Sandoz & Andrew Meynier ----------------------- Deliberation of the Police Jury of the Parish of St. Landry. Tuesday 7th September 1852. The Jury met pursuant to adjournment present as before and Mr. Akenhead. On motion, Mr. Akenhead was permitted to record his vote in the affirmative for the Rail Road Tax. Mr. Harris presented the petition of Clement Hollier pere cause to be surveyed the Public Road that runs between his lands and that of T. H. Lewis. Mr. Gantt presented the report of the Jury, laying out and tracing a public Road, from Bayou Waxe to Bayou Boeuf. On motion Mr. Haris, Lastie Nezat was permitted to explain his petition to abolish the road across his land, when. On motion of Mr. Wright Resolved that the public road laid out --- across the land of Lastie Nezat and adopted 3d March 1851. (see Book D page 208) be and the same is hereby abolished. On motion Mr. Haris, the petition of C. Hollier pere was taken into consideration and Mr. Hollier was permitted to explain, when, On motion of Mr. Wright, the petition was laid on the table. Resolved, the Felix Dejean be and is appointed Captain of Patrol in the 8th ward and that he be chairman of the Jury, appointed to change the road near his land. Mr. Harris, moved to grant the prayer of the heirs of Boisdore and retrocede ---- which motion the President ruled to be out of order. Mr. Harris applied 2 Nay's Messrs Harris and Wright Ayes 3, so the decision of the chair was sustained. Mr. Dunbar moved that the President be authorized to sell the land for the taxes to the heirs of Boisdore. ---- motion withdrawn. On motion of Mr. Harris, Resolved unanimously that, "An Ordinance, providing for the subscription by the Parish of St. Landry to the Stock of the New Orleans, Opelousas and Great Western Rail Road Company," be and is adopted. Resolved. That "An Ordinance providing for an election to ascertain by a vote of the landed proprietors of the parish of St. Landry, their approval or rejection of "An Ordinance levying a tax to subscribe to the capital stock of the New Orleans, Opelousas and Great Western Rail Road Company." be and is adopted. Was presented a petition to change the Public Road at Mountville, a petition of the inhabitants for a Public Road from the Bridge at Felix Dejean's direct to Washington. On motion of Mr. Harris, The Jury had a recess, and having reassembled, present as before. On motion of Mr. E. Wndrus, Resolved, The elections of the 2nd ward, shall hereafter be held at the House of Francis Trainer in Washington, and that Gerand Carriere and John Reed, be appointed commissioners of election in said Precinct, in place of T. M. Anderson and J. G. Fitzgerald resigned. On motion of Mr. Devillier, Resolved, That a part of the public road from Bayou Fuselier to the Bayou Bourbeaux, that strikes the land of A. Debaillon, shall from thence be changed and that the following mamed freeholders, to wit: Francois Marks, Isaac Kennison, Simon Marks, Portalis Castille, Louis Marks, and Hypolite Savoi, be and are appointed a jury to trace and lay out said change, and make return thereof according to law. Resolved, That Napoleon Robin, be and is appointed Captain fo Patrol, in the 3rd ward, in place of J. M. Carriere resigned. Resolved, That commissioners be appointed to examine the Bayou Fuselier at its junction with Bayou Teche, and together with such commissioners as may be appointed by the Parish of St. Martin, make a report of the costs of a draw bridge over said Fuselier, the commissioners to receive no pay. Messrs. F. C. Devillier, Jos. Berrault and Ant. Arnaud were appointed. On motion of Mr. Jo. E. Andrus, Resolved, That the report of the Jury of freeholders, appointed to trace and lay out a public road from, at or near the 13th Mile Post, on the road from Opelousas to Huffman's bridge, by Hay's bridge, to Daigle's ferry and thence to some ferry on Bayou Nez Pique, be and the same is adopted and declared to be a public road. On motion of Mr. Dunbar, the Jury adjourned until to-morrow at 10 o'clock, A. M. Wednesday, 8th September 1852. The Jury met pursuant to adjournment. Messrs. Akenhead and Boudreau, absent. On motion of Fontenot, Resolved, That a public road shall be opened and made from Prudhomme's bridge to Peloquin's ferry, and that the following named freeholders, to wit: Joseph Z. Fontenot, Hypolite Teller, Francois Aguilard, John