All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** SUCCESSION OF ELIAS CARTER, Sept 1842 State of Louisiana } Parish of Catahoula} Be is Remembered that on this 3rd day of September A.D., a family meeting comprised of the persons having after named being relatives commissions by affinity and friends of the minor heirs of Elias Carter, dec'd commenced at the office of the undersigned Judge for the purpose of deliberating upon matters connected with the interests of said minor to wit: Samuel Walker, Simeon Duke, Shalom Young, Harmon Brown, M.G. Brown, John W. Stone_________ all of whom being duly sworn and organized proceeded to the consideration of the Subject presented to them; the undersigned Judge in his capacity of Notary Public presiding___The Subjects presented for the consideration of the meeting rose the following to wit: ___The situation of a suitable person to be appointed Tutor of Barton Mortimer Carter one of said minors under the age of puberty___The purpose of dividing the slaves of the Succession of Elias Carter or in Kind considered as to the benefit or injury such division might produce to the minors___ What property of the Succession it will be proper to sell and the times at which it shall be sold: And the property of authorized the Tutors on behalf of the minor heirs to notify and confirm a contract of Sale and exchange made by the late Elias Carter dec'd and Thomas L. Duke dec'd by which Elias Carter it is alleged gave a certain Negro woman named Maria and one child to said Duke for all the right title and interests of said Duke in and to the improvement and establishment made by Carter & Duke on Little River as the same mentioned as property of Said Carter's Succession___ Which Said contract was never carried fully into effect by executing conveyances between the Said parties or in any manner reducing their agreement to a meeting.______ This subject being considered this meeting came to the following conclusions to wit: ___ They recommend Samuel P. Stone as a suitable person to be appointed Tutor to Barton Mortimer Carter the minor under puberty. ____ They recommend and advise as most to the interest of the minors that the slaves be divided in Kind but that they remain under the charge of Isaac L. Baker until the crop is gathered.____ The place in the pine woods to be delivered on the 1st of January to the purchaser and the improvement on Little River to be delivered to the purchaser immediately on his complying with the terms of sale meaning the right of Isaac L. Baker to stay on the place until the crop is gathered. The meeting advise the Sale of all the property of the Succession except the slaves and they advise the sale to be made on the following terms and conditions to wit:_____ For all Slaves of twenty dollars or under cash____for all terms above twenty dollars and over one hundred dollars on credit of one year and for all slaves above one hundred dollars a credit of one two and three years from the day of sale payments to be made in equal consideration statements purchasers to give notes with good and sufficient security in solids or notes stipulating interest at the sale of ten percent for commission from date if not punctually paid and to be drawn payable at the office of the parish Judge of the parish of Catahoula_____ A Special mortgage also to be retained in the tract of land in the pine hills as additional and further security.______ The meeting and hearing evidence of the contract between Elias Carter and Thomas T. Duke came to the conclusion that the Same ought to be satisfied and respectively authorize the tutors to the minors to consummate the Said contract on their part.___ In forth whereof the members of the meeting hereunto Personally Subscribe their names on the day and date herein first above written._______ J.W. Taliaferro, Parish Judge & Ex officio Notary Public Court of Probate Parish of Catahoula, November 1842 Ordered that the proceedings of the family meeting herein before detailed homologated and confirmed and that Sale of the property of the Succession of Elias Carter dec'd, except the slaves, be made on the terms presented by Said family meeting after the legal advertisements have been made.______It is further ordered that the Slaves & the proceeds of the sale of the property of the Said Succession be partitioned among the heirs as prayed for by the heirs of age and as recommended by the meeting on behalf of the minors. Done and Signed in open Court this 7th day of November A.D. 1841___ James G. Taliaferro, Judge of Probate To the honorable James G. Taliaferro Parish Judge and ex officio Judge of Probate in and for the Parish of Catahoula, La.____ The Petition of Nancy Stone, Elizabeth Baker, Emeline Duke & Sarah Carter, the said Nancy Stone & Elizabeth Baker being herein duly assisted by their husbands Samuel P. Stone and Isaac L. Baker, with respect showeth that a family meeting was conducted on the 30th of September 1841 to deliberate on matters presented by these petitions in a petition filed in your office on the 20th of September aforesaid, and the proceedings of Said family meeting is herewith presented and these petitioners pray that Said proceedings may be homologated and approved & prays as in duty bound & c_______ S.P. Stone Petititoners further represent that Attny they concur in the Terms of the sale prescribed by Said meeting on the part of the minors, and they pray that Said sale be made on the terms & conditions set forth in Said proceedings & prays & ______________ S.P.
