Hardy Sale of Land Recorded 23 July 1836 This Deed made the twe[n]ty third day of July in the Year one thousand eight hundred and thirty six between Henry Miller of the State and Parish of St. Landry on the one part, and Thomas S. Hardy of Prince George's County & State of Maryland of the other part Witnesseth, That for and in consideration of the premises hereinafter expressed he the said Henry Miller has bargained and sold, and does by this act grant bargain, sell set over alien and confirm unto him the said Thomas S. Hardy a certain tract or parcel of land situated in the aforesaid Parish of St. Landry and lying on the Bayou Bourbeaux, bounded by said bayou, and lands of June Meche, Philip Richard fils, George Washington Gardiner, Gerasime Richard & David Meche containing five hundred and forty six & fifty two hundredths superficial Arpens more or less, and being the same land acquired by [Page 31] the seller by purchase at the sale of the est[at]es. of Philip Richard and Louis Richard deceased. To have and To hold the aforesaid tract of land with its privileges and appertenances [sic] to him the said Thomas S. Hardy his heirs, executors, administrators and assigns forever and he the said Henry Miller for himself his heirs executors and administrators the tract of land so described as aforesaid with all and singular its appertenances and privileges against the lawful claims of all persons whatsoever to him the said Thomas S. Hardy his heirs, executors, administrators and assigns does war[r]ant and will forever defend. This sale is made for and in Consideration of the sum of five thousand four hundred and sixty five dollars and twenty cents, being at the rate of ten dollars per superficial arpent, and if on actual Survey of said land there should be more than the quantity above mentioned the surplus will be at the same rate, and if less the deficiency will be deducted from the above mentioned sum at the rate of ten dollars per superficial arpent. The purchase money is made payable by three equal instal[l]ments, (towit) one third on the first day of April next 1837 with interest at the rate of ten percent per an[n]um from the date hereof, one third on the first day of April in the Year one thousand eight hundred and thirty eight with interest thereon at the rate of ten percent per an[n]um and after the twenty third day of July (1837) until paid, and the remaining third on the first day of April on[e] thousand eight hundred and thirty nine with interest thereon at the rate of ten percent per annum from and after the twenty third day of July 1838, until paid. It being stipulated and agreed that the aforesaid bargained and sold premises shall remain specially mortgaged to the sellor [sic] to secure the payment of the aforesaid sums of money and the interest which may accrue thereon until the entire payment thereof. And further to secure the payment of the aforesaid purchase money to the seller William Frederick Hardy of the State of Louisiana & Parish of St. Landry aforesaid binds himself his heirs &c as security for the same as well as for the interest which may accrue thereon. Judge ****** Lenard Smith & wife To Caleb Swaize and Rice Garland Power of Attorney Recorded 26 July 1836 Know all men by these presents that we Lenard Smith and Eliza his wife of Allegany County on the State of Maryland, for divers good Causes and consideration as hereunto moving have made, ordained Constituted, authorised, nominated and appointed and by these presents do make nominate, ordain, Constitute and appoint, Rice Garland and Caleb L. Wherefore, agreeably to the provisions of an act of Congress passed on the third day of March 1807 entitled an act respecting the claims to land in the territories of Orleans and Louisiana, the claimant is entitled to a patent from the United States, for the above described tract of land, or as much thereof as is not rightfully [sic] claimed by any person, unless the same shall be found to include either a lead mine or salt spring, this certificate being filed with the register of the land Office for the said district within twelve months from the date hereof shall entitle the claimant to the certificate of said register, on which a patent shall issue--Given under our hands at Opelousas church this 28th day of May in the Year one thousand eight hundred and eleven, and i n the thirty fifth Year of Independence of the United States (Signed William Garrard (signed) John Thompson Clerk of the Board (signed) Levin Wailes (signed), Gedian [sp?] Fitz Commissionners [sic]. Pub. ***** Virgil Frozard To Placide & Magdeleine Marks Release of Mortgage Recorded 29 July 1836 Know all men by these presents that Whereas on the nineteen day of March in the Year one thousand eight hundred and thirty five, Virgil Frozard of the State of Louisiana and Parish of St. Landry, bargained and sold to Placide Marks and Magdeline Marks his wife all that certain tract