To the Honorable the Judge of the Third Judicial District Court in and for the Parish of Lincoln, State of Louisiana. The petition of James T. Miselle, a resident of your said Parish and State , with respect shows that his brother, Z. C. Miselle, died intestate, unmarried and without issue, about April 1864, away from home and in the Army of the Confederate States, leaving some real property situated in what is now Lincoln Parish and leaving as his heirs his mother, Sarah Miselle, and his brothers and sisters. He shows that he, J.W. Miselle, Sarah J. Miselle, wife of Thomas Z. Kent, Elizabeth Teasly ( nee Miselle) (now deceased and represented by her children, Sarah Mitchell, Elizabeth Holland, and Wm Z Teasly), and Sarah P. Cox, nee Miselle, (now deceased and represented by her children, Phebe L. Thomas, Sarah P. Cox and Martha A. Cox) and his mother, the said Sarah Miselle are the sole heirs and legal representatives of the deceased, Z.C. Miselle. He shows that his said brother, Z. C. Mizelle, deceased, was indebted to your petitioner at the time of his death, that he was then agent for said deceased for the preservation and protection of his land, in your said parish, was paying taxes on said land and he has, since the death of said Z. C. Miselle continued to pay taxes upon and preserve the land belonging to the succession of said deceased. He shows that said succession owes debts and an administration is necessary. He is an heir of the deceased and creditor of his succession and is entitled to the administration, and applies therefor. He prays that his application to be appointed administrator of said succession be advertised according to law, that J. W. Williams, Clerk of the Court and Ex Officio Recorder and Ex Officio Notary Public in and for your said parish be ordered and required to make a full fair and complete inventory and appraisement of all the property belonging to the succession of said deceased, situated in said parish and make return according to law, that after legal delays and formalities your petitioner be appointed Administrator of the succession of Z. C. Miselle, deceased. He futher prays for necessary orders and decrees for costs and general relief. Signed: G. L. Gaskins, Atty for Petitioner State of Louisiana } Parish of Lincoln } In 3rd Dist. Court, The foregoing petition the prayer thereof and the law being considered it is hereby ordered and decreed that J. W. Williams, Clerk of the Court and Ex Officio Recorder and Ex Officio Notary Public, in in and for the parish aforesaid, be and he is hereby ordered and directed to make a full fair and complete inventory and appraisement of all the property belonging to the succession of Z. C. Miselle deceased, situated in the said parish and state and due return thereof make according to law. It is further ordered and decreed that the application of James T. Miselle to be appointed Administrator of said succession be advertised according to law, and after legal advertisement for ten clear days, and no opposition being filed, it is ordered that said James T. Miselle be appointed administrator of said succession upon his giving bond, with good security, as required by law, in a sum one fourth over and above the amount of the inventory of the property of said succession, (??) under this order.
