The petition of Mary Lydia Story wife of James B. Underwood a resident of the said Parish of St. Helena and of Grace N. Story wife of Joseph E. Noble, also a resident of the said Parish. Respectfully represents ( being herein joined aided & assisted especially (?) by their said husbands) that their Father Samuel Story & their Mother Mary Reddin his wife have both departed life in the said Parish of St. Helena where they resided, leaving your petitioners and the following named minor children, brothers & sisters of your petitioners, the sole heirs of the said deceased --- Viz: George Story, Sarah Jane Story, Saml. Marion Story, William Jesse Story and Charlotte Story --- for whom Edward Story, a resident of the Parish of East Feliciana has been duly appointed by your Hon. Court their Tutor and George Redden undertutor. Petitioners further represent that their said Father & Mother Saml. Story & his wife Mary Reddin left at their deaths considerable property real estate & slaves, personal property, _____ (?) separate & communative of wherein a Public Inventory & appraisement had been duly made by order of your Hon. Court ---- Which property is whereunto by your petitioners and their said co Heirs equally in an undivided state. Petitioners further represents that they are desirous of having a full & fair partition of all said property made between themselves & their said co Heirs according to their respective rights & interests in a firm & irrevocable manner by a decree of your Hon. Court. Petitioners further represent that in order to prevent loss & inconvenience, a public sale of all said property be necessary in order to effect the partition sought. Petitioners further represent there are some debts due & owing by the succession of the said deceased, being the expense attending this last illness of the deceased the said Story and the last charges occuring in the settlement of succession for which promisory at or (?) the partition. Wherefore the premises being Considered Your petitioners bring suit --- prays for the cotutor of the said Edward Story Tutor of the said minor heirs & held to answer their petition & that your Honor will render a judgement decreeing a full & fair partition of all the property of every kind whatever belonging to the succession of Saml Story & his deceased wife Mary Reddin to be makde in a fair & irrevocable manner, to be preceeded by a public sale thereof made according to law --- the terms of the sale to be fixed by a family meeting of the relations and for the benefits of the said minors heirs to be convoked for that purpose --- and (?) terms of Cash so far as concern your petitioners respective interests & (?) petitons and that provisions be made for the payments of the said debts due or previous & the partitions, and for such further order grant & proceedings be had as the land & nature of the case may begin & for general relief in the premises.
