The Petition of James Huey 3rd, a resident of the Parish of Ouachita in the State of Louisiana with respect represents unto your Honor that his mother Mary Alexander, late of your said Parish and State departed this life in your said Parish at her residence on the 17th day of April 1841 intestate leaving a considerable Estate of Property Real and Personal, Rights and Credits, Slaves &c in the following persons interested therein to wit: your petitioner, John F. Huey; Sarah Huey the Widow Milling residents of the Parish of Ouachita, La.; Clementina W. Richardson, resident of the Parish of Union; and Mary Huey, James Huey 5th and Clementine Huey minor representatives of William M. Huey, Decd. residents of your said parish wherefore he prays your Honor to cause an Inventory and appraisement of said descendents property to be made and that he be appointed Administrator of said Estate and for such other and further decrees in the premises as may comport with Law and Equity and for legal relief &c. Huey; Sarah Huey, Widow Milling residents of the parish of Ouachita, La.; Clementina W. Richardson and Mary Huey, James Huey 5th, Clementine Huey, minor representatives of William Huey Decd. residents of the Parish of Union, La. Besides leaving a considerable Estate of Property real and personal, rights and credits, goods & chattels, lands and tenements, and for the purpose of making an Inventory and Appraisement of said decedent’s Estate. Farmer, his security of the State of Louisiana, are held and firmly bound unto John Taylor, Judge of the Court of Probates, in and for the Parish of Union, or to his successors in office, in the sum of three thousand four hundred dollars; current money of the United States of America, which we promise to pay to him or his successors in office for the faithful performance of which we bind ourselves and each of us, one and each our heirs, Executors and Administrators jointly and severally firmly by these presents [unreadable] all benefit or division or discussion whatsoever. Sealed with our seals this nineteenth day of May in the year of our Lord one thousand eight hundred and forty one. The condition of the above obligation is such that if the above bounden James Huey 3rd, Administrator of the Estate of the late Mary Alexander, deceased, does well and truly, according to law administer the same and further does make and render a true, just and perfect account of his actions and doings, when thereunto lawfully required either by the aforesaid Judge or his successors in office agreeably to law, or by the heirs of the said deceased, or their lawful attorney or attorneys, or by the duly appointed and authorized executor or executors of the last will and testament of the said deceased, should it hereafter appear that any such will or testament was by the said deceased made, then this obligation to be void, or else to remain in full force and virtue. Now, therefore, he is hereby authorized and fully empowered to discharge and perform all and singular the duties appertaining to the said appointment according to law. Huey, Sarah Huey the widow Milling residents of the Parish of Ouachita and Clementina W. Richardson resident of the Parish of Union in said State with respect represents unto your Honor that their mother Mary Alexander departed this life in your said Parish (and state) on the 17th day of April 1841 leaving a considerable Estate which has been duly Inventoried and Appraised by your Honor. That she left your Petitioners, children and lawful descendants and Mary Huey, James Huey 5th, and Clementine Huey minor children of William M. Huey, Decd. a son of said descendent. Said minors represented by their mother and Natural Tutrix Barbara Huey, resident of your said parish, heirs of said Estate. They are desirous that a partition of said descendents Estate should be made. That the property is of such a nature that the partition of said Estate can not be made in kind. Wherefore your Petitioners pray your Honor to cause a partition to be made of said Estate. That your Honor cause said property to be sold on such terms as may be most advantageous to the Heirs in order to effect said Partition. That Barbara Huey, the mother and Natural Tutrix of the minors Mary Huey, James Huey 5th, Clementine Huey be cited to appear for the interest of said minors and that Experts to partition the proceeds of said Estate after sale among the Heirs in the proportions as entitled by law and for such other and further decrees as may be necessary and for general relief. Richardson By reason of the law and the evidence and the Court being satisfied that a partition of the Estate cannot be made in kind it is ordered, adjudged and decreed that a sale of the property be made for cash. That the Heirs of said Estate partake equally and that W. W. Farmer and Joel Mixon be appointed experts to partition the proceeds of said Estate. May 19th day 1841. Also being advertised in the Monroe Olive Branch from the 19th May 1841 until 26th June 1841 all the real and personal property of said descendents Estate. Conditions of sale, cash. Huey 240.00 The NW ¼ of the NW ¼ of Sec. 8, Range 1 E Township 18 __280.00 $526.00 June 26th 1841 Agreeably to an order of the Probate Court, I John Taylor, Judge of the same and Ex Officio Notary Public proceeded the sale of the Estate real and personal of Mary Alexander, Decd. for cash whereof the amount as annexed to deed of cash sale was sold pursuant to notice. Now be it remembered that as there was Sundry articles that after being offered for cash could not find a bidder, it was agreed on by and between the heirs all being present that John F. Huey should take charge of the unsold articles at their appraised value, to which the said Jno. F. Huey being present consents and also binds himself to the heirs of said Estate for the same, viz. 1 set flax, $2, 1 lot table clothes $9, 1 lot counterpanes $3 14.00 1 lot towels, $1.50, 1 lot counterpanes $18 19.50 1 lot pillow cases $12, 1 lot under sheets $12 24.00 1 lot bed clothing $18, 1 lot largest pot ware $15 33.00 1 lot coopers ware, $5, 3 spinning wheels $5 10.00 1 lot spun cotton 33 doz. 33.33 1 lot crockery ware 15.00 1 cutting knife & steel mill $4, farming tools 34.00 1 pine table $2, 1 cupboard $18 20.00 1 eight day metal clock __35.00 $237.83 It was further agreed by and between said heirs all being present that the following articles mentioned below should be sold on a credit until the first of March one thousand eight hundred and forty two. Your petitioner James Huey 3rd of the Parish of Ouachita, State of Louisiana with respect represents to your Honor that as Administrator of the Estate of Mary Alexander and one of the heirs of the same, he prays your Honor that the sale and partition of said Estate as made by experts be made final and that notice be given to the heirs that if any opposition be made that it shall be filed in writing in the office of your Honor in ten days and in default thereof Judgment final be rendered in the same. John Taylor Parish Judge June 26th 1841 In pursuance of an order and decree of the Court of Probates for appointing and swearing experts to make an equal division of the net proceeds of the funds arising from the sale of the estate of Mary Alexander, decd. I John Taylor Parish Judge and Ex Officio Notary Public have appointed W. W. Farmer and Joel Mixon according to law to partition the net proceeds of said Estate who being duly sworn proceeded to make the partition in manner and form following viz. Gross amount of sale $2761.33 Deduction of Interest on notes ____5.92 $2755.41 Judges Fees ___88.00 $2667.41 Administrators percent & privileged debts __154.39 5/$2513.02 Equal proportion of the heirs of net proceeds 502.60 We certify that having made the deduction of the privileged and ordinary debts rendered against the succession as shown in our Statement above that there remains a balance in favor of each heir of the said succession Five in number of five hundred and two dollars and sixty cents.
