The Petition of Bernadina Haus, the widow of William Hartmann, Elizabeth Hartmann, the wife of Joseph Fritz, and of her said husband, herein duly authorizing and assisting her herein, Frances Hartmann, the wife of Frank Hankens, herein represented by Henry Hecker, acting by virtue of the powers to him granted in a power of attorney, executed before Ernest Commiagere, notary public, on the 9th of March 1897. as will appear by a duly certified copy of said power of attorney, hereto annexed and made part hereof, Jacob Hartmann, Anthony Hartmann, Wilhelmina Hartmann, widow of William A. Stites, Miss Catherine Hartmann, John Hartmann, and Joseph Hartmann, all of lawful age of majority and of this Parish, With respect represents - That William Hartmann of this Parish, departed this life, in this city, intestate, on the 20th of March 1895, having an estate in this Parish, consisting of the interest in the community, which existed between him, and his wife, your petitioner, Bernadina Haus. That he left as his sole and only heirs, your petitioners, Elizabeth Hartmann, the wife of Joseph Fritz, Frances Hartmann, the wife of Frank Hankens, Jacob Hartmann, Anthony Hartmann, Wilhelmina Hartmann, the widow of Wm. A. Stites; Miss Catherine Hartmann, John Hartmann and Joseph Hartmann, who are the sole issue of the marriage of the decedent and your petitioner, Bernadina Haus, as the whole will more fully appear by affidavits hereto annexed and made part hereof. That there are no debts and an administration is unnecessary; - that the succession is accepted unconditionally and without the benefit of an inventory - That your petitioner Bernadina Haus, the widow of said Wm. Hartmann, desires to be recognized, as widow in community of said decedent, and as such to be recognized as owner of one half of the community, which existed between them, and usefructuary of the other half, inherited by the children and heirs of her said deceased husband. That your petitioners, Elizabeth Hartmann, wife of Joseph Fritz, Frances Hartmann, wife of Frank Hankens, Jacob Hartmann, Anthony Hartmann, Wilhelmina Hartmann, widow of Wm. A. Stites, Miss Catherine Hartmann, John Hartmann and Joseph Hartmann, desire to be recognized as the sole and only heirs of their said father, William Hartmann, and as such to be recognized as owners of and be put in possession of his estate, subject however to the usefruct of their said mother. Wherefore the premises and annexed, affidavits considered, your petitioners pray, that Bernadina Haus, the widow of William Hartmann, be recognized as widow in community of said William Hartmann, and as such, that she be recognized as owner of one half of the community property heretofore existing between them, and, usufructuary of the other half, inherited by the children and heirs of her said deceased husband, and more especially of the following described property to wit: 1st Four lots of ground situate in the Seventh district of New Orleans in square 129 bounded by Oak, Hillary Adam and Zimple streets, designated by the Nos. Sixteen, Seventeen, Twentieth one and Twenty two. - Lots Sixteen and Seventeen measuring sixty feet on Oak Street by one hundred twenty feet in depth. Lots nos. Twenty-one and Twenty-two measuring sixty feet front on Hillary street y one hundred and thirty-seven feet six inches in depth - Acquired by William Hartmann by purchase at a tax sale made by J. D. Houston, state tax collector on the 28th of May 1887 for tax of 1886 assessed in the name of J. H. Schumaker, as the whole appears by the process verbal of said tax collector dated June 3/86, registered in conveyance office in Book 127 Folio 492. 2nd Four lots of ground in the same square No. 129, bounded by Oak, Adam, Zimple & Hillary streets, designated by the nos. One, Two, Three, & Four. Lot One measurer thirty-two feet six inches front on Zimple street by one hundred and twenty feet deep and front on Hillary street. Lots Two, Three and Four measure, each, thirty feet front on Zimple street by one hundred and twenty-feet deep. - Acquired by Wm. Hartmann at a sale made by Guy Dreux, sheriff, on the 27th February 1858, in the matter of the succession of Margaret Metta, wife of Jacob Godstine, as will appear by the process verbal of sale, dated February 27th 1858, duly registered Book Conveyance Office ___ Folio. And 3rd Seven lots of ground, situate in the Seventh district of New Orleans, on square 104, bounded by Burthe, Elm, Adams and Burdette streets, designated as lots 17 to 23, both inclusive. Lots Seventeen, Eighteen, Nineteen, Twenty, Twenty-one and Twenty-two, measuring each thirty feet front on Adams street by one hundred and twenty feet deep. Lot Twenty-three measures thirty feet on Burthe street by one hundred and fifty feet deep. - Acquired by Wm. Hartmann, by partition made with Geo. F. Bowers, on the 3rd of April 1866, per act passed before A. Commandeur, notary public. That Elizabeth Hartmann, the wife of Joseph Fritz, Frances Hartmann, the wife of Frank Hankens, Jacob Hartmann, Anthony Hartmann, Wilhelmina Hartmann, the widow of William A. Stites, Miss Catherine Hartmann, John Hartmann and Joseph Hartmann, be recognized as the sole and only heirs of their deceased father, William Hartmann, and as such, that they be recognized as owners of and be put in possession of his estate, and more especially of the undivided one half of herein above described property, subject, however, to the usefruct of their said mother. STATE OF LOUISIANA - Parish of Orleans: Before the undersigned authority personally came and appeared John Meyers and John Dunn, Jr. who, each, being duly sworn depose, and say that they were well and intimately acquainted with William Hartmann, that he died on the 20th of March 1895, that he left as his sole and only heirs, Elizabeth Hartmann, the wife of Joseph Fritz, Frances Hartmann, the wife of Frank Hankens, Jacob Hartmann, Anthony Hartmann, Wilhelmina Hartmann, the widow of William A. Stites, Miss Catherine Hartmann, John Hartmann and Joseph Hartmann, who are the sole issue of his marriage with Bernadina Haus, that all of said heirs are of lawful age of majority.
