Transfer of LandEstate of T. Kennedy to George Richardson04 November 1839Be
it Known and remembered, that on this Fourth day of November in the year of
our Lord, One Thousand Eight hundred and thirty Nine and in the year of the
Independence of the United States the Sixty-fourth, Before me, Burlin
Childress, Judge of said Parish and duly authorised by law to exercise the
powers of Notary Public therein, personally came and appeared Gaston Turner
Raoul, acting Testamentary Executor of the last will & testament of the
late Thomas Kennedy, a  citizen of the Parish, who did declare and say
that, the consideration herein after expressed he does by these presents,
grant, bargain, sell, convey, transfer, assign, and set over, with a full
guarantee against all troubles, debts, mortgages, claims, evictions,
donations, alienations or other incumbrances whatsoever unto Mr. George
Richardson also a citizen of the same Parish and State here present
accepting and purchasing for himself and his heirs and assigns, and
acknowledging delivery and possession thereof the following Land - viz.:The
west half of the North East quarter of section No 17 Township No. 7 South
of Range No. 8 east containing Eighty acres and one hundred & sixty acres
being the North west quarter of Section No. Eighteen Township No. Seven
South of Range No. eight east, and the undivided their of the following
Lands - viz.:  Six hundred and forty acres lying at the mouth of Selsers
Creek on the waters of the Tangipahoa and known as the "Samuel Richardson
confirmation" and eighty acres lying on the east side of said confirmation
entered from the Government of the United States by Richardson, and two
hundred and Nineteen acres immediately on the Road leading from Samuel
Richardson to George Richardson.To have and to hold, the said property unto
the said purchaser, his heirs and assigns, to their proper use and behoof
forever; and the said vendor for the said deceased Thomas Kennedy, his
heirs and assigns, shall and will warrant of all persons, whomsoever, by
these presents, the said vendor, moreover, subrogating the said purchaser
to all the right and actions of warranty which ... did has or may have
against his own vendor, or the vendors of his vendor, hereby authorizing
the said purchaser to exercise the said rights land action in the manner he
might or could have done.  This sale is made for and in consideration of
the sum of Sixteen hundred thirty-three dollars 33/100, which sum is to be
paid in the following manner viz:  One hundred & thirty three 33/100
dollars in six months, six hundred dollars in twelve months, and six
hundred dollars in twenty four months, in Notes of the purchaser from
August 1839, Satisfactory endorsed to draw ten per cent interest after
maturity till paid.All of which have been recieved [sic] before the signing
of this instrument.  This sale is made in Virtue of an adjudication made at
Public Auction in Virtue of an order from the Hon. Court of Probates of
this Parish after the requisite advertisement of thirty days by the Hon.
Burlin Childress, Judge of said Parish and ex officio auctioneer, in and
for the same, all of which will fully appear by reference to the account
sale of Land on file in this Court of Probate of the aforesaid Parish, all
the above named and described property being Mortgaged & Hypothicated
Specially for the payment of the aforesaid sum of Sixteen hundred and
thirty three 33/100 Dollars, as the second payments become due & the said
Notes duly parapher Nevariature by me, Notary, to be indentify the date in
the this Instrument.  It appears by the certificate of the recorder of
Mortgages that there is no Lien or Mortgage of Record on the Property
herein conveyed in the Mortgage office of said Parish.Thus done and passed
at my office in the town of Springfield, the day, month and year first
above written, in the presence of James H. Harry and Abraham Caldwell,
witnesses of lawful age, and domiciliated in this Parish, who have hereunto
signed their names together with said appearers, and me said Judge.George
