Gorman & Wife to D. K. Gorman Land and Slaves & D. K. Gorman to Rebeccca Gorman State of Louisiana Parish of St. Helena} Be it known that on the twenty fifth day of March in the year of our Lord one thousand eight hundred and forty eight and of the independence of the United States of America the seventy second. Before me S.B. Draughan Recorder in and for the Parish of St. Helena State of Louisiana duly commissioned and sworn and in the presence of witnesses herein named and unassigned personally came and appeared Mr. David Gorman and his wife Mrs. Rebecca Gorman both of said Parish and State the latter being duly authorized and empowered to appear and act by her said husband who declared and acknowledges they had bargained, sold, transferred, conveyed and delivered unto Dempsey K. Gorman also of said Parish and State. Fifteen certain slaves namely George aged 26 years, Henry aged 26 years, Daniel aged 24 years, woman Dotia aged 24 years, and her three children Torrie (?) aged 4 years John aged 5 years & Hannah aged 2 years. Julia aged 22 years & child Luisa aged 2, boy Parris aged 14 years, boy Burlin aged 10 years, Tim aged 65 years, Rose aged 50 years Muo(?) aged 4 years and Jack aged 2 years, all slaves for life and warranted free from the vices and maladies prescribed by Law to have and to hold the said slaves. Each of them unto the said purchaser, and unto his heirs and assigns, together with all the rights privileges, uses and issues unto the same in any lawful manner belonging or pertaining under a clear unencumbered and fully guaranteed title except so far as this herein after named, To their own proper use and behoof forever, for and in consideration of Five Thousand & five hundred dollars to them made payable as herein after set fourth to wit - The said purchaser hereby assumes to pay for said vendors a judgment owed by W. S Sea administrator of the Estate of David Kemp decd. against Rebecca an amounting at this time to nineteen hundred & sixty one dollars & sixty five cents. After deducting credits and to guarantee the payment of which hereby grants a special mortgage all said Slaves in favor of said vendors The further sum of two hundred and thirty seven dollars is paid by the receipt of said purchaser being an amount heretofore paid on said judgment by said purchaser for said defendant One hundred and forty four dollars is paid by the delivery of a note of Rebecca Gorman for the amount given in favor of D Gorman. Twelve hundred dollars is paid by six years service of said purchaser rendered here being from the year 1839 to the year 1848 inclusive. Five hundred and fifty dollars is paid by the transfer of the slave Mary from said D. K. Gorman to the said Rebecca hereto named and the balance of Fourteen hundred & seven dollars and twenty nine cents is to be paid the first day of January 1852 to the said Rebecca Gorman & for which the said Rebecca Gorman and for which the said D K Gorman gives his promissory note of even date herewith calling for said sums amounting to the said sum of fifty five hundred dollars. To have and to hold the said named slaves unto the said purchaser and unto his heirs and assigns forever and the said vendors hereby further promise that they and their heirs shall and will forever warrant and defend the slaves herein conveyed against all legal claims and claimants whatever the said vendors moreover transfer unto said purchaser all the rights and actions of warranty to which they themselves are entitled against all the former proprietors of the slaves herein conveyed subrogating said purchaser to the said rights and actions ably him enjoyed and exercised in the same manner as they might have been by the present vendors The said Dempsy K Gorman being here present purchasing and accepting and who acknowledges possession and delivery there of and who further declares that he hereby transfers, conveys, and delivers the said slave Mary a woman aged 22 years of black color a slave for life unto the said Rebecca Gorman and unto her heirs and assigns at the said sum of five hundred & fifty dollars to him cash paid in the value of the slaves herein to him conveyed to have and to hold said slave Mary unto said Rebecca Gorman her heirs and assigns to then avow proper use and behoof forever together with all the rights, issues, privileges and uses unto the same in any manner belonging The said David & Rebecca Gorman hereby further acknowledge and declare that in addition to the slaves herein sold by them that they have and do hereby sell, transfer, convey & deliver unto said D K Gorman a certain tract of land lying and being on Frachee Creek in said Parish with all the buildings and improvements thereon containing three hundred and twenty acres bounded north by William Hutchinson East and South by the Estate of Dempsey Kemp and West by Twelve mile creek or the west half of the section of which said land is a part and included with said slaves in the sale and also stands specially mortgaged to secure the payment of said note and was omitted in the first part of this act And now to the presents personally came and appeared Madam Rebecca Gorman wife of said David Gorman as aforesaid and after having cognizance of the foregoing act which I the said recorder carefully read and explained & to her declared and said that she wished to approve and satisfy the same and the said wife did further declare unto me Recorder that it is her wish and intention ? in favor of said purchases the slaves & said herein conveyed from the matrilineal dotal paraphernal and other rights and from any claims mortgages or privileges to which she may be entitled whether by virtue of her marriage with Gorman or otherwise where upon the said Reader did inform the said Rebecca Gorman apart & out of the presence and hearing of her said husband that she had by law a legal mortgage on the property of her said husband First for the restitution of her dowry and for the reinvestment of the dotal property sold by her husband and which she brought in marriage receiving from the celebration of the marriage. Secondly for the restitution and reinvestment of the dotal property by her acquired since marriage whether by succession or donation from the day the succession opened or the donation perfected. Thirdly for nuptial presents. Fourthly for debts by her contracted with her said husband. And fifthly for the amount of her paraphernal property alienated by her and received by her said husband or otherwise disposed of for the individual interest of her said husband that in making her intended renunciation she would deprive her self irrevocably and forever of all rights of acclimation against the property herein convey whether under mortgage privilege or otherwise. And the said wife did thereupon declare unto said Recorder that she was fully aware of and fully acquainted with the nature and extent of the matrilineal dotal paraphernal and other rights and privileges thus secured to her by law on the property of her said husband and she nevertheless did persist in her intention of renouncing and does formally renounce, not only all the rights claims and privileges herein before enumerated and describe but all others of any nature or kind whether to which she is or maybe entitled by any laws now or heretofore enforce in the State of Louisiana. And the said David Gorman being now present here signing and authorizing the said Rebecca Kemp his said wife in the execution of these presents, she the said wife did again declare and that she did and does hereby make a formal renunciation & relinquishes herein of all her said matrilineal, dotal, paraphernal and other rights claims and privileges in favor of said Demsey K Gorman binding herself and her heirs at all times to sustain and acknowledge the validity of the renunciation. Thus done and passed at the residence of the vendors Parish office in presence of Wm. F. Womack & Alexander Smith witnesses both of this Parish who here unto sign their names with the parties & me the said Recorder.
