Beauchamp Sale of Land [and Slaves] Parish of Avoyelles State of Louisiana Before me Roger B. Marshall Notary public for the parish of Avoyelles on Bayou Boeuf personally appeared (Patrick H. Glaze of the above written State & parish, who acknowledges to have bargained, transferred [sic], set over and delivered and does by these presents grant bargain set over and deliver to Thomas D. Beauchamp of the Parish and State above written three Negro Slaves, to wit. A woman aged about 23 years known by the name of Betsy, her two children one a boy about 2 years old and an infant not yet named, Also a certain tract or parcel of Land situated on Bayou Chicot containing for [sic] hundred & twenty acres being the same on which Daniel Ferguson resided and contracted to the said Glaze for the sum of Sixteen hundred dollars, Now whereas the said Daniel Ferguson has not made the said Glaze a title to said land the said Glaze binds and obligates himself to make the title to said land to said Beauchamp with guarantee, but should the said Daniel Ferguson not make full and complete title to said land to said Glaze then the said Glaze binds & obligates himself his heirs & assigns to pay to the said Thomas D. Beauchamp the sum of Sixteen hundred dollars. This tract of Land being the same including the premises on which the said Glaze now resides peaceable & quiet, possession of the Said land & premises to be given to the said Beauchamp on the first day of Oct[obe]r. next----In consideration of slaves Betsy & her two children the said Beauchamp has this day paid the said Glaze seven hundred dollars cash in hand the receipt whereof is hereby acknowledged--In testimony of which the parties here being present the one delivering and the other accepting the same in presence of William C. Marshall Notary Public ============================================================================== ================= Wm. & Eliza Wikoff To Wikoff Power of Attorney Recorded 11 June 1836 Know all men by these presents that We William Wikoff of the State of Louisiana and Parish of St. Landry and tutor to Susan Watts Pannell and Eliza Wikoff wife of William H. Pannell of the same State and Parish aforesaid and Tutrix to Henrietta Matilda Pannell co-heirs with our Said wards in the succession of the late Mrs. Susan Watts Wikoff of said parish deceased and herein acting as well for ourselves as tutors as aforesaid, have nominated, constituted & appointed and in our place and stead put, and by these presents do nominate constitute & appoint, and in our place and stead put Stephen W. Wikoff of the aforesaid State and parish our true and lawful attorney for us and in our names, place and stead and to our use, so far as we are interested in our own right and as tutor as aforesaid, to ask demand, sue for levy, require, recover & receive all and all manner of goods, chattels, debts duties, rent and rents & sums of money, and demand whatsoever, due or hereafter to be due owing or belonging to the Succession of the aforesaid Mrs. Susan Watts Wikoff deceased, by any person or persons whomsoever, for any matter or thing whatsoever, and upon the receipt thereof or any part or parts whereof, to make and to give acquittances or other discharges for the same in our names or in his own name--and for us and in our names to commence and prosecute any suit or suits, or action or actions as well real as personal or mixt [sic: mixed] for any goods chattels, debts, duties, demands, matter, cause or thing whatsoever, due or belonging unto the aforesaid succession, or to be demanded on what may be demanded by us in any courts of law or equity, or in any other court or place whatsoever--and the same action & actions suit and suits, and every of them to prosecute and follow on to discontinue the same if he shall see cause--Also for us and in our names to appear make answer and defend in al manner of actions and suits whatsoever as well real as personal or mixt which at any time may be commenced, sued or taken against the said Estate or against the Estates of our said wards--And also for us and in our names to settle and adjust with all person or persons, all accounts dues & demands subsisting or to subsist between them or either of them & the aforesaid Estate, and to arbitrate and agree the same in such manner as our said Attorney shall think proper. Judge-- ============================================================================== ================= Labiche Syndic To Doyl Release of Mortgage Recorded 11 June 1836 Know all men by these presents that whereas a sale of the property surrendered to his creditors by Michel Perault made on the 27th day of April 1835 pursuant to an order of the District Judge of the Fifth Judicial district for the Parish of St. Landry and State of Louisiana John Doyle of the aforesaid State and parish, became the purchaser of a negro woman named Eliza aged about nineteen years with her child a negro girl named Charlotte about eighteen months old for the price & sum of seven hundred and ninety five dollars payable one half on the first day of June 1835 and the other half on the first day of June 1836, with a special mortgage on said slaves until final payment and whereas the said John Doyle has fully paid to me Pierre Labiche Syndic of said creditors of said Perault, the said sum of seven hundred and ninety Dollars the receipt whereof is hereby acknowledged. Now in consideration of the premises I have released cancel and annul the above recited