Case set for Monday April 17th 1882 # 916 – State of Louisiana vs. Marion Perkins – Murder Accused was brought into Open Court, arraigned, plead Not Guilty and asked for trial by Jury. Case set for Friday Aapril 21st 1882 # 905 – State vs. Andrew Allen – Nolle Prosseque entered and accused discharged # 879 – State vs Rachel Bradley – Continued on application of defense (Page 215) State of Louisiana Parish of Rapides Alexandria Friday April 21st 1882 The District Court met pursuant to adjournment. His Honor Judge Barbin presiding – Minutes of the previous day were read and approved. # 2686 – Robert H. Jackson vs. Geo. H. Sallis Answer filed and case scheduled for to day. # 2707 – I. M. Lyle & Co. vs Milton Tanner Judgment deferred in favor of Plaintiff for the sum of Two Thousand and Thirty Five & 62/100 dollars with 8% per annm interest from April 13th 1882. One third of said amount to be paid on the 1st day of January 1883 and the balance on the 1st January 1884. See Decree # 2691 – Milton Tanner vs. W. P. Marsh Judgment in favor of Plaintiff annulling the Judgment and it is ordered that the case of W. P. Marsh vs. Milton Tanner is reinstated on the Docket in the position that it was when the Judgment was rendered. # 2625 – Hassell M. Prothro vs. Chas. N. Edwards et al Set for Thursday April 27th # 876 – State of Louisiana vs Ralph Smith Accused having been convicted of the crime of Assault with a dangerous weapon, was brought before the Court and asked if he had anything to say why the sentence of the Court should not be pronounced upon him. After hearing him the Court proceeded to pass sentence in the words and figures as follows to wit – I do now sentence you Ralph Smith to be confined in the Parish Jail for the period of forty five days – to be reconed from the day of your conviction and to pay a fine of Forty Dollars and all costs of this prosecution and in default of payment of said fine & costs I sentence you to forty five days additional imprisonment in the Parish Jail. The Accused was remanded to Jail and the Sheriff ordered to see this sentence carried into effect. # 918 – State of Louisiana vs J. S. Musgrove and Jesse Davis – Murder This case was called for trial pursuant to assignment. Accused J. S. Musgrove and Jessie Davis being present in open Court. Trial was entered into. The following Jury was impaneled and sworn viz. C. W. Boyce, C. H. Burnaman, John Jackson. The regular panel of Jury being there exhausted, the following Jurors were selected from the regular panel of Talismen Jurors specially ordered and drawn to serve at this the 3rd week of this term of the Court, viz., Frank Harris, Walter M. Clarke, Carter Booze, H. T. Applewhite, H. Bellay, E. A. DeLoach, T. J. Mustian, Phillip O’neal. The panel of Talis Jurors being then exhausted the Court ordered the Sheriff was ordered to summon Five Talisman and from these five the Jury was completed by selecting Dr. A. Rachal. Both accused being still present in Open Court the trial was proceeded with a late hour where the Jury was placed in charge of the Sheriff, and the case laid over until Saturday April 22nd. Both accused being present in Open Court during all these proceeding. The Court then adjourned until Saturday April 22nd at 8:30 a.m. Attest, C. L. Rausdell, Dy. Clerk (page 216) State of Louisiana Parish of Rapides Alexandria Saturday April 22nd 1882 The District Court met pursuant to adjournment. His Honor Judge Barbier presiding. Minutes of the previous day were read and approved. # 918 – State of Louisiana vs. J. S. Musgrove and Jessie Davis – Murder This case coming over from the day previous and both accused being still present in Open Court. Case was taken up and trial proceeded with. After hearing the testimony the arguments of counsel and the charge of the Judge, the case was referred to the Jury. When they came into Court, and both accused being still present in Open Court rendered the following verdict. We the Jury find the prisoners Not Guilty. /s/ H. T. Clerk State of Louisiana Parish of Rapides Alexandria Monday April 24th 1882 The District Court met pursuant to adjournment. His Honor Judge Barbin presiding. Minutes of the previous day were read and approved. On Motion of James G. White, Esqr. Atty., in open Court it was ordered that No Smoking be allowed upstairs in the Court House either in or outside of the Court Room. That this order be adopted and a rule of the Court and that any party caught violating this rule on order be fined in the sum of Ten Dollars. (page 217) # 924 – State vs Aaron Harris – Larceny Bond of accused fixed at the sum of $100.00 & case continued. U. H. Johns vs Stanley Tanner Rule set for Wednesday 26th April # 2695 – Easter Murphy vs. E. J. Barrett Answer viled. # 916 – State vs Marion Perkins – Murder This case having been assigned for to day was called for trial. Accused being present in open Court trial was entered into. The following Jury was impaneled and sworn viz – A. W. Pollitt, J. M. Nassibs, Nasha Pembroke, W. C. Burke, M. R. Tuck, J. M. Cruise, David Rush, A. T. Compton, George Brooks. The regular panel of Jury being then exhausted the Jury was completed from the panel of Talis Jurors specially ordered and drawn to serve at this the Fourth Week of this Term of the Court viz. – R. C. Clarke, A. J. Rush, R. G. Maddox. Accused being still present in open Court, trial was proceeded with. After hearing the testimony the arguments of counsel and the charge of the Judge, the case was referred to the Jury. When they came into Court and through their Foreman presented the following Verdict – Not Guilty as charged in the Indictment. /s/ J. M. Nassibs, Foreman. Minutes of the previous day were read and approved. # 2693 – Samuel Freidlander vs. Mrs. E. Schumalinski & Husb. Answer filed. # 2706 – R. G. Dier & Co. vs. W. C. McGrinsey Default # 919 – State of Louisiana vs Louis Lacasse & John Watson – Murder In this case – Leave of the Court being first had, the District Atty. in Open Court entered a Nolle prosseque and the accused were ordered to be released. # 920 – State of Louisiana vs. John Watson In this Leave of the Court being first had, the District Atty. in Open Court entered a Nolle prossque and the accused was order to be released. (Page 218) # 932 – State of Louisiana vs Louis Lacasse & John Watson – Assault with dangerous weapons and shooting with intent to kill & murder In this case the District Atty. in open court - Leave of the Court being first had entered a Nolle prossegue. Accused were ordered to be released. # 931 – State vs. Mat Dyal – Asslt D.W. Intent to Kill In this case the Leave of the Court, being first had the District Atty in open Court entered a Nolle Prosseque. Accused was ordered released & his bond cancelled. # 923 – State vs. Hiram Maricle et als – Malicious Mischief In this case – Leave of the Court being first had the District Atty in Open Court entered a Nolle prosseque. Accused were released and their bond cancelled. # 914 – State of Louisiana vs Albert A. Davide – Murder This case was called for trial pursuant to assignments. The accused being present in open Court – Motion and affidavit for continuance filed by Defense, sustained and case continued. # 725 – State of Louisiana vs Robert West – Horse Stealing This case being assigned for to day and accused being present in Open Court. H. L. Daigle Atty at Law was appointed by the Court to defend the accused. Trial was entered into. The following Jury was impaneled and sworn. Mr. R. Tuck, John Strother, W. C. Burke, J. M. Cuise, A. W. Pollett, E. M. Ball, David Rush, Levi Stewart, Frederick Thick, William Graham, Chas. Goldenburg, Oliver Bassett. After hearing the testimony the argument of counsel and the charge of the Judge the case was referred to the Jury. When they came into Court, and accused being still present in Open Court, presented the following verdict. We the Jury find the prisoner guilty as charged in the Indictment and recommend him to the Mercy of the Court. /s/ E. M.
