Falgout Funeral Home of Galliano is in charge of arrangements. ===================== HERBERT O'NIELL Herbert O'Niell, Lafourche Parish's first public defender in the 17th Judicial District, died Sunday at age 70 after a long bout with cancer. O’Niell a native of Gretna, served as public defender in Lafourche Parish for 14 years. He also practiced civil and -criminal law in New Orleans and Thibodaux before he retired to Mississippi Oct. 31, 1990. O'Niell received his law degree from Louisiana State University. A memorial service is scheduled at 2:30 p.m. Wednesday at Riemann Funeral Home in Bay St. Louis, Miss. Visitation is Wednesday from 1:30 p.m. until funeral time. O'Niell is survived by his wife Merlyn Dunbar O'Neil of Waveland, Miss.; three sons Herbert Edwin O'Niell II of Baton Rouge, David Michael O'Niell of San Antonio, Texas, and Walter Lindes O'Niell of Oxford, Miss.; a daughter Ronnie O'Niell Einhorn of Mill Valley, Calif., and sister Patricia O'Niell Reeves of Gulfport, Miss., He is also survived by three granddaughters. He was preceded in death by his parents Herbert Edwin and Blanche Josephine Belanger O'Niell. ===================== JUDGE SIDNEY ORDOYNE, 17th Judicial District, said O'Niell will be missed terribly. "I've known Herb for at least 20 years," Ordoyne said."Everyone who knew him will miss him terribly. He was always enjoyable to talk to." Ordoyne said he met O'Niell when they both started private law practices in Thibodaux about 20 years ago. "(O'Niell) was instrumental in drafting legislation for a statewide public defender system," Ordoyne said. "We worked closely together when I was in the district attorney's office and he was public defender. He was a very close friend and will really be missed terribly." Six years out of law school, O'Niell quit his job as a staff attorney for Southern Pacific Railroad and moved to Thibodaux to work with his law school friend Bernard Knobloch. He went on to work in the Lafourche Parish District Attorney's Office before becoming public defender. "I enjoyed working in the District attorney's office, but not enough to, keep doing it," O’Niell said in an interview a few months before his retirement. "I much prefer defending." O'Niell said he didn't think of himself as a defender of guilty people, but as a defender of the U.S. Constitution which guarantees everyone the right to a fair trial. "I got to be a lawyer by accident," he said. "I didn't like law school and I didn't like practicing law. But I always liked criminal law.” O'Niell had planned to write a book about his experiences as public defender after his retirement. Barker, 64, was told by her doctor in December of 1990 that she only had six months to live, so she sought the services of the Hospice program of South Louisiana. Barker said last November that she wasn’t afraid of dying. “I’m no longer afraid of death” she said. “I’ve made my peace with my four children. Hospice took me by the hand and led me and my family through the trying times." Barker was a native of Harlingen, Texas. She has been a resident of Thibodaux since 1946. She was a member of about 18 civic, social and religious organizations, a few of which include Lafourche Parish Council on Aging, Lafourche Parish Community Action, Archdiocesan Apostolate on Aging, Teche Clearinghouse Review Board, Les Amie, St. Joseph Altar Society and Ladies Golf Club.