mortgage as fully and effectually as though the same had never existed. Thompson and James Morrison Sale of Land Recorded 11 June 1836 This Deed made & entered into this tenth day of June one thousand eight hundred and thirty Six between Elias Blunt of the State of Louisiana and parish of Rapides of the one part & Joseph D. Thompson of the same State & parish of St. Landry & James Morrison of the said parish of Rapides of the other part witnesseth--That for and in consideration of the sum of Five thousand dollars to him in hand paid, the receipt whereof is hereby acknowledged, sell, alien, convey set over & deliver unto the said Joseph D. Thompson & James Morrison a certain tract of land being the North East Quarter of Section number thirty four in township Two north range one East, containing one hundred and sixty acres more or less. To have & to hold the above described tract of Land to them the said Thompson & Morrison their heirs & assigns forever. Dupre' to Wikoff Sale of Slave Recorded 12th June 1836 Know all men by these presents that Caroline David widow Laurent Dupre' fils of the State of Louisiana and parish of St. Landry for and in consideration of the sum of twelve hundred dollars payable on half on the first day of April in the next ensuing year, 1837, and the other half on the first day of April in the year, 1838, has bargained and sold and does by this public act, grant, bargain, sell transfer and deliver unto Stephen Wikoff of the same State and Parish aforesaid a certain negro man slave named Robert aged about thirty six years. To have and to hold said slave to him the said Stephen W. Wikoff his heirs &c. forever, with guarantee of title against the lawful claims of all persons whatsoever, and the more effectually to secure the title of said slave to the purchaser Laurent Dupre' acknowledges & binds himself as security thereof. The purchaser dispenses with the production of the certificate required by the 3328th article of the Louisiana Code. That for and in consideration of the sum of Three hundred dollars cash in hand paid the receipt whereof is hereby acknowledged, the said Antoine Curvelo has bargained & sold and does by this act grant bargain, sell, alien, convey, set over and deliver unto her the said Margaret Queen a certain Lot of ground situated in the Town of Washington being Lot No. 17 bounded on the north by land of Matilda Goodrich, on the West by land of John Crawford on the South by land of John Caswell & on the East by land of [blank] Bellair To have and to hold the said Lot of Ground to her the said Margaret Queen her heirs & assigns forever--And the said Curvel for himself his heirs &c. the title to the said land with its privileges & appurtenances free from the lawful claims of all persons whatever does warrant & will forever defend--The certificate required by the 3328th Article of the Louisiana Code is despenced [sic] with by the purchaser--In testimony whereof the said parties have hereunto signed in presence of Caleb Green Jr. & Benoit Debaillon and before George King Parish Judge and ex-officio Notary Public in & for the said Parish of St. Landry, the day & year above written--The said Simon Kephart, wife of the purchaser, also signs as approving this act of his wife--Antoine Curvela--Margaret Queen--S. Judge ============================================================================== ================= Denis Hargrove & Antoine Myer To Moses Littell Sale of Land 13th June 1836 Recorded This Deed of Sale made this thirteenth day of June one thousand eight hundred and thirty Six between Denis Hargrove & Antoine Myer both of the State of Louisiana and parish of St. Landry of the one part and Moses Littell of the same State & Parish of the other part, Witnesseth, that for & in consideration of the sum of Four hundred dollars to them in hand paid the receipt whereof is hereby acknowledged the said Hargrove [Page 4] and Myer have bargained and sold and do by this act grant, bargain, sell, alien convey set over and deliver unto Moses Littell aforesaid all their right and title to the West half of North East Quarter of Section number twenty two, and also to the West half of South West quarter of same Section No. 22 Township One north, Range Five East, containing one hundred and fifty nine & 67/100 acres--To have and to hold the said tract of land to him the said Moses Littell his heirs & assigns forever--It is understood that the said Hargrove & Myer offer no guarantee except against all persons claiming by through or under them--The purchasers dispenses with the certificate required by the 3328th article of the Louisiana Code. The above described land is by the Registers Certificate No. 95 dated 15 Feby. 7th 1836. Judge ============================================================================== ================= Margaret Queen wife of Kephart To Windsor Smith [Sale of land] 13th June 1836 Recorded This deed of sale made this thirteenth day of June one thousand eight hundred and thirty six between Margaret Queen wife of Simon Kephart of the State of Louisiana & Parish of St. Landry, hereby acting by and with the advice & consent of her said husband, of the one part--and Windsor Smith of the Same State & parish of the other part Witnesseth--That for and in consideration of the Sum of Two hundred dollars cash in hand paid the receipt whereof whereby acknowledged the said Margaret Queen has bargained and sold & does by this act grant bargain sell alien convey set over