Beauchamp Sale of Land [and Slaves] Parish of Avoyelles State of Louisiana Before me Roger B. Marshall Notary public for the parish of Avoyelles on Bayou Boeuf personally appeared (Patrick H. Glaze of the above written State & parish, who acknowledges to have bargained, transferred [sic], set over and delivered and does by these presents grant bargain set over and deliver to Thomas D. Beauchamp of the Parish and State above written three Negro Slaves, to wit. A woman aged about 23 years known by the name of Betsy, her two children one a boy about 2 years old and an infant not yet named, Also a certain tract or parcel of Land situated on Bayou Chicot containing for [sic] hundred & twenty acres being the same on which Daniel Ferguson resided and contracted to the said Glaze for the sum of Sixteen hundred dollars, Now whereas the said Daniel Ferguson has not made the said Glaze a title to said land the said Glaze binds and obligates himself to make the title to said land to said Beauchamp with guarantee, but should the said Daniel Ferguson not make full and complete title to said land to said Glaze then the said Glaze binds & obligates himself his heirs & assigns to pay to the said Thomas D. Beauchamp the sum of Sixteen hundred dollars. This tract of Land being the same including the premises on which the said Glaze now resides peaceable & quiet, possession of the Said land & premises to be given to the said Beauchamp on the first day of Oct[obe]r. next----In consideration of slaves Betsy & her two children the said Beauchamp has this day paid the said Glaze seven hundred dollars cash in hand the receipt whereof is hereby acknowledged--In testimony of which the parties here being present the one delivering and the other accepting the same in presence of William C. Marshall Notary Public ===================================================================== Labiche Syndic To Doyl Release of Mortgage Recorded 11 June 1836 Know all men by these presents that whereas a sale of the property surrendered to his creditors by Michel Perault made on the 27th day of April 1835 pursuant to an order of the District Judge of the Fifth Judicial district for the Parish of St. Landry and State of Louisiana John Doyle of the aforesaid State and parish, became the purchaser of a negro woman named Eliza aged about nineteen years with her child a negro girl named Charlotte about eighteen months old for the price & sum of seven hundred and ninety five dollars payable one half on the first day of June 1835 and the other half on the first day of June 1836, with a special mortgage on said slaves until final payment and whereas the said John Doyle has fully paid to me Pierre Labiche Syndic of said creditors of said Perault, the said sum of seven hundred and ninety Dollars the receipt whereof is hereby acknowledged. Now in consideration of the premises I have released cancel and annul the above recited mortgage as fully and effectually as though the same had never existed. Dupre' to Wikoff Sale of Slave Recorded 12th June 1836 Know all men by these presents that Caroline David widow Laurent Dupre' fils of the State of Louisiana and parish of St. Landry for and in consideration of the sum of twelve hundred dollars payable on half on the first day of April in the next ensuing year, 1837, and the other half on the first day of April in the year, 1838, has bargained and sold and does by this public act, grant, bargain, sell transfer and deliver unto Stephen Wikoff of the same State and Parish aforesaid a certain negro man slave named Robert aged about thirty six years. To have and to hold said slave to him the said Stephen W. Wikoff his heirs &c. forever, with guarantee of title against the lawful claims of all persons whatsoever, and the more effectually to secure the title of said slave to the purchaser Laurent Dupre' acknowledges & binds himself as security thereof. The purchaser dispenses with the production of the certificate required by the 3328th article of the Louisiana Code. In Testimony of all which the parties & the said, Laurent Dupre' have hereunto signed. The said Caroline David & L. Dupre' by making their ordinary mark not knowing how to write. In presence of Paul Dupre and [blank] competent Witnesses & before George King Parish Judge in and for the Parish of St. Landry & ex-officio Notary Public this twelfth day of June in the Year one thousand and eight hundred and thirty six. Judge ===================================================================== Hypolite Chretien To John Doyle & Robert Barry Release of Mortgage [Slaves included] Recorded 30 June 1836 