H. McGee, Thomas H. McGee, Joseph Young and Gilbert David, be and are appointed, a Jury to trace and lay out said road, and make due return thereof according to law. Resolved, That a warrant issue for four hundred dollars, to Messrs. McGee's for building Prudhomme's bridge. Resolved, That the pauper Ellen Turngate, deaf mute and her child be placed under the charge of Joseph Z. Fontenot, and that he receive her pay. Resolved, That the place of holding elections in the 8th Ward shall hereafter be at John H. McGee's in place of at Gilbert Davis's. Mr. Fontenot moved the prayer of M. Galinier for the loan of the benches of the Court HOuse be granted. Motion lost. On motion of M. Guillory: Resolved that a warrant issue to Silas Harris, for building Deballion's bridge. Resolved that the rule be dispenced with, and that the widow of Gerard Jeansonne be placed on the list of paupers for the sum of thirty-five dollars, to be paid to Phillippe Stagg. On motion of M. Dunbar, Resolved that a further sum of three hundred dollars be appropriated to build a draw bridge over Bayou Crocodile, making in all the sum of one thousand dollars. Resolved that John D. Hudspeth be a commissioner of election in the 12th Ward, in place of P. Collins, resigned. Resolved, that on the third Saturday of October next, 1852, a poll shall be opened at the different precincts of election, in the 12th Ward of this Parish and held open between the hours of nine in the forenoon and three in the afternoon of the said day, to determine by a ballot of the legal voters of the Ward whether licences for drinking houses and shops shall be granted or witheld in said Ward by the Police Jury; That the Commissioners of election shall give notice thereof to be posted up, and make due return of the state of the polls to the President of the Police Jury, and cause the same to be delivered to the Clerk of the Jury without delay. On motion of M. Dunbar, Resolved that Article 2 of the Road law be dispensed with and that a part of the public road from Washington to Mountville be changed so as commencing at Mrs. Reeds, at Mountville, than in an Easterly direction to the Old Saw Mill of Dr. Littell's on the bank of the Courtableau and following said bank to the present bridge, on Crocodile; and that the following named freeholders to wit: Amos Webb, Peter Collins, John D. Hudspeth, Pierre Wartell, Henry S. Dunbar and John Edwards, be and are appointed a Jury of freeholders to trace and lay out said change, and make due return thereof, according to law. Mr. Dunbar moved, That an additional sum of one hundred and forty four dollars be appropriated for the bridge over Boeuf, at School House No. 3, which motion was lost. Ayes. Messrs. Dunbar, McBride, Teale and Meche, 4. ---- Nays, Messrs. Harris, E. Andrus, Devillier, CArte, Fontenot, Young, Jo. E. Andrus, Guillory, Gantt and Wright. On motion of Mr. Dunbar, Resolved, That the sum of one thousand dollars be and is appropriated to build all the bridges on the public road from Bayou Boeuf, to Bayou Rouge. Ayes, 11 ---- Nays, 3. On motion of Mr. Harris, Resolved, That plans for each of said bridges shall be exhibited on the same day they are let out to the lowest bidder. Mr. Guillory moved that said bridges shall be built of good Cypress Timber. Messrs. Devillier, Fontenot, Young, Guillory, Teal and Wright, voted in affirmative, 6, And Messrs. E. Andrus, J. E. Andrus, Dunbar, Gantt, McBride, Carte and Meche voted in the Negative, 7. The President voted in the affirmative and the motion was lost. Mr. Dunbar moved to take into consideration the subject of comutation tax, but consented to lay it over until the afternoon. Mr. Dunbar moved that the fine imposed in Article 8th, of "An Ordinance concerning the Police of Cattle, Horses and Mules within the Parish of St. Landry," shall hereafter be fifty dollars. Motion lost. Ayes 6 ---- Nays 8. Mr. Dunbar moved that one hundred copies of Law, Organizing the Police Juries, be printed for the use of the Jury, motion lost. Messrs. Carte, Dunbar, Wright and Meche, boted Aye. 4. --- Messrs. Harris, E. Andrus, Devillier, J. E. Andrus, Fontenot, Young, Guillory, Gantt, McBride and Teale, voted Nay, 10. Mr. Gantt moved that all persons who have filed accounts at this session as commissioners shall be paid three dollars per day for each day actually employed, and ten cents per mile