All rights reserved. http://usgwarchives.net/copyright.htm http://usgwarchives.net/la/lafiles.htm ********************************************** Lenard Smith & wife To Caleb Swaize and Rice Garland Power of Attorney Recorded 26 July 1836 Know all men by these presents that we Lenard Smith and Eliza his wife of Allegany County on the State of Maryland, for divers good Causes and consideration as hereunto moving have made, ordained Constituted, authorised, nominated and appointed and by these presents do make nominate, ordain, Constitute and appoint, Rice Garland and Caleb L. Swayze of the Town of Opelousas in the State of Louisiana, by the name and firm of Garland and Swayze partners in the practice of the Law our true and lawful attornies [sic], for us and in our name place and stead and for our own proper use and benefit, to ask demand, sue for recover and receive of and from all persons whatsoever, all such sum or sums of money, debts and demands, legacies and bequsts [sic] whatsoever which are now due and owing unto me the said Leonard as one of the grand children of Elizabeth Smith late of the State of Louisiana deceased, and for as such in our stead, place and name to sue for recover all and ev[e]ry part of the real Estate of the said Elizabeth Smith which according to the laws of the State of Louisiana and of the United States was devised, or descended to the said Leonard as one of the grand children & heirs at law of the aforesaid Elizabeth by and through his deceased father Gather John Smith, and by these presents as our attornies in fact and in law to bargain & sell all of our interest of in and to all such land and real Estate as may be divided, or desdescended [sic] to the said Leonard from his Grandmother aforesaid, lying and being in the State of Louisiana, and to make over and convey all our right,, title interest and claim of us the said Leonard and Eliza his wife of in and to the same to such person or persons as shall or may purchase the same at such price or prices & on such terms as shall or may be aggreed [sic] upon for us and in our names by Garland and Swayze our attornies in fact & in law or either of them, and also for us and in our names and stead and as our own proper act and deed to sign, seal and deliver and acknowledge all such deed or deeds of conveyances as shall be necessary for the absolute granting and assigning the premises unto the purchaser or purchasers in fee simple giving and granting unto our said Attornies or either of them by these presents our full and whole power and strenght [sic] and authority in and about the premises to have use and take all lawful way and means in our names for the purposes aforesaid, and upon the receipt of the purchase money for the sale of the aforesaid real Estate, to make and seal all sufficient release, acquitances and discharges, and finally all and every other act or acts whatsoever, device or devices in the law needful and necessary to be used and done about the premises for us and in our names to do and execute as fully and amply to all intents and purposes we ourselves might or could do if personally present, Hereby ratifying allowing & confirming all and whatsoever our attornies Shall lawfully do and in and about the premises by virtue hereof. In witness whereof we have hereunto set our hands and seals this 24 day of May in the Year of our Lord One thousand eight hundred and thirty six. Signed sealed and delivered in presence of us Jacob Clamnier Peter McClury Leod Smith (seal) Eliza Smith (seal) State of Maryland, Allegany county towit Be it remembered that on this 24th day of May 1836 personally appeared Leonard Smith and Eliza his wife before us the subscriber here protectors of the peace of the State of Maryland in and for Allegany County, there being personally known to us to be the persons named in the aforegoing instrument of Writing, or power of attorney and severally acknowledged the said instrument of Writing, or power of Attorney to be their act and deed, and the said Eliza having signed and sealed said instrument of writing or power of attorney before us out of the presence of her husband and out of his hearing and the said Eliza being by us first examined out of the presence and hearing of her husband, w[h]ether she doth execute and acknowledge the same freely and volentairly [sic], and without being induced to do so by fear or threats of or ill usages by her husband, or by fear of his displeasure, declareth and saith that she doth. In testimony whereof we hereunto Subscribe or name the day and Year aforesaid Jacob Cammer - Peter MClury Maryland, Allegany County, towit --- I hereby certify that Jacob Clammer & Peter McClury Gentlemen before whom the within power of Attorney was acknowledged and who have hereunto set their names were at the time of so doing Ju[s]tice of the peace duly commissioned & sworn in and for said County & State.
