Brashear, Parish Judge and Ex Officio Judge of the Court of Probates within and for the Parish of Lafayette in the State of Louisiana. The Petition of Anaclet Richard of said Parish with respect represents that he is the Under Tutor of the minors (Blank Space) Hebert and Caroline Hebert. Two of the heirs of the late Ursin Hebert late of this Parish deceased, issue of his lawful marriage: in premier noce with Dame Marguerite Richard also deceased, and that by the death of the late Ursin Hebert aforesaid: the two aforesaid minors are now destitute of Tutors to administer their property and to take care of their persons. The Succession of their late Father Ursin Hebert aforesaid being now open in the Parish aforesaid: and before the same can be legally administered: it will be necessary to have said minors provided with a Dative Tutor or Tutors: and in order that said Tutor or Tutors may be legally appointed, it will be necessary to call a meeting of family to deliberate and advise as to the person or persons best qualified to become the Tutor or Tutors of the two aforesaid minors. The premises considered your Petitioner prays that you will order a meeting of family to convene before a competent officer to deliberate and give their advice, touching the interests of the two above named minors in the appointment of a Dative Tutot or Under Tutors: to administer their property and persons. And your Petitioner prays for all such other and further reliefs as law and equity require and as in duty bound. Witnessed By: T. B. Brashear Parish Judge and Ex Officio Notary Public within and aforesaid Parish and in presence of the witnesses herein after named and undersigned. Personally appeared Moise Hebert pere, Valmon Hebert, Louis Richard, Philipe Richard, and Moise Hebert, Jr. all of said Parish relatives of the minors herein after named composing a meeting of family duly convened before me the said Judge and Notary, in virtue of an order of the Court of Probates within and aforesaid Parish dated on the Ninth day of January. Instant, for the purpose of deliberating and advising relatives to the interests of Jacques Hebert and Caroline Hebert minor heirs of the late Ursin Hebert late of this Parish deceased, issue of his lawful marriage in premier noce with Dame Marguerite Richard also deceased, and the said assembly of Family Meeting having been duly sworn as the law directs has consulted deliberated and advised and do deliberate advise and declare as follows that is to say is being to the knowledge of this assembly of family meeting that the late Ursin Hebert aforesaid: acted up to the day of his death as Natural Tutor of his two minor children aforesaid: that since the death of the said Ursin Hebert the two aforesaid minors have been destitute of Tutors and and that it is now the duty of the present assembly of family meeting: to recommend to the Court of Probates of said Parish some person or persons qualified in the opinion of said assembly of family meeting to take the Dative Tutorship of the two aforesaid minors: and the said assembly of family meeting having taken a careful view of the situation of said minors and finding that said minors have three brothers of full age: either of which are capable of administering the property of said minors: the said assembly of family meeting do unamimously recommend and advise that Ursin Hebert fils of said Parish brother of said minors be constituted and appointed Dative Tutor of the same: and the said assembly of family meeting having declared they had nothing further to deliberate or touching the interests of said minors they do therefore hereby close the present deliberations and before figuring the same personally intervened Anaclet Richard Under Tutor of said minors duly sworn who declared that he had inspected the above out of family meeting and in his said capacity of Under Tutor recommends the confirmation of the same. Done signed and prepared at the late residence of said deceased the day and year first above written in presence of (Blank Space) and (Blank Space) competent witnesses who have hereto figured with all these apprasers and me Judge and Notary aforesaid after due reading. Brashear Parish Judge and Ex Officio Notary Public within and for said Parish and in presence of the witnesses herein after named and undersigned. Personally appreared Dame Rosalie Hache of said Parish of full age widow of the late Ursin Hebert late of this Parish deceased of his second marriage of the first part. And also personally appeared Joseph Hebert, Ursin Hebert, Gedeon Hebert, Uranie Hebert wife of Lazan Broussard and by her said husband duly authorised in the execution hereof and Dame Caroline Hebert wife of Emile Sonier and by her said husband duly authorised in the execution hereof all of full age and residing in the Parish of aforesaid and heirs of the late Ursin Hebert aforesaid of his first marriage with Marie Marguerite Richard, also deceased, all of the second part hereto who have made and intend into the following agreement as follows to wit: The said Dame Rosalie Hache of the first part hereto covenants and agrees for and in consideration of the premises herein after named to abandon the Comminity of Acquists and Gains between her late husband Ursin Hebert aforesaid in favor of all the Heirs of said deceased and that she does by then present renounce and abandon in their favor of the said Community of Acquists and Gains and that she makes said renunciation in due form of Law. And the said Parties of the second part hereto for and in consideration of the aforesaid renunciation do by then present grant cede transfer alienate and deliver in full property to the said Dame Rosalie Hache of the first part hereto one certain negro woman named Louise aged about Twenty five years and her four children to wit: Narcisse aged Ten years, Francis Eight years, Clemence Six years and Marie Two years all slaves for life. Which slaves the said apprasers warrants and forever defends the title thereof to be free from the lawful claims of all and every person and persons whatsoever and to have and to hold said slaves to the duly proper on benefit and enjoyment of her the said Rosalie Hache her heirs and assigns forever. Dugas $30.00 $8019.75 From which is deducted 1. Amt. of Joseph Sonier's purchases $15.00 2. " of Mad Ursin's purchases $18.12 1/2 $33.12 1/2 3. Amount of debts paid $1690.76 4. Parish Judge for his fees for Portage $30.00 $2774.24 $5245.51 Which seven items added makes the sum of two thousand and seven hundred and seventy four dollars and 24/00 - which sum deducted leaves the sum of five thousand and two hundred and forty five dollars and fifty one cents to be divided amont the six heirs of said deceased and which sum divided gives to each of them as follows to wit: Amount Brought Forward $5245.51 To Ursin Hebert $874.25 " Joseph Hebert $874.25 " Gedeon Hebert $874.25 " Caroline Hebert wife of Charles Sonier $874.25 " Uranie Hebert wife of Lazan Broussard $874.25 Which seven items added together make the orinial $5245.51 to be divided. There is due to Charles Sonier in the right of his wife Caroline Hebert $874.25 - $660.00 = $214.00 due him by his coheirs. etc.
