Higginbotham December 5, 1885 State of Louisiana, Parish of St. Helena} Be it remembered that on this the fifth day of December A.D. One Thousand Eight hundred and eighty-five, before me William C. Pipkin, a notary public in and for aforesaid Parish, duly commissioned, qualified, and acting as such therein, there personally appeared, John Chaffe; William H. Chaffe and Christopher Chaffe Jr., all composing the commercial firm of John Chaffe & sons and all residents of the parish of Orleans, State of Louisiana, who dictated unto me, notary, in the presence of the undersigned competent witnesses that for the consideration,, and upon the terms and considerations herein after expressed, they do by these presents grant, bargain, sell, convey, transfer and deliver unto Charles Higginbotham , a resident of the Parish of St. Helena, State of Louisiana, here present purchasing and accepting for himself, his heirs and assigns and acknowledging delivery and possession thereof, the following described property with all the rights, ways, uses, privileges, etc. thereto appertaining, and as situated in the parish of St. Helena, said state to wit: Lot No two(2) in section 43 T 1 S. R 4 E. as per plan of survey made of said section in 1884 by J.B. Womack Parish surveyor, containing eighty acres and 54/100 of an acre situated on Darlings Creek, bounded North by lands of Perry Brown, East by vendors and Robert McKnight, South by vendors, and West by lands of H W Pipkin formerly Mrs. S C Keating, and being lands acquired by vendors from Jas Felix Robertson in 1876, as per act then papers and of record in St. Helena Parish. To have and to hold said property, rights etc, unto said purchaser, his heirs and assigns forever, and vendors moreover now hereby bind themselves and heirs to forever warrant and defend in favor of said purchaser his heirs and assigns the title to said property herein conveyed against all mortgages, liens, privileges or other claims and demands whatever, hereby fully subrogating said purchaser to all of their rights, and rights of action, etc. in warranty, to be by him fully exercised in the premises. The consideration, terms and conditions of this sale and transfer are as follows: For the sum of Two hundred and fifty dollars (250$) paid and to be paid as follows, seventy-nine dollars cash, the receipt of which is hereby acknowledged and full acquittence therefore given and for the balance of said purchase price, the vendee has executed here two certain promissory notes of even date herewith each calling for the sum of eighty-five & 50/100 dollars, drawing each 8 percent per annum interest from date until paid, and made payable to vendors, or bearer, and payable one and two years from date respectively. Now to secure the full and final payment of the aforesaid two notes and all interest due thereon when paid, the vendors retain and vendee grants in favor of the sellers or any future holders said notes, a special mortgage with vendors lien and pri? upon the property, improvements, etc. herein conveyed with a pact de non alliance which notes after being paraphed ne varietur of this days date by me, notary, for identification with this act of sale and mortgage, were delivered to said vendors who acknowledge the receipt of same. The certificate of mortgages required to be produced in such cases by law is now hereby waived by the parties, and all taxes due to date on said property conveyed, are paid, as per evidence exhibited to me notary, before passing. In witness whereof, the said contracting parties, after having same carefully read to them, have here unto signed their names by writing themselves in presence of John D. Adcock and W. K.