and deliver unto him the said Windsor Smith, a certain half lot of ground in the town of Washington, being the Westerly half of Lot No. 17 this day acquired by the vendor from Antoine Curvel, by act of Sale passed before George King Parish Judge of said parish--Said half Lot of Ground being bounded on the North by land of Matilda Goodrich, on the West by land of John Crawford on the South by land of John Caswell and on the East by land of the vendor--To have and to hold the said lot of Ground to him the said Winsor Smith, his heirs & assigns forever and the said Margaret Queen for herself her heirs &c. the title to the said land with all & singular its privileges & appurtenances free from the lawful claims of all persons whatever does hereby warrant & will forever defend. White Governor Bond as Grog shop keepers 14th June 1836 Recorded Know all men by thes[e] presents, That we Truss & Shea principals and Napoleon Franchebois security are held and firmly bound unto Edward D. White Governor of the State of Louisiana and to his successors in office, in the sum of Five hundred Dollars, which sum well and truly to pay to the said Edward D. White--Governor of the State of Louisiana, and to his successors in office, we do bind ourselves, our heirs, executors, and administrators, firmly by these presents with our hands and sealed with our seals in the Parish of St. Landry, this fourteenth day of June in the year of our Lord, one thousand eight hundred and thirty six--Whereas the above bound Truss & Shea principals have obtained a License to Keep a Grog shop in the Town of Opelousas from and after the date hereof, to the first Monday in May 1837--Now the condition of the above obligation is such, that if the said bound Truss & Shea the principal & shall contravene any one of the provisions in relation to Slaves contained in this act entitled, "An act to amend the Black Code" approved March 16th 1830, or should the said bound Truss & Shea the principals keep a disorderly Grog Shop or permit an assemblage of more than three slaves (not belonging to them or in their employment) at the [Page 5] said Grog Shop kept by them or at such other place as they may be in act of retailling [sic] spirituous liquors at, in said Town then the above obligation shall be forfeited, and the amount thereof be recovered before any court of competent jurisdiction in the State of Louisiana one half to the use of the person who shall sue thereon and the other half to the use of the parish of St. Landry. Brounson [Sale of Land] 14th June 1836 Recorded State of Louisiana Parish of St. Landry. Be it remembered that on the day of the date hereof before me George King Parish Judge of said parish and ex-officio Notary Public in & for the same personally came and appeared Louisa King wife of Pierre Wartelle of said parish & herein acting by & with the advice and authority of her said husband who declared, That whereas her said husband had by an act of sale executed on the first day of June in the year one thousand eight hundred & thirty five before George King Parish Judge & ex-officio Notary Public in & for said parish, sold aliened transfered [sic] and conveyed unto John Brownson of the parish of Lafayette in the same State a certain tract or parcel of land, situated in the aforesaid parish of St. Landry & lying in the prairies Bellevue & being the same which the seller acquired by deed of exchange with Dominique C. Sittig as per act passed before Pierre Labiche on the 28th day of October 1829 and the same which the said Dominique C. Sittig purchased at the public sale of the Estate of the late Louis Chacere of said parish of St. Landry deceased, containing four hundred and seventy superficial arpents--And whereas it is necessary to the confirmation of the title conveyed by her said husband to the said Brownson that she should ratify publickly [sic] the said act of Sale--Now therefore the said appearer Louisa King declared that it was her wish & intention to release in favour [sic] of the said Brounson the above described tract of land from any mortgage, claim or privilege whatsoever that she may now have or may hereafter have on the same, whether resulting from her marriage with her said husband or otherwise. Wherefore I the said notary did inform her the said Louisa King apart and out of the hearing of her said husband that she had by Law a legal mortgage upon all the property of her said husband for the restitution of her total effects wether [sic] brought in marriage or subsequently acquired, for the restitution of her paraphernal effects of which her said husband had the administration or enjoyment for debts by her contracted with her said husband & for nuptial presents & she the said Lousia [sic] King did whereupon declare unto me that she was fully acquainted with the nature & extent of her claims and privileges upon the property of her said husband & that she did persist in her intention to approve and ratify the aforesaid sale from her said husband to the said Brounson and to release all her claims & privileges in favour of the said Brounson and she does hereby formally renounce all her said claims rights & privileges of the aforesaid tract of land sold by her said husband to the said Brounson in favour of the Brunson [sic], binding herself & her heirs at all times to sustain & acknowledge the validity of the aforesaid sale. Overton to Marsden Campbell Deed of Partition 17th June 1836 Recorded This Deed of Partition made the seventeenth