All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** Assumption Parish, Louisiana Inventory Book 1839, pages 413-416 [The tight binding on the left side of this page obstructs some of the words.] "it Known that on Wednesday the second day of October eigh- teen hundred & thirty nine, before me Bela Hubbard parish judge ex officio Notary Public, in & for the Parish of Assumption, at ten in the morning, by virtue of a Decree, of the Court of Probates, of said Parish, bearing date the 30th September 1839, person ally came and appeared Messr Joseph Dugas, Ursin Marsix [Maroix?], Ursin Daigle, Dorino Bourg, & Hypolite Bourg The nearest friends & relatives of Victor Roger, Victorine Roger & Irma Roger, minor children of Auguste Roger by his first marriage with Marie Modeste Gotreaux, both deceased, and of Zulme & Augustine Roger - minor children of the said decd August Roger & issue by a second marriage, with Emerante Bourg, said appearers forming a family meeting, to deliberate on the interests of said minors, & to take into consideration the subject matter of the petition of said Emerante Bourg widow of said decd Auguste Roger, representing therein, that the minors of the first marriage, remain without a tutor, that the decd left moveable & immoveable property, that an inventory be made of said property, to be followed by a public sale that a family meeting be convened to appoint said tutor [ ? ] fix on the term & condition of said sale, and the said members being now formed into a family meeting, The said parish judge laid before them, the said petition & having first administered to them the oath, to give their advice & opinion, on the subject submitted to them & touching the interest of said minors & having maturely reflected thereon, assisted by the under tutors of said minors, have decided on follow 1o That Mr. Simon Leblanc of this Parish be appointed tu- tor to the said minor children of the first marriage, on his gi- ving security according to law - 2d That it will be to the interests of all of said minors, that all the property left by said Auguste Roger, be sold at public auction, after the le- gal publication and on the following term & conditi- on, to wit: The moveable property payable, the one half in March next 1840 & the other half in March eigh- teen hundred and forty one, being in their opinion the most advantageous to the interests of said minors & the land[?] property & slaves payable, one third in March next, one other third in March, eighteen hundred & forty one & the remaining third in March, eighteen hundred & forty two. Judge [The following is written in the same handwriting but with an instrument with a finer point.] On motion of said petition ordered that Simon Leblanc be appointed tutor to said minors on his giving security & taking the oath according to law. It is further ordered & decreed this & the aforesaid deliberations be & are hereby homologated . It is further ordered, ad judged & decreed that all of said property be sold at public sale on Saturday the 2d Novbr 1839 at 10 in the morning on the premises, on the terms & conditions fixed by the family meeting, after having been legally published for thirty days This 2d day of October 1839 Bela Hubbard, par. judge ex officio Judge of Probates [Th]e Honorable the Court of Probates in & for the Parish of Assum- tion & State of Louisiana The petition of Mirante Bourg of said Parish, respectfully represents that Auguste Roger her late husband, departed this life on or about the 27 September last past leaving, moveable & immoveable property, separate as well as belonging to the com munity which existed between your petitioner & her said decd husband, also five minor children, Victor Roger, Victorine Ro- ger & Irma Roger of his first marriage, with Marie Modeste Gotreaux decd & who remain without a tutor. & the two others issue of his marriage with your petr named Zulme & Augustine Roger. Your petitioner being by law natural tutrix of her said minor chil dren, is desirous of being confirmed in the tutorship & of having an un der tutor appointed to them Your petitioner further stated that she has been advised, it will be necessary to cause an inventory of said property to be made to be followed by a public sale thereof in order to proceed to a legal partition among the heirs & that a family meeting should be convoked, to deliberate on the interests of said minors & fix on the terms & condition of the said sale. Wherefore your petitioner prays, that she may be confirmed in the tutorship of the said minor children & that Alcide Bourg may be appointed their under tutor. She further pray, that a tutor & under tutor may be appointed, to the minors by said first marriage that an Inventory of said separate & community property be made & the appraisers appointed. Judge [The following is written sideways on the page.] Parish of Assumption Court of Probates Estate of August Roger Petition of Mirante Bourg filed 30 September 1839 Bela Hubbard par Judge On reading the within petition, it is ordered that Mirant Bourg widow of the said decd be confirmed in the tutorship of her said minor children & Alcide Bourg - undertutor to the same, on their taking the oath required by law. & it is further ordered that Charles Gotreaux be appointed under tutor to the said minor children of the first bed. It is further ordered & decreed that an inventory of said property be made on Saturday 2d Novr ending, in the premises at 10, in the morning & that Joseph Dugas and Ursin Maroix, both inhabitants residing in said Parish be appointed appraisers - It is further ordered & decreed that a family meeting be convened before me on Wednesday on the 2d Octr 1839, at my office, at 10 o'clock forenoon, to be composed of Joseph Dugas, Ursin Maroix, Ursin Daigle, Dor- cino B ourg & Hypolite Bourg the nearest relatives & friends of said minors, to deliberate on their interests & to take into consideration, the subject matter of the [?] petition & finally it is ordered that both of said undertutors be notified to attend & assist at said Inventory & family meeting.
