Collins to Eli Splann with wifes renunciation on the 14th day of December 1857 State of Louisiana Parish Of Catahoula Be it Known by these presents that before me R.G. Wooton, Jr., a Notary Public in and for the said Parish & State and the subscribing witnesses personally came and appeared R.W. Collins of the above residence who declared that for and in consideration of the sum of Eleven Hundred Dollars cash the Receipt of which is hereby acknowledged he had this day sold and by these present does sell transfer and deliver unto Eli Splann of the same residence who is personally present and accepting for himself all of his right title and interests in and to a certain tract or parcel of land to wit: All of the North East fractional quarter of Section No. Thirty-Six (36) lying on both sides of Little River in Township No Seven north of Range No. Four East in north of Red River Land District Louisiana containing one hundred and thirty four 14/100's acres according to the official survey of said Township on file in the State Land office which said lot of land is a portion of the location of the swamp land warrant no. 1646, H.H.S. issued to the Vendor January 19, 1857 to have and to hold the same forever for his only proper use and benefit his heirs or assigns, the title to which tract or parcel of land the Vendor doth warrant and will forever defend to be free from the lawful claim of all persons whosoever. And the parties hereby agree to wave the production of a Mortgage Certificate as is required by article 3328 of the Civil Code of Louisiana and to hold me said notary harmless in the premises. And now also appeared Mrs. Susan Carroline Collins wife of the said Reuben W. Collins who being above the age of majority who declared unto me said Notary that it is her wish and intention to renounce and relinquish in the favor of the said Eli Splann all of her rights of every kind or nature whatsoever. She has in and up on the tract or parcel of land above describes whether the same arise by Virtue of her marriage with the said Reuben W. Collins or otherwise where upon . I the said Notary did in form the said wife separate and apart and out of the presence and hearing of her said husband that she had by law a legal and tacit Mortgage up on all the property of her said husband. 1st For the dotal property alinated by him and for the restitution and reinvestment of the same. 2nd For the dotal property by her acquired by her since the mortgage whether by succession or donation from the time the succession was opened or the donation perfected. 3rdly For the Nuptial presence 4thly For debts by her contracted with her said Husband and 5thly For the amount of her paraphernal property by her alinated and the proceeds thereof received by her said husband or otherwise disposed of for his individual benefit and the said Susan Carroline Collins did there upon declare unto me the said notary that she was fully aware of the law and well acquainted with the extent of her rights, priviledges and interest secured to her by law, but that she did nevertheless voluntarially and of her own free will and accord renounce and relinquish in favor of the said Eli Splann not only all the rights claims and privilidges herein before expressed or mentioned but all others of any motive whatsoever which she may be entitled by any law now or hereafter in force in Louisiana and that the said Reuben W. Collins being now present aiding and authorizing the said wife in the execution of these presents she the said wife did declare and does hereby make renunciation and relinquishments of all her dotal paraphernal and matrimonial rights claims and priviledges in and upon the said tract or parcel of land herein before described in favor of the said Eli Splann binding herself and her husband and her assigns at all times and acknowledge the validity of this her rennunciation . This done signed and passed this the 14th day of December A.D. Eighteen Hundred and Fifty Seven in the presence of the subscribing Witnesses and me the said Notary.