Whereas by an act passed before George King Parish Judge of the Parish of St. Landry on the 18th of June 1834, John Doyle & Robert Barry acknowledged themselves indebted to Hypolite Cretien all of the said Parish, in the sum of Two thousand seven hundred dollars payable at such times and on such term as are specified in said act, and as security for the payment of said sum of money with such interest as might accrue thereon, the said Doyle and Barry mortgaged to the said Chretien the following described property towit, A tract of Land situated in the aforesaid Parish & Lying in the prairie Grand Coteau bounded on one side by land of the widow Jean Bt. Stelly and on the other side by land of the Widow Bernard Collegin on one end by land of Humbert Perrodin containing ninety superficial acres with the buildings & improvements thereon, being the same on which said Doyle & Barry then resided. Also a tract of wood land lying in the aforesaid Parish on the Bayou Bourbeur, bounded on one side by land of Mr. Charles Smith & on the other by lands ceded to citizens [very faded word] of Bellevue, on one end by the said Bayou & on the other end by the domain, containing forty superficial arpents, also the following described Slaves to wit. A negro man named Henson aged about twenty eight years. A negro Girl named Maria aged about eighteen years. A negro woman named Philis aged about thirty two Years. A negro boy named Charles aged about eleven Years. A negro Girl named Ellen aged about nine Years. A negro Girl named Clarissa aged about six Years, and Milly a negro girl aged about four Year. And whereas the said Doyle & Barry are desirous of Pledging said Landed property so described as aforesaid for Stock in the Citizens Bank of this State. Now therefore, I the said Hypolite Chretien have released & do by this act release cancel & annul the said Mortgage on said land and improvements thereon, ad fully & effectually as though said Mortgage had never existed thereon. It is hereby explicitly understood however that the said Chretien retains a mortgage on the said slaves as by said act of 15th June 1834 Mortgaged & hypothicated to him by Doyle & Barry. Smith Sale of Land & Slaves Recorded 22nd July 1836 This Deed made the twenty second day of July in the Year one thousand eight hundred and thirty six between Benoist Vanhille and Caroline Fontenot his wife of the State of Louisiana and Parish of St. Landry of the one part, and George Morris Smith of the same State and Parish aforesaid of the other part Witnesseth, that for and in consideration of the premises hereinafter expressed by the said Benoist Vanhill and Caroline Fontenot his wife have bargained and sold and do by these presents, grant, bargain sell transfer, set over , alien Confirm and deliver unto him the said George Morris Smith the following described lands and slave, towit. A tract of land situated in the aforesaid Parish and lying at the place called Prairie des Marias containing nine hundred and two & twelve hundredths superficial American acres equal to one thousand and sixty six superficial arpens more or less, the said tract is composed of a tract of land purchased by the said Vanhille from Edmund Johnson Junr. containing one hundred and fifty nine and ninety six hundredths superficial acres. A tract of land purchased by the same from Edmund Johnson Senr. containing eighty two and forty two hundredths superficial acres, a tract of Land purchased by the same from the United States containing eighty four and seventy four hundredths superficial acres a tract of Land purchased by the same from Benjamin Going containing four hundred and seventy five superficial acres, and a tract of land purchased by the same form William Gardner containing one hundred superficial acres. Also a negro man named George aged about twenty one Years, A negro man named Kondre (with swollen feet) aged about forty Years, a negro woman named Anne (lame) aged about thirty five Years with three children, towit, Paul a boy aged about seven Years, Melinde a girl aged about five Years and Eugene a boy about three Years old, a mulatto woman named Aim‚ aged about twenty one Years & child Carlos a boy two Years old. Narcisse a boy aged about seventeen years, Marcelite a girl aged about fourteen Years, Harry a man aged about thirty five years, Violatte a woman aged about thirty two years & three children, towit, Eliza a girl aged about eight Years, Lucy a girl aged about four Years, a woman named Judy aged about twenty one Years with two children, towit, Edward a boy aged about five Years & Joseph a boy about three Years