H. ELLIOTT, DECEASED BE IT KNOWN: That before me, Hy. W. BETHARD JR., a notary public in and for said parish and state, duly commissioned, sworn and qualified personally came and appeared: MRS. SARAH EMMA ELLIOTT, the wife and widow of W. H. ELLIOTT, deceased; PUGH P. ELLIOTT, a married man whose wife's name if MRS. BESSIE ELLIOTT, nee WOODARD; W.H. ELLIOTT, JR., a married man whose wife's name is MRS. MATTIE LOU ELLIOTT, nee Conly; EDNA ELLIOTT SCOTT, a married woman whose husband's name is C. S. SCOTT SUSIE MAY ELLIOTT McDONALD, a married woman whose husband's name is H. T. McDONALD L. P. ELLIOTT, a married man whose wife's name is MRS. NELL ELLIOTT, nee WOODARD and J. M. T. ELLIOTT, a married man whose wife's name is MRS. MADGELINE ELLIOTT, nee SMITH; all of whom are residents of Red River Parish, Louisiana, and over and above the age of twenty-one years complete, who together and severally declared unto me, said authority, in the presence of the undersigned competent witness as follows, to wit: That MRS. SARAH EMMA ELLIOTT is the widow of, and that the other appears are children of W. H. ELLIOTT, issue of his marriage with MRS. SARAH EMMA ELLIOTT; and constitute and are the widow and sole heirs and legal representatives of said W. H. ELLIOTT, deceased, they are the owners in the proportion of one- half to MRS. SARAH EMMA ELLIOTT and 61/2 each to remaining appearers, in the following described property, situated in Red River Parish, Louisiana, to wit: A certain house and lot in the town of Coushatta, Parish of Red River, State of Louisiana, known as the L. B. WATKINS residence, and further known as the residence of MARK LISSO, bounded on the south of main street, west by Abney Street, north by Paxton street and east by lot of BEN WOLFSON; said property being known as the "Drummer's" Hotel, and lot, also the old jail lot on Court and Clark Streets, as per act of sale and process verbal in the matter of L. B. WATKINS, deceased, dated April 12, 1902, recored in Book "J" page 778 of the official Conveyance records of Red River Parish, Louisiana; and Another certain lot of ground, in the Town of Coushatta, Louisiana, adjoining the afore-described property on the east and being the same lot on which the office of the Red River Abstact Company is now situated, or in other words the building formerly used by the abstract company, and being the same property acquired by the said W.H. ELLIOTT, by deed duly of record in Conveyance Book 40 page 269 of the official conveyance records of Red River Parish, Louisiana; Also a certain lot of ground, situated in the Town of Coushatta, Louisiana, in the rear of the afore-described property, and being the same property purchased by T. W. LETTLES at tax sale of property belonging to the Estate of E. H. CARTER, deceased, as per tax deed duly of recor in Conveyance Book ____ page _____ of the official records of Red River Parish, Louisiana, and be said W. H. ELLIOTT, deceased from said LETTLES. SOUTH HALF (S1/2) of Southeast quarter (SE1/4) and the Southeast quarter (SE1/4) of Southwest quarter (SW1/4) of Section Six (6); and the North half (N1/2) of North half (N1/2) of the section and the East half (E1/2) of Southeast quarter (SE1/4) of the northwest Quarter (NW1/4) of Section Seven (7); all of said property being situated in township thirteen (13) north of range eight (8) west, in Red River parish, La., with all buildings and improvements thereon; also NORTH half (N1/2) of Southwest quarter (SW1/4) of Section twenty (20), township thirteen (13) north of range (9) west, in Red River Parish, La.; Also Ten share of the Capital Stock of the People's State Bank, a banking corporation of Coushatta, Louisiana, of a par value of $100.00 each; also Three and three-fifths shares of the capital stock of the Bank of Coushatta, a banking corporation of Coushatta, La., of a par value of $100 each; One share of the capital stock of EDW. LISSO & COMPANY, Inc., a mercantile corporation of Coushatta, La., on a par value of $100; One share of the capital Stock of the Island Realty, company sometimes known as the Fish and Fin Club of a par value of $100; A small sum of cash now on deposition in the People's State Bank, Coushatta Louisiana. And now said appearers declared that they are desirous of settlement of said estate and partitioning said property among themselves, for the reason that they no longer wish to hold said property in indivision, and have agreed upon the following partition of said property, to wit: The said PUGH P. ELLIOTT is to take and receive, in fee simple, the SE1/4 of SE1/4 of Section 6, Twp. 13 N. R. 8 West, containing forty acres, more or less, with all the building and improvements thereon; The said L. P. ELLIOTT is to take and receive, in