Brown31 March 1853Be it Known and remembered that on this thirty first day of March in the year ofour Lord one thousand eight hundred and fifty three and in the year of theIndependence of the United States of America, the Seventy Seventh.Before me Gastin T. Raoul, recorder of said Parish, and duly authorised by lawto exercise the powers of Notary Public therein, personally came and appearedMr. Benjamin Manning, a citizen of the Parish of Livingston, state aforesaid,who did declare and say that for the consideration hereinafter expresses he doesby these presents, grant, bargain, sell, convey, transfer, assign, and set over,with a full guarantee against all troubles debts, mortgages, claims, evictions,donations, alienations, or other incumbrances whatsoever unto Messrs. JamesClark and William B. Benson of the City of New Orleans, herein represented byMr. George Richardson who is here present accepting and purchasing for the saidClark & Benson, their heirs and assigns, and acknowledging delivery andpossession thereof,A certain tract or parcel of land situate, lying and being in said Parish ofLivingston on the river Ponchatoulas being the west half of the North Eastquarter and the West half of the South east quarter of section No. twelve (12)in Township No. seven (7) south of Range No. seven (7) East containing Onehundred and Sixty Six 79/100 acres, together with all the buildings,improvements, privileges, and appertenances to the same belonging or in anywiseappertaining, vendor acquired said land from the Government of the UnitedStates, in part by location of military land warrant No. 19.948 and in part bypurchase.To have and to hold said property unto the said purchaser, their heirs andassigns, to their proper use and behoof, forever; and the said vendor forhimself his heirs & assigns said land to said purchasers their heirs andassigns, shall and will warrant and forever defend against the lawful claims ofall persons whomsoever by these presents; the said vendor moreover, subrogatingthe said purchaser to all the rights and actions of warranty which he has or mayhave against his own vendor or the vendors of his vendor, hereby authorising thesaid purchaser to exercise the said rights and actions in the same manner as hemight or could have done.This sale is made for and in consideration of the sum of Three hundred andtwelve dollars & fifty cents $312.50/100 cash in hand paid out of the presenceof me, recorder, the receipt whereof is hereby fully acknowledged by said vendorand for which full discharge and acquittance is given.Mortgage certificate shows the property herein conveyed to be free of any liensor incumbrances.Thus done and passed at my office in the town of Springfield the day, month andyear first above written in the presence of Alexr.