day of June in the year one thousand eight hundred and thirty six between John Holmes Overton and Patrick Henry Overton of the State of Louisiana and parish of St. Landry of the one part, and Marsden Campbell Jun. of the same State and Parish aforesaid of the other part. Witnesseth that [Page 6] whereas the parties have purchased from the Goverment [sic] of the United States a tract of land containing thirteen hundred and fifty four acres being Sections numbered four in Township number three South of Range numbered three East and the Section numbered thirty eight in Township number two South of the thirty first degree of the north Latitude, of Range number three East of the basis [sic] meredian [sic] in the Southwestern District of the State of Louisiana situated in the County of Opelousas and whereas one half of the said land purchased as aforesaid has immediately in the rear of a tract of land belonging to the John H. Overton & Patrick H. Overton and the other half in the rear of a tract of land belonging to the said Marsden Campbell Junr. And whereas the parties have agreed to divide the said tract of land so as that each party shall have the land in the rear of the land previously owned by them, that is, that the said John H. Overton & Patrick H. Overton shall have the land immediately behind their original tract of twenty by forty arpens & that the said Marsden Campbell Junr. shall have the land immediately behind, his tract, and to be divided by a line in continuation of that which heretofore divide their land. Now therefore in consideration of the premises they the said John H. Overton & Patrick H. Overton have conveyed and do hereby convey, transfer set over alien and confirm to him the said Marsden Campbell Junr. his heirs and assigns the half of the tract of land so purchased as aforesaid which lies in the rear of his original tract to have and to hold the same to him the said Marsden Campbell Jr. his heirs and assigns forever--and the said Marsden Campbell Jr. has conveyed and does hereby convey, transfer, set over alien and confirm to them the said John H. Overton and Patrick H. Overton the half of the tract of land purchased as aforesaid which lies immediately in the rear of their original tract so to be divided as aforesaid--To have and to hold the same to them the said John H. Overton & Patrick H. And whereas the said parties have agreed to divide their joint interest in said tracts of Land, the said Robert taking the said first mentioned tract and the said Linton the last mentioned. Dear Linton, I wrote a letter some time since to Bennett in it I requested him to inform you that the negroes I spoke of when in your country could not be purchased. I have since seen Mr. McSheny [sp?] he informed me it was his wish to sell and he intended doing so provided he could get the other gentlemen concerned to agree and he would give me a final answer in August. If Jean purchase them you shall certainly have to the amount I promised more of this when I see you as I expect a vissit [sic] from you next month, the letter I wrote to Bennett was on business and I expected to hear from him before this but I presume he was absent, on my return home, I found Mrs. Freeman opposed to moving to the South so much so that I would decline moving provided Bennett would take back the land at what it cost me. I find I should have to sell my farm at a grate [sic] saccrafice [sic] and pay high prices for negroes. It would certainly be his advantage to do so as I consider the land to be worth $20 pr. acre. Freeman direct to Port Tobacco Charles County Md. ============================================================================== ================= Needham Coward to Parish Judge Bond as Constable Recorded 24th June 1836 Know all men by these presents that Needham Coward, Thomas Bilbo and Haray [Harvey?] Coward of the State of Louisiana & Parish of St. Landry are held and firmly bound unto George King Parish Judge of Said Parish in the sum of five hundred dollars for the true and faithful payment of which to the said George King or to his successors in Office they hereby bind themselves their heirs &c. jointly and severally firmly, by these presents signed with their hands and sealed with their seals at Opelousas this twenty fourth day of June one thousand eight hundred and thirty six. Witnesseth, That for and in consideration of the terms hereinafter mentioned that said Daniel has bargained & sold & does by this act grant bargain sell alien convey set over & deliver unto the said Dupre a certain half Lot of Ground in the town of Opelousas, with all the improvements thereon known & described on the plat of said Town as Lot No. 1 in Square No. 14, which western half of said Lot is bounded on the North by Landry Street, on the West by Court Street, on the South by lot No. 4 in Square aforesaid, & on the East by the other half of said lot No. 1 and being the same which the sellor [sic] acquired from Joseph Anselm & which the said Anselm acquired from Benoist Keller. To have and to hold the said lot of Ground with all and singular its buildings and improvements to the said Antoine Dupre his heirs & assigns forever, with guarantee on the part of the seller his heirs &c against the lawful claims of all persons claiming by through or under him. This Sale is made for and in consideration of the price and sum of Two thousand dollars--Twelve hundred of which are payable on the eleventh day of December next (1836) and eight