The above and foregoing application having been duly considered and Bethel Spurlock having been appointed special tutor and having presented an answer to said application, giving his assent to the Emancipation of said Minor, said answer containing the specific declaration, "That said Minor is fully capable of managing his own affairs." and having heard all parties and the law and the evidence, being in favor of said Minor. It is therefore ordered that said Minor be, and he is hereby fully emancipated and relieved of all the disabilities which attach to minors, and he is hereby granted full power to do and perform all acts, as fully as if he had arrived at the age of twenty one years. FLEMING ) STATE OF LOUISIANA, ) PARISH OF CARROLL NO. 5385 VS. ) ) Thirteenth District Court FRED BENNICK ) Be it Known, That by virtue of a writ of Fura Facias issued from said Court in the above styled case and to me directed, commanding me to seize and sell the following described property belonging to the defendant, Fred Bennick to wit: The South West Quarter of Section Seven, T 18, Range 10 East situated in said Parish and State containing 160 acres more or less. I, William W. Collins Sheriff, in and for the Parish of Carroll, State of Louisiana, duly commissioned and sworn, did, on the 21st day of November A. D. 1867, seize the above described property, notice of which seizure I gave Fred Bennick defendant in writing, and on the 28th day of December A. D. 1867 I advertised said property, in the Carroll Record, a newspaper published weekly in said Parish and State to be sold at the door of the Court House, in the town of Floyd, in said parish and State, on the first Saturday, the first day of February A. D. 1868 for cash with the benefit of appraisement. And on said day of sale at the place aforesaid, after reading the advertisement of sale and the Recorder's Certificate of Mortgage, I offered the same for sale in an audible voice, whereupon Mrs. Mary Manns, wife of Christian Pabst and by him duly authorized and assisted became the purchaser thereof, for the price and sum of Three hundred and twenty dollars, the receipt whereof is hereby acknowledged. Now in consideration of the premises and by virtue of the authority, in me vested by the law of the State of Louisiana, I do hereby sell and adjudicate unto the said purchaser all the right, title, interest and claim which the said Fred Bennick has or had in and to said property. To have and to hold the same unto the said purchaser, his heirs and assigns, for his own proper use, benefit and behoof forever. In testimony whereof, I hereunto sign my name officially together with James W. Draughon and Albert G. Papst, a resident of the Parish of West Carroll, State of Louisiana Petitioneer represents that Chris. Papst late of the Parish of Richland Louisiana died in your said Parish in the year 1870 having in said Parish at his decease a considerable Est of Real and Personal property. That Jas W. Flemming was appointed adm. of the Succession of said C. Papst. That said Flemming died without ever having settled succession and the same is now open unsettled. That it is necessary that there should be an administrator appointed by your Honor Court to the Succession of Chris Papst, dec. in the place of Jas W. Flemming, adm. dec. That Petitioner is the oldest son and heir to the said Chris. Papst, dec'd and is entitled to be appointed by preference to the administration of his said Father's Succession, Prays that your Honor Court make our order ordering an inventory of the Succession of Chris Papst, dec that his application of Petitioner be advertised according to law and that Petitioner be appointed administrator of the Succession of Chris.
