All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** Eli Splawn & wife Sale of Land to Joshua Johns State of Louisiana } Parish of Catahoula } BE IT KNOWN, That on this 31st day of January in the Year of Our Lord One Thousand Eight Hundred and Fifty seven and of the Independence of the United States of America, Before me Richard H Curry, a Notary Public in and for the Parish of Catahoula, State of Louisiana, duly commissioned and sworn, and in the presence of the witnesses hereinafter named and undersigned, personally came and appeared, Eli Splawn & his wife, Elizabeth Splawn both residents of the aforesaid Parish & State who declare that they do by these presents Grant, Bargain, Sell, Convey, Transfer, Assign and Deliver with a full Garrenter against all troubles, Debts, Mortgages, claims, evictions and Donations or other incumbrances whatever unto Joshua Johns of the Said Parish & State who is here present purchasing and accepting the following described property To Wit," A certain tract or parcel of Land situated in the Parish of Catahoula lying & being on the French Fork of Little River constituting Lot No. Six being the fractional North East quarter of Section No. Thirty, also lots No four and five of Section No. Thirty one. Also lot no. seven being the South East fractional quarter of the south west fractional quarter of Section No. Thirty - The whole lying and being in Township No. Seven North of Range No. Five East and containing in all the one hundred and fifty and ninety hundredths acres more or less. Being the same land acquired by these vendors from Wm. L. Lacy by Deed of Sale passed on the 29th Day of November A.D. 1855, & Recorded in Liber. J. on the 29th Dec. 1855, pages 506-7 & 8. Also Eighty acres of Land being the west half of the south quarter of Section No. Thirty-six Township No. Seven North of Range No five East, being the same purchased by these venders from John P. Elam by Deed of Sale passed on the 23rd January 1857 - To with all the improvements and appertances then unto belonging on in any appertaining to the aforesaid and above described tracts of Lands - This Sale is made for and in consideration of the sum and price Four thousand and Eighty Dollars cash in hand paid the receipt of which is herby acknowledged. TO HAVE AND TO HOLD the said Land unto the said purchaser, his heirs and assigns forever. And the said vendor hereby binds themselves and their heirs forever to warrant and defend the title to the Lands herein conveyed, against all legal claims and demands whatever. The said vendor moreover transfer unto said purchaser all rights and actions of warranty to which their may be entitled, against all the former proprietors of the Lands herein conveyed, subrogating said purchaser to the said rights and actions to be by him enjoyed and exercised in the same manner as they might have been by the said vendor And now, to these presents personally came and appeared, Madam Elizabeth Splawn, who, after having taken cognizance of the foregoing Act, which I, the said Notary carefully read and explained to her declared and said that she approves and ratifies the same, and that it is her wish and intention to release in favor of the said purchaser the herein described from the matrimonial, dotal, paraphernal and other rights, and from any claims, mortgages or privileges to which she may be entitled, whether by virtue of her marriage with Eli Splawn or otherwise WHEREUPON, I, the said Notary did inform the said Mrs. Elizabeth Splawn apart, and out of the presence and hearing of her husband, that, by the laws of this State, the wife has a legal mortgage on the property of her husband: FIRST,-- For the restitution of her dowry, and for the reinvestment of the dotal property sold by her husband and which she brought in marriage, reckoning from the celebration of the marriage. SECONDLY,-- For the restitution and reinvestment of the dotal property by her acquired since marriage, whether by succession or donation, from the day the succession was opened, or the donation perfected.-- THIRDLY, -- For nuptial presents, FOURTHLY, -- For debts by her contracted with her husband. And FIFTHLY, -- For the amount of her paraphernal property alienated by her and received by her husband, or otherwise disposed of for his individual interest: That in making this intended renunciation, would deprive him irrevocably and forever, of all rights of reclamation aginst the Lands herein described, whether under mortgage, privilege or otherwise. And the said Elizabeth Splawn did thereupon declare unto me that she was fully aware of, and acquainted with the nature and extent of the matrimonial, dotal, paraphernal and other rights and privileges thus secured to her by law on the property of her said husband, and that she nevertheless did persist in her intention of renouncing and does personally renounce, not only all the rights, claims, and privileges herein before enumerated and described, but all others, of any nature or kind, whatever, to which she is or may be entitled by any laws now or heretofore in force in the State of Louisiana. And the said Eli Splawn being now present, aiding and authorizing the said Elizabeth Splawn in the execution of these presents the said Elizabeth did again declare the she did and does hereby make a formal renunciation and relinquishment of all her said matrimonial, dotal, paraphernal and other rights, claims and privileges, in favor of the said purchasers, binding herself, and her heirs at all times to sustain and acknowledge the validity of this renunciation. THUS DONE AND PASSED, in my office at Harrisonburg aforesaid, in the presence of G.H. Patillo and John W. Hooter, Witnesses, both of this parish who hereunto sign their names with the parties and me, the said and the said parties dispose with the production of a mortgage certification & exonerate me said Notary from all responsibility arising from and growing out of the non production the same -- as required by the laws of the State of Louisiana.
