All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ************************************************ State of Louisiana, Parish of East Baton rouge Be it known, that on the 2nd day of January in the year of our Lord one thousand nine hundred and nine before me, John Fred Odom, a Notary Public in & for the parish of East Baton Rouge, State of Louisiana, duly Commissioned and qualified, and in the presence of the Witness herein after vowed and undersigned; Personally came and appeared, William H. Odom a resident of the lawful age of majority of the parish of St. Helena, State of Louisiana who declared that for the Consideration and upon the terms and conditions herein after expressed he has , Bargained, and sold, and does by these presents grant, bargain, sell, transfer, convey, assign and set over with substitution and subrogation to all rights and actions of warranty against all proceeding owners and vendors unto, Lewis Rudison and Harry C Rudison, both residents of the lawful age of majority of the parish of St. Helena, State of Louisiana here present, purchasing and accepting and acknowledging delivery and possession for themselves, their heirs and assigns all & singular the following to wit:___ A certain tract or parcel of land situated in the parish of St. Helena, State of Louisiana, and containing One Hundred and fifty acres more or less, together with all the buildings and improvements thereon..to wit:- on the North by W J Lea, West by Anderson fence ( and adjacent line) said property being the same by the David Hill Embry (Sic?); being the same property acquired by the present vendor from Mrs. Emma A. Odom as of record in the Book 10, folio 255(?), Conveyance Records parish of St. Helena, Louisiana. To have and to hold the said property unto the said purchasers, their heirs and assigns forever. This present and Conveyance is made and accepted for and in Consideration of the price and sum of Fifteen Hundred ($1500.00) dollars lawful current money of the United States of which said amount the said purchasers have paid in cash the sum of One thousand and Fifty ($1050.00) dollars lawful and current money of the United States, and for the balance of Four Hundred and Fifty ($450.00) dollars, the said purchasers have made and executed therein (sic) two certain promissory notes of even date herewith, drawn to the order and endorsed by themselves, for the sum of Two Hundred ($200.00) dollars and Two Hundred and Fifty ($250.00) dollars, respectively, due and payable on November the 1st 1909, and December the 1st 1909, respectively, at the Peoples Trust and Savings Bank of Baton rouge, Louisiana, & stipulated to bear interest at the rate of 8% per cent per annum from maturity until paid. The Vendor herewith acknowledged receipt of the said cash payment and Promissory Note. Which note after having the duly paraphed " Le Varutum" (sic?) by me said Notary, for identification herewith were handed over to...Vendor who hereby acknowledged receipt therof. and said purchasers further declared that they & by these present bind and obligate themselves (sic) their heirs to pay and remburse (sic) William H. Odom , are (sic) any such holder or holders shall...or pay in the event of the non-payment of said Promissory Notes at maturity, or in case it should become necessary to place said notes in the hands of a attorney at Law for collection, suit or otherwise, said attorney's fees however, to be fixed at 10 per cent on amount due...suit, ...therefore in order to secure the full & final payment of the said Promissory Notes in Capital and interest, together with all...including the attorneys fees herein after stipulated the purchaser (sic) and the vendor retains a special mortgage with vendors lien privileges on the property herein conveyed in form of said vendor any and all future holder or holders of said notes...the same shall have been fully paid & satisfied in principal and interest; the said purchasers hereby binding themselves, their heirs and assigns not to sell, alienate or encumber the said property to the prejudice of those presents. And the said purchasers further declare that they do by those presents agree, and stipulate that in the event of the said Promissory Notes not being punctually paid at maturity, it shall be lawful for & they do hereby authorize the said vendor or any holder or holders thereof, to cause all and singular the property herein before discredited and herein mortgaged to be seized & sold, under executory (sic) process issued by any Court of Competent Jurisdiction, without appraisment (sic), to the highest bidder payable cash; the said purchasers hereby expressly dispensing with all and every appraisment (sic) thereof, capital and interest, together with all cost, including attorneys fees herein stipulated. All taxes assessed against the property herein Conveyed have been paid, as appears by the Certificate hereto annexed. The Certificate of Mortgage required by Article 3364 of the Revised Civil Code of Louisiana is hereby dispensed with by consent of the parties hereto- Thus done, read & passed at my office in the City of Baton Rouge in the presence of J.M.
