MARY Before me, Charles Austin O'Neill, a Notary Public, duly commissioned and qualified in and for the Parish of St. Mary, State of Louisiana, and in presence of the witnesses hereinafter named and undersigned, personally came and appeared Ulysse Steib, Esq., herein acting as agent and attorney in fact of Mrs. Josephine Antoinette Steib, nee Becnel, widow of Landreaux Steib, and also as agent and attorney in fact of Roger Steib, Paul Steib, Philomina Steib, a femme sole of full age of majority, and Magdelaine Steib, also a femme sole of full age of majority, and of John. Steib and of Genevieve Steib and Landreaux Steib and Clovis Steib and Antoinette Steib, they being the widow and heirs of said Landreaux Steib, deceased and acting for himself individually as one of said heirs of Landreaux Steib. residents of Parish of St. James, State of Louisiana who declared and acknowledged unto me, Notary, that he did and does by these presents, GRANT, BARGAIN, SELL, TRANSFER, CONVEY, ASSIGN, SET OVER AND DELIVER unto Sylvestre Becnel, Esq., a resident of Parish of St. Mary, Louisiana here present, accepting and purchasing for himself and his heirs and assigns, all and singular, the following described property, to wit: The undivided one third (1/3) of that certain tract of land lying and being situated in the Parish of St. Mary, State of Louisiana, below or near the Town of Franklin, having a front of three and one half (3 ½) arpents on the West side of the Bayou Teche, by the depth of Forty (40) arpents between lines slightly diverging towards the Nor; and being bounded above by lands of Murphy J. Foster, in front by Bayou Teche, and below and in the nor by lands of Joseph Warmic (sic.?) Foster formerly of John B. Lyon, together with the same proportion of all of the buildings and improvements thereon situated and all the rights, ways privileges, servitudes, advantages and appurtenances thereunto belonging or in any means appertaining the thereunto this being the said property which was acquired by the said widow as portion in community and by the said heirs by inheritance from the said deceased Landreaux Steib, and acquired by the latter from Sylvestre Rouse, by purchase as appears by reference to the deed recorded in Book DD of Conveyance folio 20, of the recorder's office of the said Parish of St. Mary. To have and to hold the said property and appurtenances unto the said purchaser and unto his heirs and assigns, in full property forever, free from any lien, mortgage or encumbrance whatever, with out warranty of title, but with full subrogation to all the rights of warranty and all other rights as held therein by said vendor. This sale is made and accepted for and in consideration of the price and sum of Three Thousand Four Hundred and Sixteen and 66 2/3 /100 Dollars payable as follows, to wit: The sum of one thousand and sixteen dollars and sixty-six and two thirds cents is paid in cash at the execution of this deed, the receipt whereof is hereby acknowledged and for which good and valid acquittance and discharge are hereby given: the sum of six hundred dollars shall be payable on the 1st day of January, 1910; and this portion of said purchase price is represented by the Widow's promissory note, drawn by said vender of this date, made payable in four (4) equal annual payable respectively on January 15, 1904, and on the corresponding day of the years 1905, 1906, 1907 as representing which credit portion said vendee has made, drawn and signed his several four promissory notes made payable at the epochs aforesaid to the order of himself and endorsed by him; with interest thereon at the rate of Eight per cent per annum from this date until paid. Which said promissory notes after having been paraphed No Varietur by me, the undersigned Notary, for identification with this act have been delivered to said Ulysse Steib who acknowledges the receipt thereof as well as the cash portion of this sale. And in order to secure the punctual payment of the above described promissory note at maturity, as well as of all interest to accrue thereon, and in order, furthermore, to secure the payment and reimbursement of the fees of any and all lawyers who may be employed to collect the same, in principal and interest, or any part thereof, and whether with or without suit (which lawyer's fees, however are fixed at ten (10) per cent on the amount collected, and said purchaser consents and agrees to pay and allow the same) the said purchaser hereby specially mortgages affects and hypothecates the herein described and conveyed property unto and in favor of the said vendors as well as of any and all future holder of holders of said promissory notes without necessity of Notarial act of transfer, promising and binding himself and his heirs not to sell, alienate nor encumber the said property to the prejudice of this act, nor of the vendor's lien or privilege and special mortgage hereby retained by said vendor (for themselves and for any and all future holders of said note) and granted by the said purchaser on said property until the full and final payment of said promissory notes. Said purchaser further declared that in case of the non-payment of all or any portion of said promissory notes as stipulated, it shall be lawful for and he does hereby authorize any holder or holders thereof to cause all and singular the herein described and conveyed property to be seized and sold under executory or other legal process (issued by any competent court) without appraisement of property sold under executory or other legal process, said purchaser hereby confessing judgment in favor of any and all holder or holders of said promissory notes for the full amount thereof, together with all interests thereon, costs and attorney's fees. The parties hereto agree to dispense with the production of the certificate required by Article 3364 of the Revised Civil Code of this State, and do hereby exonerate me, the undersigned Notary, from all liability in the premises. All taxes due to the State and Parish upon the property herein conveyed have been paid up to and including those due December 31, 1902 as is evidenced by the certificate of the State Tax Collector following hereto and made a part hereof. Thus done and passed at my Office at Franklin, in the Parish of St. Mary, State of Louisiana, on this 16th day of July 1903 in the presence of John Downing Morris and Thomas P.