old Charles a man aged twenty four Years, James Congo a man aged about fifty Years Agate' a woman aged about twenty Years with her child a boy named David about two Years old, and a mulatto man named John aged about twenty one Years, this man John is to serve as a slave until he arrives at the age of thirty five Years, when the purchaser binds himself his heirs &c to liberate him according to the due forms of law. To have and to hold the aforesaid tract of land with all and singular its improvements, appurtenances and privileges, and also the aforesaid slaves to him the said George Morris Smith, his heirs, executors, administrators and assigns forever. An they the said Benoit Vanhille, and Caroline Fontenot his wife, acting herein with the advice consent of her said husband, the titles to the aforesaid lands with all and singular the improvements thereon, their appertenances [sic] and privileges, and also of the slaves described as afforesaid [sic], against the lawful claims of all person or persons whatsoever, to him the said George Morris Smith his heirs, executors, administrators and assigns do warrant and will forever defend. This sale is made for and in consideration of the sum of thirteen thousand dollars, for the slaves, and twelve dollars per superficial arpent for the land making the entire sum of twenty five thousand seven hundred & ninety two dollars payable as follows, towit, Five thousand dollars [Page 30] Cash paid in hand by the purchaser to the sellers the receipt whereof if hereby acknowledged, and the balance one third on the first day of March in the Year one thousand eight hundred and thirty eight with interest thereon at the rate of eight percent per anum [sic] from and after the first day of March One thousand eight hundred and thirty seven, One third on the first day of March in the Year one thousand eight hundred and thirty nine with interest at eight percent per annum from the first day of March one thousand eight hundred and thirty seven, and the remaining third on the first day of March in the Year one thousand eight hundred and forty with interest thereon from and after the first day of March in the year one thousand eight hundred and forty with interest thereon from and after the first day of March in the Year one thousand and eight hundred and thirty seven the aforesaid land and slaves remaining specially Mortgaged to the sellers until the entire payment of the aforesaid purchase money and the interest which may accrue thereon. And further to secure the payment of the aforesaid purchase money and interest the said George Morris Smith has mortgaged and does hereby hypothicate and Mortgage to the said sellers the following described slaves, towit, A negro man named Jesse aged about twenty five Years, a negro man named Nicholas aged about twenty five Years, a negro boy named Peter aged about fifteen Years, a negro boy named Buon aged about seventeen Years, A negro woman named Annette agerd abut twenty one Years, a negro woman named Mary aged about twenty seven Years and a negro girl named Faustine aged about ten Years. It is known and understood by the parties that the above described bargained & sold land and a part of the slaves are Mortgaged to the Union Bank of Louisiana for stock takin [sic] in said Bank by the said Vanhille Which said Mortgage the said sellers bind themselves their heirs &c to Cause to have released. The purchaser dispenses with the Certificate required by the 3328th Article of the Louisiana Code or by any other Law of this State on the subject of Mortgages. In testimony of all which the parties have hereunto signed and affixed their seals, the said Caroline Fontenot wife of the said Benoist Vanhille and acting by his consent & authorization being informed by the undersigned Notary & Parish Judge separate and apart from her husband that she had by law a legal mortgage upon the property of her said husband for the restitution of her total effects whether brought in marriage or subsequently acquired, for the restitution of her paraphernal effects of which her said husband had the administration or enjoyment, for debts by her contracted with her said husband and for nuptial presents, declared that she was fully acquainted with the nature and extent of her claims and privileges upon the property of her said husband, and that she did nevertheless sign & confirm this Deed of Sale. Signed and sealed in presence of Robert Benguerel and Caleb Green Junr. competent Witnesses and before George King Parish Judge in and for the aforesaid Parish of St. Landry at Opelousas the day and Year above written.