necessarily traveled. motion lost, Ayes 4. ---- Nays. 10. On motion of Mr. Carte, the Jury having reassembled and Mr. Akenhead. Lyon, Carron Bridge, 140 Marcel Richard, Coffin for a Pauper, 10 Mr. Gantt further reported, that, for further information, the committee had laid over, the claim of the Parish of Rapides of $275, as part of the parish of St. Landry, for runing the Boundary line between the two parishes, as per act of the Legislature of 1852, page 87. Also the accounts of Magistrates, Jurors, Constable and Witness, in the case of State, vs. slave of G. W. Addison. And recommend that the accounts of Harrison Rogers for bringing in the returns of the elections held in April and June 1852 be refered to the Clerk, who shall produce the receipts for, and that the other claimants file their accounts, to be laid before the Jury. On motion the report was adopted. On motion of Mr. Gantt, Resolved, That the report of the road laid out by the Jury of freeholders, from Bayou Waxe to the Bayou Boeuf, on 7th July 1852, be, and is adopted and declared to be a public Road. Mr. Gantt reported that the bridges over Bayou Waxe and Cow Bayou, had been let out to Bryant Stapleton for four hundred dollars. Mr. McBride moved that a warrant issue to James Morgan for the full amount of the appropriation for building the bridge over Waxe, called Morgan's Bridge, which motion was lost. Ayes, 3, ---- Harris, Dunbar, Gantt and McBride. Mr. Morgan was permitted to explain. On motion of Mr. McBride, Resolved, That the sum of one hundred and fifty dollars are appropriated to repair the bridge over Bayou Petite Prairie, at McBride's and that James Morgan, J. McBride and Arum J. Kink, be commissioners. Resolved, That Thomas Stapleton, be commissioner of election in the 15th ward in place of Woods. On motion of Mr. Teale, presented the following, and moved its adoption. Resolved, That the requisites required in Article 2 of the road law, be dispensed with, and that a public Road shall be opened and made from Point aux Pins, to intersect the public Road near Flat Town, and that the following named freeholders, to wit: Which motion was lost. Ayes, 3. Messrs. J. E. Andrus, Teale and Wright. Resolved, That the rule be dispensed with, and that the Widow of Manuel Ortego, be placed on the list of Paupers, for the sum of thirty five dollars, to be paid to Eli Fontenot. Resolved, That David Young receive for Charles Harvey, a Pauper. Mr. Teale moved, That the residence of Charles Johnson, be designated as a precinct of election in the 16th ward, motion lost, Ayes, 5. --- Messrs. J. E. Andrus, Carte, Teale, Wright and Meche. Mr. Dunbar moved, That the commutation tax be now taken up and considered, which motion was lost. Ayes, 7. ---- Nays, 8. On motion of Mr. Harris, The President was excused from further attendance at this term. Mr. Akenhead was called to the chair. Mr. Wright moved that the boy Jacques Estelly, a Pauper, having no use of the right arm, or the left leg and now present, be placed on the list of Paupers, for the sum of forty dollars, and to be under the charge of James Myers. Resolved, That Antoine B. Carte be allowed and paid the sum of sixteen dollars, for his services as commissioner and planting mile posts. On motion of Mr. Harris, Resolved, That as Slates cannot, at this season, be procured to cover the public Prison, and as the same requires to be covered as soon as possible therefore the commissioners are required to cover the same with shingles of the best quality. On motion of Mr. Carte, Resolved, That Pierre Matte, Wm. Elkins and Lefroy Fontenot, are appointed to examine into the situation of Charles Chiason, and report under oath. On motion of Mr. Gantt, Resolved, That the Treasurer of this Parish notify Harrison Rogers, Sheriff of said Parish to settle with him, the Treasurer, all the accounts between him and said Parish according to law and pay into the Treasury any balance that may bve found due by him, and this on or before the first day of November, 1852, and in the event that said Sheriff shall fail or neglect to settle and pay over, the the Parish Attorney is directed to cause suit to be brought against said Sheriff. On motion of Mr. Akenhead, Resolved, That in the 16th ward, John P. Murdock is appointed Captain of Patrol, and Thomas H. Thompson and Robert Singleton, are appointed commissioners of election.