fee simple, the SW1/4 of SE1/4 of Section 6, Twp. 13 N. R. 8 West containing fourty acres, more or less, with all buildings and improvements thereon. The said W. H. ELLIOTT, JR., is to take and receive, in fee simple, the NW1/4 of NE1/4 of Section 7, TWP. 13 N. R. 8 West, and that small tract immediately of said forty and north of a branch running east and west; with all buildings and improvements thereon; The said J. M. T. ELLIOTT is to take and receive, in fee simple, the SE1/4 of SW1/4 of Section 6, Twp. 13 N. R. 8 West, containing forty achres,j more or less with all buildings and improvements thereon. The said MRS. EDNA ELLIOTT SCOTT is to take and receive in fee simple, the NE1/4 of NW1/4 of Section 7, Twp. 13 N. R. 8 West, containing forty acres, more or less, with all buildings and improvements thereon. The said SUSIE MAE ELLIOTT McDONALD is to take and receive, in fee simple, the NE 1/4 OF NW 1/4 OF Section 7, Twp. 13 N. R. 8 West, containing 40 acres, more or less, with all buildings and improvements, thereon; The said MRS. SARAH EMMA ELLIOTT is to take and receive, in fee simple, the following property; A certain house and lot in the Town of Coushatta, Parish of Red River, State of Louisiana, known as the L. B. WATKINS residence, and further known as the residence of MARK LISSO, bounded on the South by main street, west by Abney steet, North by Paxton Street and east by lot of BEN WOLFSON; said property being known as the "Drummers" Hotel; also the old jail lot on Court and Clark Steets, as per act of sale and proces verbal recorded in Book "J" page 778 of the official conveyance records of Red River Parish, La. Another certain lot of ground in the Town of Coushatta, La., adjoining the afore-described property on the east and being the lot on which the building formerly used by the Red River Abstract company as an office now stand, and being the same property purchased from BEN WOLFSON as per deed duly of record in Conveyance Book No. ___ page ___ of the official records of Red River Parish, La; Also, a certain lot of ground situated in the Town of Coushatta, La, in the rear of the aforesaid property and being property purchas by T. W. LETTLES as per tax deed duly of Record in Conveyance Book ____ on page ___ of the official records of Red River; and by said W. H. ELLIOTT , deceased, from said LETTLES. And now to properly perfect title to the foregooing lots as described as being foregoingly allotted to the several appearers, the said appearers do now, severally and together, transfer, set over, exchange, sell, partition and deliver, with full warranty of title and with complete subrogation of all reights and actions of warrant against all former owners and vendors of the property or properties herein conveyed unto the foregoingly named appearers, individually as allottments were foregoingly made herein; It bering the intention of all and each of said parties to fully vest title to each of said appearers in the property foregoing described as taken and received by each of them, and to relinquish and transfer the ownership, as the widow and heirs of the said W. H. Elliott, deceased, to each of said appearers according to the allottments foregoingly made herein. And now each of said parties declared that they have received title, in fee simple, to the property foregoingly set apart and allotted to them, and that they have relinquished all title or interest that they had in the other allottments to their co-appearers; and declared that they are fully satisfied with this partition, having received, in vlaue their proportionate part of the succession of the said W. H. ELLIOTT, deceased. Said appearers further declared that they take the property or properties foregoingly allotted to them encumbered as they or any of them now stand and bind and obligate themselves to discharge such encumbrance and indebtedness, and release their mother and co-heirs from all indebtedness due on the respective portions received by each. The said heirs further bind and obligate themselves to make a formal transfer of the stock herein transferred to their mother by due endorsements and assignments of the certificates representing said stock in the different corporations. To have and to hold said properties unto each grantee, his or her heirs and assigns forever. The certificate of mortgages is waived by the parties hereto and me, notary, relieved of all liabillity on account of the non-production thereof; and each grantee binds his or herself to pay all taxes due on the respective property or properties received. Thus done and signed at my office in the Town of Coushatta, in the presence of the undersigned witnesses after a due and thorough reading of the whole act. Witnesses: (Indistinct) MRS.
