To the Honorable Allen Barksdale, Judge of the 3rd. Judicial District Court holding sessions in and for Lincoln Parish, Louisiana:- The petition of Martin V. Pruitt, a resident of' Lincoln parish, Louisiana, with respect represents that James Trice Mizelle, late a resident of Lincoln parish, Louisiana, recently died leaving a small estate which he disposed of by last will and testament, nuncupative in form, by private act, bequeathing all his property to Martha Ann Cox and Sarah P. Couch, nee Cox, both residents of Lincoln parish, Louisiana, and in which he appointed your petitioner executor of his said will; all of which will more fully appear from said last will and testament filed herewith, and made a part hereof. Your petitioner represents that the said James Trice Mizelle left no forced heirs, either ascending or descending, and that he left the following collateral relations who are his heirs and who are all majors, Viz: Josephine Kent, nee Mizelle, wife of Z.T. Kent, a resident of Lincoln parish, Louisiana, who is a sister; Sarah P. Couch, nee Cox, a widow and feme sole, Martha Ann Cox, a feme sole, both residents of Lincoln parish, Louisiana; Phoebe Thomas, nee Cox , wife of Lawson Thomas, residents of Bienville parish, Louisiana; who are his nieces, being all children of the same mother, a deceased sister of James Trice Mizelle; William Teasly, a nephew, Sarah Mitchell, nee Teasly, a widow and a feme sole, a niece; and Bettie Holland, nee Teasly, a niece, wife of B. M. Holland; all residents of Bienville parish, Louisiana, and children of the same mother, a deceased sister of James Trice Mizelle: the above named persons being the only heirs of said James Trice Mizelle. Your petitioner alleges that said will should be probated, filed and executed, and that letters testamentary should be issued to him as executor of said will. Wherefore premises considered, petitioner prays that a day, hour, and place be fixed for the proof of said last will and testament of James Trice Mizelle and that the above mentioned heirs have due and legal notice in writing of said time and place, that they may attend the proof of said will; and that after said last will and testament has been duly proven, that same be probated and ordered registered and executed; that your petitioner be confirmed as executor of said last will and testament, and that letters testamentary be issued to him as such; that the subscribing witnesses to said will be duly summoned, all of them being residents of Lincoln Parish, Louisiana, except W. M. Tilley, who resides in Bienville Parish, Louisiana; that an inventory and appraisement be made and taken of all the property, real and personal, rights and credits belonging to the estate and succession of said James Trice Mizelle, and that commissions issue to J.W. Williams, clerk of 3rd District Court in and for Lincoln parish, Louisiana, and to J. W. Tooke, clerk of the 2nd. District Court in and for Bienville parish, Louisiana to make and take said inventory and appraisement of the property situated in their respective parishes and that they give said heirs above mentioned notice of the time and place of taking same. By reason of the law and the foregoing petition, it is ordered, adjudged and decreed that Wednesday the 6th day of March A.D. 1895, at Eleven O'Clock A.M. at the Court- house in Ruston, Lincoln parish, Louisiana be fixed as the time, place and hour for proving up and probating the instrument of writing filed with this petition and purporting to be the last will and testament of James Trice Mizelle, late of Lincoln Parish, Louisiana; before me or if I be absent before J. W. Williams, CDC, that A.R. Bowden, W.M. Tilley, N. Boddie, W.M. Durrett and T.L. Smart, purporting to be the subscribing witnesses to said will be duly summoned to appear at that time and place; that the heirs named in the foregoing petition have due and legal notice of said time and place of proving up said last will and testament. It is further ordered, adjudged and decreed that commissions issue to J.W. Williams and J.W. Tooke as prayed for and that the heirs be given notice by them of the time and place of taking said inventories. Thus done and signed officially on this, the 21st day of February A.D. 1895.
