Hardy Sale of Land Recorded 23 July 1836 This Deed made the twety [sic] third day of July in the Year one thousand eight hundred and thirty six between Henry Miller of the State and Parish of St. Landry on the one part, and Thomas S. Hardy of Prince George's County & State of Maryland of the other part Witnesseth, That for and in consideration of the premises hereinafter expressed he the said Henry Miller has bargained and sold, and does by this act grant bargain, sell set over alien and confirm unto him the said Thomas S. Hardy a certain tract or parcel of land situated in the aforesaid Parish of St. Landry and lying on the Bayou Bourbeaux, bounded by said bayou, and lands of June Meche, Philip Richard fils, George Washington Gardiner, Gerasime Richard & David Meche containing five hundred and forty six & fifty two hundredths superficial Arpens more or less, and being the same land acquired by the seller by purchase at the sale of the estes. [estates] of Philip Richard and Louis Richard deceased. To have and To hold the aforesaid tract of land with its privileges and appertenances [sic] to him the said Thomas S. Hardy his heirs, executors, administrators and assigns forever and he the said Henry Miller for himself his heirs executors and administrators the tract of land so described as aforesaid with all and singular its appertenances and privileges against the lawful claims of all persons whatsoever to him the said Thomas S. Hardy his heirs, executors, administrators and assigns does warant [sic] and will forever defend. This sale is made for and in Consideration of the sum of five thousand four hundred and sixty five dollars and twenty cents, being at the rate of ten dollars per superficial arpent, and if on actual Survey of said land there should be more than the quantity above mentioned the surplus will be at the same rate, and if less the deficiency will be deducted from the above mentioned sum at the rate of ten dollars per superficial arpent. The purchase money is made payable by three equal instalments [sic], (towit) one third on the first day of April next 1837 with interest at the rate of ten percent per anum [sic] from the date hereof, one third on the first day of April in the Year one thousand eight hundred and thirty eight with interest thereon at the rate of ten percent per anum [sic] and after the twenty third day of July (1837) until paid, and the remaining third on the first day of April on[e] thousand eight hundred and thirty nine with interest thereon at the rate of ten percent per annum from and after the twenty third day of July 1838, until paid. It being stipulated and agreed that the aforesaid bargained and sold premises shall remain specially mortgaged to the sellor [sic] to secure the payment of the aforesaid sums of money and the interest which may accrue thereon until the entire payment thereof. And further to secure the payment of the aforesaid purchase money to the seller William Frederick Hardy of the State of Louisiana & Parish of St. Landry aforesaid binds himself his heirs &c as security for the same as well as for the interest which may accrue thereon. The purcha[s]er dispenses with the production of the certificate required by the 3328th Article of the Civil or Louisiana Code. In testimony of all which the parties and security have hereunto signed & affixed their seals in presence of Caleb Green Junr. and Raphael J.
