Lea Judge I am subject to accidents of life in common with other men and being far away from my relations and no particular friend in which I feel sufficient confidence or have had sufficient intimacy to ask to act as my Executor in case of my death, I now merely name Mr. Michael Graves (attorney at law, in the City of New Orleans) whom I should wish might be called on in case any Law business should be necessary in the Settlement of my small affairs for the benefit of my children to whom I shall leave but a Small allowance. It is proper for me here to say and it was the uneasiness and pain which their helpless situation induced to here record, that although some irregularity in the marriage with their mother existed all these irregularities were cured by an act passed before L.R. Kinney / Notary Public) in the city of Lafayette dated 12th February 1848 in accordance of a Special law of the State of Louisiana Copy of Said act duly recorded will be found in one of the Banks Books, and put into the Iron chest now in my house The key of my writing draw, all of which will clearly Show that nothing of ignominy or disgrace can attach in the Smallest degree to them, they are of the name respectable connections and assure the affection of my relations, although they have been much neglected in their education for the past five or six years, because I have not means to defray expenses Should I be cut off suddenly by death, I Should wish my children Should call on Samuel W. Oakey Esq. of New Orleans who I have no doubt from a very long acquaintance would tender them any Kindness in his power, although I have never mentioned a word to him on the Subject, but as he is Known to be a Gentleman of Kindness and humanity would I have no doubt be happy to render assistance or services to helpless orphans so amiable and deserving as mine. The above was written some months Since when I had reason to fear a sudden termination of my life. They are an expression of my wishes now and I wish them to be considered such until I write to the contrary Lafayette 6th June 1851 Signed D.T. Oakey of this City my Executor in case of my sudden death or any thing preventing his serving Joseph O. Peerson also of this City, as it will be necessary for some one to immediately act to draw the little money that I have in Bank for the expenses of my children Signed D.T. Walden New Orleans (4th District) Sunday 7th November 1852 Should anything happen suddenly depriving me of life I wish to confirm what is written on the opposite page as to calling Mr. S.W. Oakey should he appear unwilling to act for you as I have requested send at once for Mr. Joseph O. Pierson who I always had the best opinion of although we had a little misunderstanding Some time ago & I have not spoken to him since. I am sure however he is too much of a Gentleman to allow the small affair to prevent his doing any thing and every thing for my friendless children until they become of age or so situated as to be able to take care of themselves. They are all virtuous and Intelligible and well educated for their ages, The two youngest Boys Treadwell and Lawd I have been preparing to Send at College, my means will not allow this if I am deprived of life. my eldest Boy Lionel was a very unmanageable child for some two or three years back, but thank God he is changing much for the better My children thank goodness you are all getting old enough to know how to keep yourselves out of harms way with Kind advise - your Father D. Lea Judge Proof of Will Be it remembered that on this 20th day of May in the year of our Lord One Thousand Eight Hundred and Fifty Four and the 78th of the Independence of the United States of America Upon the application of J.O. Pierson and pursuant to my decree bearing even date herewith. Before me James N. Lea, Judge of the Second District Court of New Orleans, personally came and appeared M.M. Christian Roselind Maurice Grivot witnesses, who being duly sworn, were by me presented with a Document, and bearing the following Subscription, to wit. "June 1851 - To my Children - Mr. J.O. Pierson to be sent for in case of accident - N.O. Nov 1852. did declare and say that the said Superscription is in the proper handwriting of the late Daniel T. Walden...." (etc.)
