All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** AGREEMENT BETWEEN THE HEIRS OF HENRY SHERIDAN Be it remembered that on this 6th day of November in the year of our Lord one Thousand Eight hundred and twenty seven, Mary Earles widdow and legitimate daughter of Henry Sheridan deceased, Rebecca Sheridan wife of John Lum and John Lum, Elizabeth Sheridan wife of Latteny Parrot and Latteny Parrot, Hanah Sheridan wife of Daniel McClain and Daniel McClain, Sarah Sheridan wife of William Carrel and William Carrel, and John Sheridan ,all legal heirs and representatives of Henry Sheridan deceased, desirous to come to an amicable settlement and partition of the Estate of said deceased, do agree as follows to wit, that the Estate of said Henry, after paying the legal fees for the administration of the same (except the fees of P. A. Rost administrator) amounts to the sum of twenty eight hundred and forty five dollars and seventy five cents which being equably divided between the aforesaid six heirs gives to each the sum of four hundred and seventy four dollars and twenty nine cents, that the undersigned bought at the probate sale of the said Henry to the respective amounts following to wit, that is the said Mary Earles to the amount of three hundred and forty three dollars and thirty five cents which leaves a balance in her favor against said Estate of one hundred and thirty dollars and ninety four cents, that the said Rebecca Lum bought to the amount of three hundred and forty seven dollars and fifteen cents leaving her creditor of said succession to the amount of one hundred and twenty seven dollars and fourteen cents that the said Sarah Carrol and her husband Wm Carrel purchased to the amount of four hundred and thirty five dollars and twenty five cents which leaves a balance against said estate in her favor of thirty eight dollars and ninety four cents, that Elizabeth Parrot purchased to the amount of twenty six dollars, which leaves a balance in her favor of four hundred and forty eight dollars and twenty nine cents and that by act passed? on the day of ____ 1827 the said Elizabeth transferred to John Sheridan the sum of two hundred and fifty dollars being a part of her portion as heir of said Henry, which being deducted from the balance aforesaid leave the sum of one hundred and ninety eight dollars and twenty nine cents in favor of said Elizabeth - that the sum of four hundred and fifty dollars being the price of a mulatress? which had been delivered to Hannah McClain before the death of the decedent and which has been collected, leaves in favor of said Hannah the sum of twenty four dollars and twenty nine cents, that said John Sheridan purchased at said sale and became bound for others to the amount of seven hundred and twenty nine dollars and fifty cents for which a judgment was obtained in the name of P. A. Rost administrator, at the last term of the district court in and for the parish, from which after deducting the portion of said John as heir and the amount transferred by said Parrot, leaves him debtor of the estate to the amount of five dollars and twenty one cents. It is agreed between the parties aforesaid that the notes and other claims now in possession of P. A. Rost in favor of said succession are to be paid over to those heirs aforesaid who are creditors of said Estate as appears by this agreement. It is further agreed between the parties aforesaid that if the costs and expenses attending the collection of these debts now outstanding reduces the amount so as that it will not pay the whole amount that may be due the heirs who are creditors, that those who have received the amount of their portion shall contribute in equal portions. The sum of seventy two dollars and fifty cents which is due to John Sheridan, John Lum and others for collecting the stock and preparing the property for sale has been taken into consideration in this partition except so far as to deduct it from the general amount and is therefore to be paid by contribution in case they should not be otherwise paid. It is further agreed that the notes in favor of the Estate shall be delivered to those heirs who are creditors of said Estate. None of the heirs shall demand of any of them any portion of the four hundred and seventy four dollars and twenty nine cents unless the debts now outstanding should be insufficient to pay their portion. Carr, Parish Judge of the parish of Natchitoches and Notary Public in office, personally appeared Richard Cherrington of said parish who being duly sworn the truth to declare, declared and saith? that he was personally present when the foregoing act was signed and acknowledged by those of the parties hereto who wrote their names, and that he heard John Sheridan, Rebecca Lum, and Elizabeth Parrot acknowledge that they had thereunto set their ordinary mark of a cross and that deponent and James Parrot in witness thereof did thereunto set their hands - (signed) R.