or parcel of land situated on the aforesaid Parish and lying in the Prairie Gros Chevruille adjoining to lands of Michel Mayer, Alex Mayer, Cyprien Lalonde and the domain containing about ninety eight & three quarter arpens for the price and sum of eight hundred dollars, three hundred and fifty of which were paid in hand, & the balance made payable one hundred and fifty dollars in April 1836, and three hundred dollars in the month of April 1837--and whereas the aforesaid sums have been paid to the said Frozard the receipt whereof is hereby acknowledged--Now in Consideration of the premises he the said Virgil Frozard has released & does hereby release the mortgage retained on the aforesaid tract of land to secure the payment of the purchase money as fully and entirely as though it had never existed. Blaze Lejune & Lussuin Lejeune of the State of Louisiana & Parish of St. Landry of the One part and Moses Littell of the same State & Parish of the other part Witnesseth, That for & in consideration of the price & sum of five hundred dollars cash in hand paid the receipt of whereof is acknowledged the said Jean Bt Blaze and Lussain have bargained & sold & do by this act grant bargain sell alien convey, set over and deliver to him the said Littell a certain tract of Land situated in the Parish of Avoyelles known as the East half & West half of the South East quarter of the Section numbered twenty one in the Township number One North of Range five East being the same tract conveyed to the said Littell by assignment & entered by him at the Land office in Opelousas on the 16th day of Febuary [sic] 1836, as appears by the Register's certificate No. 96, containing One hundred & fifty nine 50/100 acres more or less. Judge ***** Tobe Williams To John Smith Sale of Land Recorded 20th September 1836 Know all men by these presents that Tobe Williams of the State of Louisiana and parish of St. Landry for and in consideration of the price and sum of one hundred dollars cash to him in hand paid the receipt whereof is hereby acknowledged has bargained and sold and by this act does grant bargain sell alien convey and deliver unto John Smith of the same State and Parish aforesaid all and singular the improvements upon a certain tract of public land situated in said Parish and lying in the Prairie Faketaque at Joseph Briars Point together with any right which the vendor may have to acquire the land upon which said improvements are situated by preemption or otherwise from the United States, said improvements being the same acquired by said Williams from Soulange Trahan of said Parish on the [blank] day of [blank] 1836 by a private act w[h]ich said vendor obliges himself to deliver to said Smith. And the said Williams warrants said improvements free from the lawfull [sic] claim or title of all persons whatsoever. In witness whereof said parties have hereunto signed at Opelousas this twentieth day of September one thousand eight hundred and thirty six in presence of George R. King and Caleb Green Jr. competen[t] witnesses and before George King Parish Judge and ex-officio Notary Public in and for said parish of Saint Landry. Tobe Williams John Smith Witness Geo. R. Judge ***** Moses Littell To Eliakim Littell Sale of Bank Stock 21st September 1836 Know all men by these presents that whereas on the Sixteenth day of January in the present year Moses Littell of the State of Louisiana and Parish of St. Landry sold and conveyed to Eliakim Littell of the same State and parish aforesaid his [Page 49] undivided third part of certain lands and slaves, and moveable property as will more fully appear by reference to said sale and whereas the said property or a part thereof is included in a joint Mortgage given by the said Moses & Eliakim Littell to the Union Bank of Louisiana to secure the payment of Stock in said Bank taken by the said Moses Littell to the amount of five thousand dollars, which said Mortgage he the said Moses Littell bounded himself to have released so far as he was interested therein and whereas it has been subsequently agreed by and between the said parties that the said Eliakim Littell shall take the said Stock on his own account & let the mortgage remain unreleased. Now therefore for and in consideration of the sum of eight hundred dollars Cash in hand paid on the first day of May last from which day this sale shall have effect he the said Moses Littell has bargained and sold and does hereby grant bargain sell alien and confirm, transfer and convey to him the said Eliakim Littell his said shares in the aforesaid Union Bank of Louisiana amounting to the sum of five thousand dollars. In Testimony whereof the parties have hereunto signed in presence of Benoist Debaillon and William Moore competent Witness and before George King Parish Judge in & for the aforesaid Parish of St. Landry at Opelousas this twenty first day of September One thousand eight hundred and thirty six.