hundred dollars payable on the eleventh day of May one thousand eight hundred and thirty seven--with a mortgage on the premises in favour of said Daniels until full & effective payment of said sums of money. Judge ============================================================================== ================= Hypolite Chretien To John Doyle & Robert Barry Release of Mortgage [Slaves included] Recorded 30 June 1836 Whereas by an act passed before George King Parish Judge of the Parish of St. Landry on the 18th of June 1834, John Doyle & Robert Barry acknowledged themselves indebted to Hypolite Cretien all of the said Parish, in the sum of Two thousand seven hundred dollars payable at such times and on such term as are specified in said act, and as security for the payment of said sum of money with such interest as might accrue thereon, the said Doyle and Barry mortgaged to the said Chretien the following described property towit, A tract of Land situated in the aforesaid Parish & Lying in the prairie Grand Coteau bounded on one side by land of the widow Jean Bt. Stelly and on the other side by land of the Widow Bernard Collegin on one end by land of Humbert Perrodin containing ninety superficial acres with the buildings & improvements thereon, being the same on which said Doyle & Barry then resided. Also a tract of wood land lying in the aforesaid Parish on the Bayou Bourbeur, bounded on one side by land of Mr. Charles Smith & on the other by lands ceded to citizens [very faded word] of Bellevue, on one end by the said Bayou & on the other end by the domain, containing forty superficial arpents, also the following described Slaves to wit. A negro man named Henson aged about twenty eight years. A negro Girl named Maria aged about eighteen years. A negro woman named Philis aged about thirty two Years. A negro boy named Charles aged about eleven Years. A negro Girl named Ellen aged about nine Years. A negro Girl named Clarissa aged about six Years, and Milly a negro girl aged about four Year. And whereas the said Doyle & Barry are desirous of Pledging said Landed property so described as aforesaid for Stock in the Citizens Bank of this State. Now therefore, I the said Hypolite Chretien have released & do by this act release cancel & annul the said Mortgage on said land and improvements thereon, ad fully & effectually as though said Mortgage had never existed thereon. Jewell of the same State & Parish of the other part Witnesseth that for & in consideration of the price & sum of Two hundred dollars to him in hand paid, the receipt whereof is hereby acknowledged, the said Littell has bargained & sold & does by this act grant, bargain, sell, alien, confirm, convey & deliver unto him the said Jewell, a certain Tract of land known & described as the East half of the South East quarter of Section numbered nineteen in Township Three South of Range Five East containing about eighty and an half acres more or less, being the same purchased by said Littell as assignee of Alexander Duhon & John Francis, as per Receivers certificate No. 1626. This sale is made for and in consideration of the sum of thirteen thousand dollars, for the slaves, and twelve dollars per superficial arpent for the land making the entire sum of twenty five thousand seven hundred & ninety two dollars payable as follows, towit, Five thousand dollars [Page 30] Cash paid in hand by the purchaser to the sellers the receipt whereof if hereby acknowledged, and the balance one third on the first day of March in the Year one thousand eight hundred and thirty eight with interest thereon at the rate of eight percent per anum [sic] from and after the first day of March One thousand eight hundred and thirty seven, One third on the first day of March in the Year one thousand eight hundred and thirty nine with interest at eight percent per annum from the first day of March one thousand eight hundred and thirty seven, and the remaining third on the first day of March in the Year one thousand eight hundred and forty with interest thereon from and after the first day of March in the year one thousand eight hundred and forty with interest thereon from and after the first day of March in the Year one thousand and eight hundred and thirty seven the aforesaid land and slaves remaining specially Mortgaged to the sellers until the entire payment of the aforesaid purchase money and the interest which may accrue thereon. And further to secure the payment of the aforesaid purchase money and interest the said George Morris Smith has mortgaged and does hereby hypothicate and Mortgage to the said sellers the following described slaves, towit, A negro man named Jesse aged about twenty five Years, a negro man named Nicholas aged about twenty five Years, a negro boy named Peter aged about fifteen Years, a negro boy named Buon aged about seventeen Years, A negro woman named Annette agerd abut twenty one Years, a negro woman named Mary aged about twenty seven Years and a negro girl named Faustine aged about ten Years. It is known and understood by the parties that the above described bargained & sold land and a part of the slaves are Mortgaged to the Union Bank of Louisiana for stock takin [sic] in said Bank by the said Vanhille Which said Mortgage the said sellers bind themselves their heirs &c to Cause to have released. The purchaser dispenses with the Certificate required by the 3328th Article of the Louisiana Code or by any other Law of this State on the subject of Mortgages.
