimated at the sum of Eight dollars per head." 23. "One certain portion of wood land containing one arpent front on the west bank of the river Vermillion with the depth of the wood. Bounded by the lands of Madame Fastin below. Estimated at the sum of Sixty two dollars." "The inventory and appraisement included household items such as bedding and furniture, farm equipment and many other valuable farm animals." Mouton Athanas Meaux His X Mark Louis Richard, fils Ursin Hebert His X Mark Anaclet Richard Louis Richard Valmon Hebert His X Mark Charles Braux His X Mark State of Louisiana Parish of Lafayette Court of Probates Let a meeting of the family of the minors named in the foregoing Petition: (composed of their nearest relatives, residing in said Parish) be called to appear before me as Notary Public Ex Officio to deliberate and give their advise, on the subject matter, of the foregoing Petition and, Philip Richard, Valmon Hebert, Narcisse Dugast, Moise Hebert pere, and Alexandre Guidry of said Parish, relatives of said minors and accordingly appointed to compose the said family meeting and it is further ordered that said family meeting do take place on the Twelfth day of this present month October at the Court House of the Parish in my office in said Court House. The Petition of Ursin Hebert of the Parish aforesaid with respect represents that according to an order of your Court of Probate within and for the Parish aforesaid dated on the Eighth day of October in the year 1832 whereof the original is written, at the end of a Petition presented to you by your Petitioner as Natural Tutor of his four minor children and heirs of his late wife Dame Marie Margret Richard, to wit: Lidi Hebert, Caroline Hebert, Uranie Hebert and Jacques Fastin Hebert all under the age of puberty to whom your Petitioner is Natural Tutor a meeting of family was duly convened before you as Notary Public Ex Officio composed of the nearest relatives of said minors and has deliberated and given their advise upon the subject submitted to them and stated in said Petition by which deliberation this said assembly - a copy of which is hereunto annexed - of family meeting together with the Under Tutor of said minors has advised that it would be greatly to the advantage of said minors to retain their mortgages or lien on the Wood Land stated in said deliberation and to release their rights on the Portion of Prairie Land also therein mentioned in favor of Moise Hebert pere. The premises considered your Petitioner therefore prays that he may be duly authorised by your court as Natural Tutor of the aforesaid minors to release and abandon their rights in and to the portion of Prairie Land as set forth in the deliberations of the meeting of family and also that you will homologate the said proceedings and your Petitioner prays for all further relief and as in duty bound.
